DEED OF EXTRAJUDICIAL

SETTLEMENT WITH SALE


KNOW ALL MEN BY THESE PRESENTS:
THIS instrument is made and executed by and among JUANITO
VICERRA, , married to ZENAIDA VICERRA, the Heirs of JUANITA
VICERRA-UBIAS, represented by her children namely: CONSOLACION
UBIAS-BANGAYAN, married, HELEN UBIAS-CASTRO, widow and RAQUEL
UBIAS, single, NORMA VICERRA, married to Virgilio Reconoce, MILAGROS
VICERRA, widow, EDERLINA VICERRA married to Aurelio Jose, ELISA
VICERRA, widow and VISITACION VICERRA married to Rodolfo Pagaduan,
of legal age, Filipinos and residents of Newagac, Gattaran, Cagayan,
hereinafter referred as HEIRS,
WITNESSETH
1. That spouses FLORENCIO VICERRA and HONORIA UNDAY a.k.a.
LEONORA UNDAY died intestate in Gattaran, Cagayan on 8
January 1972 and 29 September 2003 respectively, leaving
certain property described as follows:
A parcel of land (Lot No. 858-1-B)
situated in Newagac, Gattaran,
Cagayan with an area of fourteen
thousand, seven hundred fifty-two
(14,752) square meters more or
less, covered by Transfer Certificate
of Title No. T- 99360.
2. That the above-named deceased spouses left no known debts
which has not been settled to this date.
3. That the HEIRS named in the first paragraph hereto are the sole
and only heirs of the above-named deceased spouses because
all of them are their children, except Consolacion UbiasBanganay, Helen Ubias-Castro and Raquel Ubias, who are their
grandchildren, being the children of Juanita Vicerra-Ubias.
4. That in the best interest of the said HEIRS to settle and partition
the above-estate extrajudicially conformably with Section 1, Rule
74 of the Rules of Court, thus, they adjudicate to themselves,
settle and partition the same in the proportion of one-seventh
(1/7) EACH or 2,107.42 square meters EACH, and this inheritance
is subject to Section 4, Rule 74.
5. That by virtue of unanimous agreement among the HEIRS, they
waive and renounce part of their inheritance such as the share of
JUANITO VICERRA is 4,752 square meters, and that the
balance of 10,000 square meters shall be divided among US
six (6) HEIRS in the proportion of 1,666.66 square meters
EACH.

PROVIDED, THAT the herein HEIR OF NORMA VICERRA sold her


share of 1,666.66 square meters to FLORENCIO VICERRA, married to
Daisy Vicerra for P15,000.00 and HEIR MILAGROS VICERRA also sold
to FLORENCIO VICERRA 1,218 square meters of her share for
P10,000.00 and that HEIR EDERLINA VICERRA-JOSE likewise sold
1,218 square meters of her share to IRISH VICERRA married to
Emerson Halcon for P10,000.00 and MILAGROS VICERRA sold to
JUANITO VICERRA 200,00.66 square meters from her share for
P5,000.00.
THEREFORE, by unanimous agreement of the HEIRS and the
buyers, FLORENCIO VICERRA and IRISH VICERRA, their respective
shares are as follows:
