DEED OF HEIRSHIP AND ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by, JESUS C. BANDICO, of legal age, Filipino,
married and a resident of Poblacion, Tayasan, hereafter called the HEIR-VENDOR, in favor of,

JESS C. LUZURIAGA, also of legal age, Filipino, married, and a resident of barangay
Cabulotan, Tayasan, Negros Oriental, hereinafter called the VENDOR;

WITNESSETH:

That Sotera C. Bandico is the declared owner of a certain parcel of land, situated in Callao
Street, Poblacion, Tayasan, Negros Oriental, with improvements therein, covered by Tax Declaration
No. 99-19-001-00268, consisting of Four Thousand Three Hundred Fifteen (4,315) Square Meters,
more or less;

That Sotera C. Bandico died intestate sometime ago, leaving without any known testamentary
will nor debts not settled until the present and upon her death she was survived by her legitimate
children and only compulsory heirs, and one of them is JESUS C. BANDICO;
NOW THEREFORE, invoking the provisions of Section 1, Rule 74 of the Rules of Court, the
herein Heir-Vendor, JESUS BANDICO, have settled and adjudicated unto himself whatever undivided
shares, rights and interest he has over the aforementioned parcel of land;

WITNESSETH FURTHER:

That for and in consideration of the sum of SIXTY THOUSAND PESOS (Php 60,000.00),
Philippine Currency, in had paid by the vendee, Jess C. Luzuriaga to the vendor herein, Jesus C.
Bandico and receipt in full is hereby acknowledged by the vendor to his entire satisfactions; and that
by virtue of these presents, the Heir-vendor, does HEREBY SELL, TRANSFER AND CONVEY unto
the Vendee a portion of his shares over the aforementioned parcel of land, with a measurement of Ten
(10) meters in width and Twenty (20) Meters, in length or around Two Hundred (200) Square Meters,
more or less; immediately fronting the Road, in favor of the vendee, his heirs, successors and assigns,
free from all liens and encumbrances;

That the vendors herein declare that due notice has been given to all persons affected by this
transaction in compliance with the provisions of the New Civil Code of the Philippines, pertaining to
the rights of the redemptioner and preemptioner, but nobody opted to exercise the said rights and the
sale of these parcels land is in consonance with the provisions of the Comprehensive Agrarian Reform
Law because this parcel of land is within the retention limits of the vendor, further, the vendor warrants
her ownership over the said parcel of land and will defend the rights of the herein vendee against any
adverse claim whatsoever.

IN WITNESS WHEREOF, we have hereunto affixed our signatures this ___day of October
2014, at Tayasan, Negros Oriental.

BEFORE ME, this ____day of October 2014, at Tayasan, Negros Oriental, personally appeared
the vendor, Jesus C. Bandico and Vendee, Jess C. Luzuriaga, who exhibited their community Tax
Certificates Numbers, 21243067, issued on January 21, 2014 and 21477752, issued on October 7,
2014, respectively and both issued in Tayasan,. Negros Oriental, both known to me to be the same
persons who executed the foregoing deed, consisting of two (2) pages, including this page of
acknowledgement and all pages were duly signed by them, together with their two instrumental
witnesses and that they acknowledged to me that the same is their free act and voluntary deed.
