DEED OF HEIRSHIP, EXCHANGE AND ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by, BIENVENIDO F. BERNARDINO, RUBEN
SIAO, both of legal age, married, Filipinos, and a resident of Lopez Jaena Street, San Roque,
Cavity City, and barangay Poblacion, Municipality of Sibulan, Negros Oriental, respectively6,
hereinafter called the First Party; and,

JULIANA F. SANICO, likewise of legal age, Filipino, married, and a resident of

barangay Poblacion, Sibulan, Negros Oriental, hereinafter referred to as the VENDOR;

WITNESSETH:

That in a Deed of Extrajudicial Settlement and Partition, known as Doc. No. 34; Page No.
8; Book No. XIX; Series of 1999; notarized by Myra Triplit, Notary Public, RUBEN SIAO
acquired Lot No. 139-G while ADELA F. BERNARDINO acquired Lot No. 139-I;

That ADELA F. BERNARDINO died intestate in May 24, 2007, leaving without any
testamentary will nor debts not settled until the present; and upon her death she was survived by
her only son and compulsory Heir, BIENVENIDO F. BERNARDINO
NOW THEREFORE, invoking the provisions of Section 1, Rule 74 of the Rules of Court,
the herein BIENVENIDO F. BERFNARDINO have settled and adjudicated unto Himself, the
aforementioned Lot No. 139-I, consisting of NINETY NINE (99) Square Meters, more or less;

That by virtue of these presents the First Party herein have agreed to exchange their
shares in the following manner: that Lot No. 139-I supposedly the share of Bienvenido F.
Bernardino is hereby exchange to Lot No. 139-G.; and Lot No. 139-G supposedly shared to
Ruben Siao is exchange to Lot No. 139-I; henceforth, Lot No. 139-I, shall now belong to Ruben
Siao and Lot No. 139-G, shall belong to Bienvenido Bernardino;

WITNESSETH FURTHER:

That for and in consideration of the sum of FIFTY THOUSAND PESOS (Php 50,000),
Philippine Currency, in hand paid by the herein Vendee, JULIANA F. SANICO and receipt in
full is hereby acknowledged by the Heir-Vendors to their entire satisfactions and that by virtue
of these presents, the herein Heir-Vendor, BIENVENIDO F. BERNARDINO, does hereby SELL,
TRANSFER, and CONVEY unto the vendee, her heirs and assigns, all the vendors’ rights,
interests and participations over the aforementioned parcel of land, Lot No. 139-G, including all
the improvements found therein, free from all liens and encumbrances;

That the vendor herein declares that due notice has been given to all persons affected by
this transaction in compliance with the provisions of the New Civil Code of the Philippines,
pertaining to the rights of the redemptioner and preemptioner, but nobody opted to exercise the
said rights and the sale of these parcels land is in consonance with the provisions of the
Comprehensive Agrarian Reform Law because this parcel of land is within the retention limits of
the vendors, and that the heir-vendors warrant their title and ownership over the said parcel of
land and will defend the rights of the herein vendees against any adverse claim whatsoever.

BEFORE ME, this ___day of December 2014, at Tayasan, Negros Oriental, personally
appeared RUBEN SIAO, who exhibited his Com. Tax Ccert. No.21338133, issued on January
28, 2014, at Sibulan, Negros Oriental, and JULIANA F. SANICO who exhibited to me her Com.
Tax Cert. No. 21430880, issued on January 29, 2014 at Sibulan, Negros Oriental, both known to
me to be the same persons who executed the foregoing deed, consisting of two (2) pages,
including this page of acknowledgement and all pages were duly signed by the parties herein,
together with her two instrumental witnesses and that they acknowledged to me that the same is
her free act and voluntary deed.
