EXTRAJUDICIAL SETTLEMENT OF ESTATE WITH

ATTACHED DEED OF SALE

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT is made and executed in Cebu City, Philippines, by and

among/between:
1) FELIPA D. BINONDO, of legal age, widow, Filipino, and a resident of
Barangay Pasil, Abuno, Cebu City; and
2) LUZ S. OCAÑA, of legal age, married, Filipino, likewise a resident of
Barangay Pasil, Abuno, Cebu City.

WITNESSETH

WHEREAS, FELIPA D. BINONDO, is the sole heir, being the wife without any
children of the deceasedof ALFREDO FERRER BINONDO, who died intestate, a copy of
his Death Certificate is hereto attached as Annex “A”;
WHEREAS, the deceased ALFREDO FERRER BINONDO, who is married to
FELIPA DEBALUCOS is the absolute and registered owner of a parcel of land containing
an area of FORTY-FIVE (45) SQUARE METERS, located at Barangay Pasil, Cebu City,
covered by Transfer Certificate of Title No. 5365 of the Registry of Deeds of Cebu City
described as follows:

TRANSFER CERTIFICATE OF TITLE

A parcel of land (Lot 61, Blk. 6, of the subdivision plan, Psd-07-05-012636, being
a portion of Public Land, Pasil), situated in the Barangay of Pasil, City of Cebu, Island of
Cebu. Bounded on the NW. along line 1-2 by Lot 65. on the NE. along lines 2-3-4 by Lot
46 and along line 4-5 by Lot 45; on the SE. along line 5-6 by Lot 44; and on the SW.
along lines 6-7-1 by Foothpath 8, all of Block 6 of the subdivision plan. Beginning at a
point marked “1” on plan, being S. 54 deg. 13’E. 207.39 m. from BM No. 57, Cebu
Cadastre, thence N. is registered in accordance with the provisions of sections 103 of
the Property Registration Decree in the name of ALFREDO BINONDO, of legal age,
Filipino, married to Felipa Debalucos.

WHEREAS, ALFREDO FERRER BINONDO and FELIPA D. BINONDO has sold a

portion of their land consisting of TWENTY-THREE (23) SQUARE METERS to VICENTA
Q. SECUYA married to DEMETRIO G. SECUYA, duly evidenced by a DEED OF SALE
attached herein as enteredinthenotarialregisterofAtty.ect_______________;
WHEREAS, VICENTA Q. SECUYA and DEMETRIO G. SECUYAinturn sold
thesaidportionoflsnf above-mentioned portion parcel of land to LUZ S. OCAÑA, sister-in-
law of VICENTA Q. SECUYA, a copy of the DEED OF SALE is attached herein as Annex
“C”;
WHEREAS, the remaining TWENTY-TWO (22) SQUARE METERS parcel of land
covered under the Transfer Certificate of Title No. 5365, isin__________be fully
conferred to FELIPA D. BINONDO, as the sole heir of her deceased husband ALFREDO
F. BINONDO;
WHEREAS, pursuant to Rule 74, Section 1 of the Revised Rules of Court of the
Philippines, and being with full capacity to contract, I, FELIPA D. BINONDO, do hereby
adjudicate saidunsold portion of land consisting of TWENTY-THREE (23) SQUARE
METERS to LUZ S. OCAÑA, being the recent owner of said portion of land;
That I FELIPA D. BINONDO, hereby warrant our valid title to and peaceful
possession of the property herein sold and conveyed and further declares that the same
is free and clear of all liens and encumbrances of any kind whatsoever.

the foregoing EXTRAJUDICIAL SETTLEMENT OF ESTATE WITH ATTACHED DEED

deed. The foregoing instrument which relates to an Extrajudicial Settlement of
Estate consisting of two (2) pages including the page on which this
acknowledgement is written, has been signed on the left margin of each and
