DECLARATION OF HEIRSHIP AND SALE

KNOW ALL MEN BY THESE PRESENTS:

This Deed is made and executed by:

HECTOR MENDEZ ABORDO, of legal age, Filipino, married to Lucille S. Abordo,

with residence and postal address at Looc, Sibulan, Negros Oriental, hereinafter referred to as the
HEIR-VENDOR,
-in favor of-

MARIA JESUSA CIMAFRANCA SANTILLAN, of legal age, Filipino, married to

Christian Viray Santillan, with residence and postal address at Block 3 Lot 2 Damosa Fairlane
Subd. Lanang, Davao City, Philippines, hereinafter referred to as the VENDEE.

WITNESSETH:

WHEREAS, VICENTE MENDEZ is one of the registered owner and is entitled to ¼

share of Lot No. 989, situated in the Barrio of Looc, Municipality of Sibulan, Province of Negros
Oriental, under Original Certificate of Title (OCT) No. O-V 1048, containing an area of
THIRTY ONE THOUSAND THREE HUNDRED FORTY FOUR (31, 344) SQUARE
METERS, more or less, which is more particularly described as follows, to wit:

Lot No. 989

“A parcel of land (Lot No. 989 of the Cadastral Survey of Sibulan,

Cadastre Case No. 15, L.R.C. Cadastral Record No. 358), with the improvements
thereon, situated in the Barrio of Looc, Municipality of Sibulan, Province of
Negros Oriental, Bounded on the NE., by Lots Nos. 2550, 2549, 2543, 3596, 991,
993, and 994 on the SE, by Lot Nos. 1013, 990, the Okoy River and Lots No. 991
and 994; on the SW. by Lots Nos. 991, the Provincial Road and Lots No. 998, 987
and 985; and on the NW by Lots Nos. 984, 2551 and 959. Containing an area of
THIRTY ONE TWO HUNDRED EIGHTY TWO (31, 282) SQUARE METERS,
more or less.”

WHEREAS, VICENTE MENDEZ died intestate and left no debts or obligations due
against his estate and was survived by his four (4) children, namely, JACINTO MENDEZ SR.,
MAXIMO MENDEZ SR., JOAQUINA MENDEZ GRAMPON, AND FLORENCIA MENDEZ
ABORDO;

That FLORENCIA MENDEZ ABORDO, is the owner by verbal agreement between the
other co-owners of a portion of Lot No. 989-B-2 with an area of ONE THOUSAND THREE
HUNDRED TWENTY NINE (1, 329) SQUARE METERS;

WHEREAS, FLORENCIA MENDEZ ABORDO also died intestate and left no debts or
obligations due against her estate and was survived by her three (3) children, namely, HECTOR
ABORDO, RAUL ABORDO, and SYLVIA ABORDO, the seller-heir being one of them;

WHEREAS, pursuant to Section 1 Rule 74 of the Revised Rules of Court, subject to

limitations imposed under Section 1 of the same Rule 74, the above-named heir-vendor
HECTOR MENDEZ ABORDO, being of legal age, with full civil capacity to contract, do
hereby by these presents, SETTLE and ADJUDICATE unto himself his share over the above-
described parcel of land extrajudicially.

 WITNESSETH FURTHER:

That for and in consideration of the sum of TWO HUNDRED EIGHTY THOUSAND
PESOS (P280,000.00) Philippine Currency, receipt whereof is hereby acknowledged in full by
the HEIR-VENDOR from the VENDEE, the herein HEIR-VENDOR, do hereby by these
presents, SELL, CEDE, CONVEY and TRANSFER, in a manner absolute and irrevocable, a
portion from the above mentioned parcel of land known respectively as sublot of Lot No. 989-B-
2, known as Lot No. 989-B-2-A, with an area of TWO HUNDRED (200) SQUARE METERS
unto the VENDEE, her heirs, and assigns, free from all liens and encumbrances. A copy of the
sketch plan of Lot No. 989-B-2 is hereto attached as Annex “A”.

That the above-described parcel of land is not tenanted and no provisions of R.A. 6657
has been violated and that notice of preemption and/or redemption has been given but no such
pre-emptioner and/or redemptioner chose to exercise said rights with regards to this sale.

IN WITNESS WHEREOF, we have hereunto affixed our signatures this _______ day of
