AFFIDAVIT OF DESISTANCE
I, CHRISTINE JOY VIÑAS, minor, Filipino, single and resident of Brgy. 95-A,
Caibaan, Tacloban City, assisted by her grandmother Loreta M. Capeña, after having
been duly sworn to accordance with law, hereby depose and say:

1. That I am the private complainant in Criminal Case No. R-TAC-18-00263-CR

entitled “PEOPLE OF THE PHILIPPINES VS. ESMUNDO “MUNDO” DELA
CRUZ” for Rape (Art. 266-A, Par. 2 of the Revised Penal Code in rel. to
R.A. 7610, pending trial before the Regional Trial Court Branch 7 (Family
Court);

2. That considering the length of time and soul searching, I have come into
realization that I am no longer interested in the pursuit of the said case against
accused Esmundo “Mundo” Dela Cruz who is my step-father with whom I have
a good relationship with;

3. That I am now desisting in the further prosecution of the case and praying unto
this Honorable Court to immediately recommend the dismissal of the above-
mentioned case;

4. That I was never coerced, forced or intimidated into signing this affidavit of
desistance and further pray for the dismissal of the above-mentioned case of
which I am the private complainant.

IN WITNESS WHEREOF, I have hereunto set my hand this 29th day of October
