EXTRAJUDICIAL SETTLEMENT OF ESTATE


AND SALE

KNOW ALL MEN BY THESE PRESENTS:

This EXTRA-JUDICIAL SETTLEMENT OF ESTATE AND


SALE, made and executed by and between:

MARIA S. FULMARAN, of legal age, single, Filipino and a resident


of Camanjac, Dumaguete City, Negros Oriental, Philippines hereinafter
referred to as HEIRS/VENDORS.

BERNARDO S. FULMARAN, JR. of legal age, married to Rogelia


Otao, Filipino and a resident of Camanjac, Dumaguete City, Negros
Oriental, Philippines hereinafter referred to as HEIRS/VENDORS;

-AND –

WELLEJUN LACRO PENOL, of legal age, married to Belenda


Callao Penol, Filipino, and a resident of Dumaguete City, Philippines
hereinafter referred to as the VENDEE.

- WITNESSETH –

That BERNARDO FULMARAN married to Caridad Salvoro, is


the registered owner of the parcel of land known as Lot No. 2888, covered
by Transfer Certificate of Title No. F-T-140, situated in Sibulan, Negros
Oriental, containing an area of NINE THOUSAND FIVE THOUSAND
SEVEN (9,507) square meters more or less.

That Bernardo Fulmaran and Caridad Salvoro died on October 26,


1989 & September 18, 1989, respectively in Dumaguete City.

That they were survived by their children, namely: Maria S.


Fulmaran and Bernardo S. Fulmaran, Jr.

That to the best knowledge and information of the heirs, the said
deceased left no debts whatsoever.

That the heirs/vendors are the heirs of Bernardo Fulmaran who died
without any will.

That the herein heirs being all of legal age, and with full civil
capacity to contract, hereby by these presents agree to divide and adjudicate,
as they do hereby adjudicate, unto themselves the afore-described real
property.

That pursuant to Rule 74, Sec. 1 of the Rules of Court the heirs
hereby adjudicate unto themselves the above-described parcel of land by
means of this instrument.

WITHNESSETH FURTHER

and by these presents we, the above heirs agree to transfer and convey a
portion of the above described parcel of land consisting an area of ONE
THOUSAND NINETY EIGHT (1,098) SQUARE METERS MORE OR
LESS unto WELLEJUN LACRO PENOL, of legal age, married to
Belenda Callao Penol, Filipino, and a resident of Dumaguete City, by way
of Sale to the above-named VENDEE, which portion is more particularly
described as follows :

“ Lot 2888-C

TP – 1 N 62 DEG 40’ W 92.27M.
1- 2 S 35 DEG 01’ E 6.08M.
2- 3 S 45 DEG 57’ E 14.40M.
3- 4 S 69 DEG 23’ W 63.14M.
4- 5 N 24 DEG 06’ W 18.05M.
5- 1 N 68 DEG 29’ E 56.57M.”

NOW THEREFORE, for and in consideration of the foregoing


premises and the sum of FOUR HUNDRED THIRTY THOUSAND
PESOS (P430,000.00) PESOS only, Philippine Currency, receipt of which
is acknowledged by the heirs/vendors, hereto hereby TRANSFER, and
CONVEY by way of Sale unto the said WELLEJUN LACRO PENOL,
married to Belenda Callao Penol, his heirs and assigns, the ONE
THOUSAND NINETY EIGHT (1,098) SQUARE METERS MORE OR
LESS free from all liens and encumbrances.

The VENDORS has complied with Articles 1620 to 1624 of the Civil
Code of the Philippines before this sale was executed and all those with the
right of pre-emption and/or redemption expressed no intention to exercise
their rights;

That this land is not tenanted nor worked upon by agricultural lessees.

