“A RESOLUTION REQUESTING MS. MARITA L. MIÑAO, ACTING REGIONAL


DIRECTOR OF THE NATIONAL COMMISSION ON INDIGENOUS PEOPLES (NCIP)
REGION IX THROUGH MR. JUSTINO V. BAGSICAN, JR. PROVINCIAL OFFICER
OF THE NATIONAL COMMISSION ON INDIGENOUS PEOPLES ZAMBOANGA DEL
NORTE PROVINCIAL OFFICE TO ALLOW THE CONDUCT OF SELECTION
PROCESS FOR THE INDIGENOUS PEOPLES MANDATORY REPRESENTATIVE
(IPMR) TO THE BARANGAY LOCAL LEGISLATIVE COUNCIL (SANGGUNIANG
BARANGAY) OF THE BARANGAY TINAPLAN, SINDANGAN, ZAMBOANGA DEL
NORTE”

Whereas, Section 16 of Republic Act 8371 otherwise known as the Indigenous Peoples
Rights Act of 1997 provides that the Indigenous Cultural Communities/Indigenous Peoples
(ICCs/IPs) have the right to participate fully, if they so choose, at all levels of decision of
decision making in matters which may affect their rights, lives and destinies through procedures
determined by them as well as to maintain and develop their own indigenous political structures.
Consequently, the State shall ensure that the ICCs/IPs shall be given mandatory representation in
policy-making bodies and other local legislative councils;

Whereas, R.A. 8371 also provides that the Indigenous Political Structure (IPS) is the
recognized highest governing body in every Indigenous Cultural Communities/Indigenous
Peoples (ICCs/IPs) or Ancestral Domain;

Whereas, the Subanen in the Barangay Tinaplan, Sindangan, Zamboanga del Norte is an
identified Ancestral Domain covered in South Sindangan Ancestral Domain;

Whereas, the Barangay Tribal Council of Tinaplan, Sindangan, ZN. composed of the
Timuay as head, and the Salilings, Balyan and Panday Bata of the aforesaid barangays as
members duly validated and recognized by the National Commission on Indigenous Peoples
(NCIP) Community Service Center situated at La Roche, Sindangan, Zamboanga del Norte;

Whereas, the National Commission on Indigenous Peoples (NCIP) provides NCIP


Administrative Order No. 1 s, of 2021 otherwise known as the 2021 Revised National Guidelines
for the Mandatory Representation of Indigenous Peoples (IP) in the local legislative councils and
policy-making bodies;

Whereas, the NCIP Chairperson issued Memorandum Order No. 352 suspending the
conduct of IPMR selection process in all levels;

Whereas, item no. 3 of the aforementioned memorandum provides that if in case an


IPMR selection is allowed to proceed, a Community Resolution affirming the conduct of the
selection shall be submitted and it should be signed by the Indigenous Political Structure (IPS) or
majority of the validated decision-makers identified in accordance with customary law and shall
contain the name of the nominees, the name of the selectors and the copy of the local guidelines;

Whereas, we, the concerned leaders/elders/IPS members of our Ancestral domain in the
Barangay Tinaplan, Sindangan, ZN being the representative of our community had convened and
discussed about the said memorandum and had finally agreed to request the concerned NCIP
Community Service Center of the 2nd congressional district situated at La Roche, Sindangan,
Zamboanga del Norte to conduct and facilitate the IPMR activities as we had seen the
importance of having a representative to the local legislative councils who will protect and
promote our interest and well-being within our ancestral domain;
1. Resolution Requesting the conduct of IPMR Selection Process.
Whereas, in response, personnel of the concerned NCIP Community Service Center had
conducted the information education consultation/campaign on NCIP A.O no. 1 s, of 2021 had
facilitated and assisted the reformulation and adoption of our Indigenous Peoples (IP) local
guidelines for the mandatory representation of Indigenous Peoples to the local legislative
councils and policy-making bodies;

Whereas, after the finalization of our guidelines, we, the concerned IP leaders/elders/IPS
members of our Ancestral domain had unanimously decided to forth with undertake the selection
of Indigenous Peoples Mandatory Representative (IPMR) in the Sangguniang Barangay (SB) of
our Barangay for us to be given due recognition in terms of our social, economic and cultural
development within our ancestral domain;

Whereas, having an Indigenous Peoples Mandatory Representative (IPMR) to the


Sangguniang Baranagay (SB) of our barangay plays an indispensable role in the revitalization,
recognition, protection and promotion of our rights, welfares and cultures that has been long
disregarded;

Whereas, the proposed IPMR selection process to the Sangguniang Barangay (SB) of
Brgy. Tinaplan, Sindangan, Zamboanga del Norte will be held a Selection Process upon your
approval;

Whereas, as per approved local guidelines, the names of the NOMINEES for the
selection process will be determine only upon the declaration of the Selection Committee on
the final list of qualified nominees within two (2) days before the actual date of the
selectionprocess;

Whereas,as per approved local guidelines, the SELECTORS for the selection of IPMR in
the Sangguniang Barangay shall be the validated Timuay, Saliling, IPS members of barangay
Tinaplan, to wit:

Whereas, the selection of IPMR for the Sangguniang Barangay will be attended by the
staff of the concerned NCIP Community Service Center of the 2nd Congressional District
situated at Brgy. La Roche, Sindangan, Zamboanga del Norte;

NOW THEREFORE, the foregoing premises considered, WE, the concerned IP


elders/leaders/IPS members of the Barangay Goleo, South Sindangan Ancestral Domain, on
unanimously accord, RESOLVED as it is hereby RESOLVED to REQUEST MS. MARITA
L. MIÑAO, ACTING REGIONAL DIRECTOR OF THE NATIONAL COMMISSION ON
INDIGENOUS PEOPLES (NCIP) REGION IX THROUGH MR. JUSTINO V.
BAGSICAN, JR. PROVINCIAL OFFICER OF THE NATIONAL COMMISSION ON
INDIGENOUS PEOPLES ZAMBOANGA DEL NORTE PROVINCIAL OFFICE TO
ALLOW THE CONDUCT OF SELECTION PROCESS FOR THE INDIGENOUS
PEOPLES MANDATORY REPRESENTATIVE (IPMR) TO THE BARANGAY LOCAL
LEGISLATIVE COUNCIL (SANGGUNIANG BARANGAY) OF BARANGAY
TINAPLAN, SINDANGAN, ZAMBOANGA DEL NORTE”

Resolved further, to attach copy of our APPROVED Indigenous Peoples (IP) local
guidelines as annex of this resolution for information and reference;

Resolved Finally, to submit copy of this resolution to the Office of the Regional Director
of NCIP Region IX through the Provincial Officer of NCIP Zamboanga del Norte Provincial
Office, Dipolog City copy furnished NCIP Community Service Center Sindangan, Zamboanga
del Norte.
