DECLARATION OF HEIRSHIP AND SALE

OF AN UNDIVIDED SHARE

KNOW ALL MEN BY THESE PRESENTS:

This Deed is made and executed by:

ANTONIO ENCLONAR JR., of legal age, Filipino, married, and a resident of Balugo,
Sibulan, Sibulan, Negros Oriental, hereinafter referred to as the HEIR-SELLER,

-in favor of-

JENNIFER S. ENCLONAR, of legal age, married, Filipino, and resident of Sibulan,

Negros Oriental, hereinafter referred to as the BUYER.

WITNESSETH:

WHEREAS, ANTONIO ENCLONAR, married to ESPERANZA ABOL, died intestate

in Sibulan, Negros Oriental, leaving at the time of his death a parcel of land known as Lot No.
3619 located at Maningcao, Sibulan, Negros Oriental containing an area of Five Hundred
Twenty Four (524) Square Meters, more or less, covered by Original Certificate of Title No. T-
11615, which is more particularly described as follows:

“A parcel of land (Lot No. 3619 of the Cadastral Survey of Sibulan,

Cadastral Case No. 15. L.R.C. Cadastral Record No. 358), with the improvements
thereon, situated in the Barrio of Maningcao, Municipality of Sibulan, Province of
Negros Oriental. Bounded on the NE, by the Tañon Strait; on the SE. by Lot No. 3618;
on the SW. by No. 3621; and on the NW. by Lots Nos. 3622 and 3620. Beginning at a
point marked 1 on plan, being N. 63 deg 12’E., 742.46 m. from B.B.M. No. 18; thence N.
70 deg. 40’E., ____ to point 2; thence N. 68 deg. 44’E., 3.00 m. to point 3; N. 32 deg.
29’E., ___ to point 4; S. 48 deg. 13’ E., 47.78 m. to point 5; S. 53 deg. 20’W., 5.80m. ___
deg .07’W., 5.90 m. to point 7; S. 44 deg. 15’W., 7.57 m. to point 8; m. 46 deg. ___.,
37.47 m. to point 9; M. 53 deg. 32’__., 5.20 m. to the point of beginning; containing an
area of FIVE HUNDRED AND TWENTY FOUR (524) SQAURE METERS, more or
less.

WHEREAS, ANTONIO ENCLONAR and ESPERANZA ABOL left no debts or

obligations due against their estate, and they were survived by their ten (10) children, namely,
LEODEGARIO ENCLONAR, ROSALINDA E. EULLARAN, CRISANTO ENCLONAR,
ELVIS ENCLONAR, ANTONIO ENCLONAR JR., HILARIO ENCLONAR, VISITACION E.
GIRAY, JESUSA E. CALINGACION, LOREMER ENCLONAR, JOSEFINO ENCLONAR;

WHEREAS, pursuant to Section 1 Rule 74 of the Revised Rules of Court, subject to

limitations imposed under Section 1 of the same Rule 74, the above-named ANTONIO
ENCLONAR JR., who is the HEIR-SELLER in this instrument, being of legal age, with full
civil capacity to contract, do hereby by these presents, SETTLE and ADJUDICATE unto himself
his share over the above-described parcel of land extra-judicially, with an area of 52.4 square
meters, more or less;

WITNESSETH FURTHER:
 That for and in consideration of the sum of THIRTY THOUSAND PESOS (P30,000.00)
Philippine Currency, receipt whereof is hereby acknowledged in full by the HEIR-SELLER from
the BUYER, the herein HEIR-SELLER, do hereby by these presents, SELL, CEDE, CONVEY
and TRANSFER, in a manner absolute and irrevocable, all his share and interest over the above-
described parcel of land, with an area of 52.4 square meters, unto the BUYER, their heirs, and
assigns, free from all liens and encumbrances.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 19th day of

November 2019 at Sibulan, Negros Oriental, Philippines.

deed.

This instrument relates to a DECLARATION OF HEIRSHIP AND SALE OF AN

UNDIVIDED SHARE, consisting of two (2) pages in which this acknowledgment is written and
has been signed by the heir-seller and his instrumental witnesses on each and every page hereof.
