DEED OF PERPETUAL GRANT OF ROAD RIGHT OF WAY

KNOW ALL MEN BY THHESE PRESENTS:

This DEED, made and concluded by and between:

JOEMEL L. CATAPANG, EDDIE LUGAN, CARMELITA I. LUGAN,


CARMELITA LUGAN, KELVIN SETH LUGAN, VERNON REY LUGAN, MC BRYAN
LUGAN, MARK ANGELOU G. LUGAN, RAFY JAY MAREGMEN LUGAN, the minors,
ARLLAN JOHN LUGAN, PRINCESS MAE LUGAN and KENEY MARK G. LUGAN, all
of legal age, except the latter three mentioned minors, Filipino citizens, and all residing and with
postal address Poblacion, T’boli, South Cotabato, all represented herein by their Attorney-In-
Fact, MANUEL GLOYAN, likewise of legal age, married, Filipino citizen, resident of
Poblacion, T’boli, South Cotabato, by virtue of executed Special Power of Attorney dated Aug.
20, 2018 under Doc. No. 49, Page No. 10, Book No. XI, Series of 2018 before Atty.
EDILBERTO E. PAMA Notary Public (hereinafter collectively referred to as “GRANTOR”).

HORMIGAS, and DENNIS B. MALASADOR, all of legal age, Filipino, and all residing at
Purok Lugan III, Poblacion, T’boli, South Cotabato, represented by their Attorney-In-Fact,
JOEMEL L. CATAPANG, also of legal age, married, Filipino with residence and postal
address at Poblacion, T’boli, South Cotabato, by virtue of executed Special Power of Attorney
(SPA) dated October 5, 2016 under Doc. No. 63, Page No. 13, Book No. XLVII, Series of 2016
before Atty. BENJIE G. ESPINOSA; including the KENOON VILLAGE HOMEOWNERS
ASSOCIATION (KVHOA), INC., a community association duly organized and existing under
Philippine laws with HLURB Certificate of Registration No. 17313, and with office and postal
address at Poblacion, T’boli, South Cotabato, represented by its president Salvecio B. Dagang as
the would-be beneficiaries of the portion of the property of the former (hereinafter collectively
referred to as the “GRANTEE”).

WITNESSETH:
That, WHEREAS, the GRANTOR is the registered owner of a parcel of land located at
Poblacion, T’boli, South Cotabato, embraced and covered by Transfer Certificate Title (TCT)
No. T-8564, of the land Registry of Deeds of Koronadal City, more specifically described as
follows:

Lot No. 136, Pls-555, Case 1
Beginning at a point marked “1” of lot No. 136 Pls-555, Case 1,
being N. 60-23, 1568.01m. from BLLM No. 1, Banga, Cotabato, thence S. 62-
37., 135.17 m. to point 2; N. 05-15 W., 324.28m to point 3; N. 25-40 W., 103.64
m. to point 4; N.73-53 E., 35.32 m. to point 5; N. 69-43 E., 36.99 m. to point 6;
S. 10-26E., 74-10 m. to point 7; S. 15-10 E., 215.64 m. to point 8; N. 63.01 E.,
136.59 m. to point 9; S. 11-49 E., 113.24 m to pint 1, point of beginning
containing an area of FORTY THREE THOUSAND FIVE HUNDRED
FORTY FIVE (43,545) SQUARE METERS, MORE OR LESS.

That, WHEREAS, the herein GRANTOR is the land owner of the adjacent lot of the
GRANTEE, of which the latter had no access to the existing Road;
That, WHEREAS, the GRANTOR is GIVING or GRANTING the GRANTEE their
right of perpetual passage, ingress or egress over the Road Lot, which is the subject matter of the
aforesaid ROAD RIGHT OF WAY AGREEMENT effective from the date hereof and in
perpetuity;
That, WHEREAS, herein the GRANTOR is willing to have the grant of perpetual
passage annotated in the TCT No. T-8564 to protect the rights of the GRANTEE over the said
Road Lots;
Now, THEREFORE, for an in consideration of the foregoing premises, the GRANTOR
and the GRANTEE, agreed, as they hereby agree, to have the granted road right of way of the
said Road lots be used by the members of the Kenoon Village Homeowners Association
(KVHOA), Inc., the would be beneficiaries of the portion of the property of the GRANTEE
subject of the Deed.
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands on this