SPECIAL POWER OF ATTORNEY


KNOW ALL MEN BY THESE PRESENTS:

We, MARIA S. FULMARAN, of legal age, single, Filipino and a resident


of Camanjac, Dumaguete City, Negros Oriental, and BERNARDO S.
FULMARAN, JR. of legal age, married to Rogelia Otao, Filipino and a
resident of Camanjac, Dumaguete City, Negros Oriental, Philippines, do
hereby name, constitute and appoint CHERRY LUZ STRENG, of legal
age, widow, Filipino and a resident of Bulwang, Mabinay, Negros Oriental,
Philippines, to be our true and lawful attorney-in-fact for us and in our name,
place and stead to do the following acts and things:

1. To process the Tax Identification Number of the parties,


Estate Tax, Capital Gains tax, and Documentary Stamp Tax , in the Bureau
of Internal Revenue, Dumaguete City for the transfer of a parcel of land,
known as Lot 2888-C situated in Sibulan, Negros Oriental, containing an
area of ONE THOUSAND NINETY EIGHT (1,098) SQUARE
METERS MORE OR LESS.

2. To sign all documents and papers which may be required by the


Bureau of Internal Revenue (BIR), Dumaguete City and other government
offices relative to the registration of the Extrajudicial Settlement of Estate
and Sale/Transfer.

3. To receive the documents/title and to sign receipts therefor.

4. To do whatever is proper and legal under the premises to carry into


effect the above given power of attorney.

HEREBY GIVING AND GRANTING unto our said attorney full


power and authority whatsoever requisite or necessary or proper to be done
in and about the premises as fully to all intents and purposes as We might
or could lawfully do if personally present, with power of substitution and
revocation, and hereby ratifying and conforming all that our said attorney or
her substitute shall lawfully do or cause to be done under by virtue of these
presents.

WE, MARIA S. FULMARAN, of legal age, Filipino, single and a resident
of Camanjac, Dumaguete City, and BERNARDO S. FULMARAN, JR., of legal
age, Filipino, married to Rogelia Otao, and a resident of Camanjac,
Dumaguete City, Negros Oriental, Philippines , after having been duly sworn
to in accordance with law, hereby depose and say:

That the land We sold to WELLEJUN LACRO PENOL, of legal


age, married to Belenda Callao Penol, Filipino,and a resident of Dumaguete
City, Negros Oriental, Philippines with an area of ONE THOUSAND
NINETY EIGHT (1,098) SQUARE METERS under Doc. No. ___, Page
No. ___, Book No. 37, Series of 2020 of Notary Public ATTY.
DOMINADOR B. UY, JR. on _____________ is our retention area or a
portion of my retention area of not more than five (5) hectares.

That the subject property has no pending case at the DARAB, or any of its
adjudicators, the DAR, the Courts or at the Office of the President.

That this Affidavit is executed in compliance with DAR Administrative Order No.
1, S-1989 as well as to show proof that the land subject or above-mentioned transaction
is a retention or portion of a retention area.

I, WELLEJUN LACRO PENOL, of legal age, married to Belenda Callao
Penol, Filipino, and a resident of Dumaguete City, Negros Oriental, Philippines, after
having been duly sworn to in accordance with law, hereby depose and say:

That I am the BUYER/TRANSFEREE of a portion parcel of land, known as Lot


No.2888-C covered by TRANSFER CERTIFICATE OF TITLE NO.F-T-140 situated
in Sibulan, Negros Oriental consisting an area of ONE THOUSAND NINETY
EIGHT (1,098) SQUARE METERS MORE OR LESS, by virtue of a document
known as Extrajudicial Settlement of Estate and Sale duly notarized by Atty.
Dominador B. Uy, Jr. as Doc. No. ___; Page No. ___; Book No. 37; Series of 2020.

That the above mentioned parcel of land is not tenanted nor cultivated by an
agricultural lessee in the concept of Land Reform;

That my total landholdings in the whole Philippines does not exceed five (5)
hectares;

That I execute this Affidavit to attest to the foregoing facts and in compliance
with the Department of Agrarian Reform ( DAR) Administrative Order No. 1, Series of
1989 as well as to show proof that land subject or above-mentioned transaction is a
retention or portion a retention area.
