EXTRAJUDICIAL SETTLEMENT OF ESTATE

OF THE DECEASED FELICIDAD MEDIRAN AND ANGEL QUEMEL


WITH DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Extra Judicial Settlement of Estate with Deed of Absolute Sale is executed by, between
and among the following parties:

LEGORIO C. COLIFLORES, of legal age, Filipino citizen, married, with residence and postal
address at Brgy. Lalaan I, Silang, Cavite;

CHRISTOPHER C. COLIFLORES, of legal age, Filipino citizen, married, with residence and
postal address at Brgy. Lalaan I, Silang, Cavite;

Witnesseth:

WHEREAS, the deceased AMADA C. COLIFLORES, the registered owner of one (1) parcel of
land with improvements erected thereon with an area of Fifteen Thousand (15,000) Square
Meters located at Balite II, Silang, Cavite, covered by Tax Declaration No. 18-0011-00681 of the
Municipal Assessor of Silang, Cavite and more particularly described as follows:

Tax Declaration No.: 18-0011-00681

“A parcel of land located at Balite II, Silang, Cavite. Survey No. AP-04-007005. Boundaries
North: 05 (Lot No. 2243-PART) & 04 (Lot No. 13474); on the South: 13 (Lot No. 2215); on the East:
06 (Lot No. 2243-PART); and on the West: 08 (Lot No. 631) 04 (Lot No. 13474). Containing an area
of Fifteen Thousand (15,000) Square Meters.”

WHEREAS, the deceased AMADA C. COLIFLORES, who died intestate on

____________________________________. Left No Will or Testament, Nor Any Outstanding
Debt(s) Or Financial Obligations In Favor of Any Person Or Entity;

WHEREAS, pursuant to Rule 74, Sec. 1 of the Revised Rules of Court of the Philippines, and
all being with full-capacity to contract, the undersigned heirs as legal heirs of AMADA C.
COLIFLORES and are the legitimate heir of the deceased, do hereby adjudicate extra-judicially
unto themselves the land described above;

WITNESSETH:

WHEREAS, the portion of Seven Thousand Five Hundred (7,500) Square Meters of
aforementioned property has further agreed to sell, in favor of the, Vendee,
____________________________________, of legal age, Filipino citizen, single/ married to
______________________, of legal age, Filipino citizen, with residence and postal address at
__________________________, In consideration of Seven Million Five Hundred Thousand Pesos
(₱ 7,500,000.00), Philippine Currency;

WHEREAS, there is no known debts or obligations chargeable to the estate of decedent at


the time of her death.

NOW THEREFORE the parties hereby agree to settle the estate among them amicably and
without need for court action as follows:

The parties shall sell or enter into development agreement the portion of Seven Thousand
Five Hundred (7,500) Square Meters of the aforementioned property whether in a manner
absolute of in such form of conveyance beneficial and convenient to the heirs and divide the
proceeds among themselves pursuant to the intestate provisions of the Civil Code and related
Laws

PROVIDED FURTHER, that the undersigned heirs/sellers, do hereby acknowledge the


satisfactory receipt of Seven Million Five Hundred Thousand Pesos (₱ 7,500,000.00), Philippine
Currency, from the VENDEE. And by virtue of such presents do HEREBY SELL, TRANSFER CONVEY
AND WAIVE THEIR RESPECTIVE RIGHTS, interest and participation over the portion of Seven
Thousand Five Hundred (7,500) Square Meters of the above-mentioned real property with
improvements specified-herein in favor of the Buyer, ____________________________________,
of legal age, Filipino citizen, single/ married to ______________________, of legal age, Filipino
citizen, with residence and postal address at __________________________, his heirs, assigns
and transferees, free from any liens and encumbrances and in following terms and conditions:

1.) That the total contract price is amounting to Seven Million Five Hundred Thousand
Pesos (₱ 7,500,000.00), Philippine Currency;

2.) That the VENDEE will give and amount of Three Million Five Hundred Thousand Pesos
(₱ 3,500,000.00), Philippine Currency represent as Down Payment and payable upon
signing of this contract;

3.) That the balance amounting to Four Million Pesos (₱ 4,000,000.00), Philippine
Currency payable upon the release of the new Tax Declaration under the name of the
VENDEE.

Further witnesseth:

SPECIAL POWER OF ATTORNEY

The parties do hereby NAME, CONSTITUTE and APPOINT------ TRINIDAD ROGELIO ORTIZ,
of legal age, Filipino citizen, married, and a resident of Brgy. Santol, Silang, Cavite, as our duly
constituted representative to do the following acts:

To negotiate the sale of the property or to subject the estate.

To receive the proceeds of the sale in cash or in check.

To sign in our place and stead all documents necessary and proper to give full effect to the
intent of this authority.

HEREBY GIVING AND GRANTING the foregoing authority and ratifying all and such acts
pertaining thereto as if we are present and signing.

NOW THEREFORE, for and in consideration of the above-given premises the undersigned
hereby settle the property herein specified and further signify that the same is not tenanted and
does not come within the operation of the Land Reform Code and allied Presidential Decree and
Circulars of the Department of Agrarian Reform.
