all Filipinos, and of legal ages, and residents of Pobalacion, Baclayon, Bohol, Philippines,
hereinafter called the HEIRS;
WITNESSETH:
WHEREAS, the late spouses Antonio Oppus-Uy and Gardenia Jayag-Uy, both died
intestate and without known unsettled debts on October 30, 2004 in Ramiro Community
Hospital, Gallares St., Tagbilaran City, Philippines, and September 10, 2014 in Englewood
Hospital, Bool St., Tagbilaran City, Philippines, respectively, and survived by the above-named
heirs;
WHEREAS, the late spouses Antonio Oppus-Uy and Gardenia J. Uy, during their lifetime
were the owners of a several parcels of land which are more particularly described and
bounded as follows:
“A parcel of land (Lot No. 38, Cad-359-D) situated in Poblacion (formerly: Poblacion Obo),
Baclayon, Bohol. Bounded on the E., along line 1-2 by Lot 37, Cad-359-D; on the S., along line 2-3
by National Road; on the W., along line 3-4 by Lot 39, Cad-359-D; on the NE., along line 4-1 by
Lot 40, Cad-359-D. x x x x x Containing an area of ONE HUNDRED NINETY SEVEN (197) Square
Meters, more or less, registered in the name of Antonio Oppus Uy, of legal age, Filipino, married
to Gardenia Jayag and a resident of Poblacion, Baclayon, Bohol.”
“A parcel of land (Lot No. 6793, Cad-359-D, Case No. 8), situated in the Barrio of San Roque,
Municipality of Baclayon, Province of Bohol, Island of Bohol. Bounded on the W., along line 1-2-
3-4-5 by Lot No. 6792; on the NW., along line 5-6 by Lot No. 6798; on the NE., along line 6-7 by
Lot No. 6797; on the E., along lines 7-8-9-10 by Lot No. 6794; on the S., along lines 10-11-12-13-
14 by Lot No. 6784; on the SW., along line 14-1 by Lot No. 6790; all of Cad 359-D. x x x x x
Containing an area of FOUR THOUSAND ONE HUNDRED SIXTY EIGHT (4,168) SQUARE METERS,
more or less.”
WHEREAS, the late Gardenia J. Uy, during her lifetime was the owner and possessor of
several retail treasury bonds and unit investment trust fund from Metropolitan Bank and Trust
Company, herein described as follows:

WHEREAS, it is to the convenience and advantage of the above-named HEIRS that the
share of the late Antonio Oppus-Uy and Gardenia J. Uy over the above-described parcels of land
and the rights and benefits from the several retail treasury bonds and unit investment trust
fund of Gardenia J. Uy from the Metropolitan Bank and Trust Company that are due to her
HEIRS be settle extrajudicially by the among themselves so that their respective shares,
interests and participation can be determined by mutual agreement and adjudication;
NOW THEREFORE, for and in consideration of the foregoing premises and invoking the
previsions of Sec 1, Rule 74, of the Rules of Court, the above-named HEIRS, being all of legal
ages and with full capacity to contract, hereto hereby agree, as they have in fact already agreed
to settle extrajudically the above-described parcels of land, including all the improvements
thereon, and several retail treasury bonds and investment trust fund by and among themselves,
in the following manner:

subject, however, to the limitations imposed under Section 4, Rule 74 of the same Rules of the
Court in favour of any possible heir, creditor, or co-owner who might have been deprived of his
lawful participation and share over the subject properties, retail treasury bonds and unit
investment trust fund and for a period of two (2) years from and after the date of execution of
this instrument;
That the above-described parcel of land is neither leased nor tenanted since October 21,
1972 and the same are free from any and all liens and encumbrances;
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands this
