EXTRA-JUDICIAL SETTLEMENT OF REAL ESTATE OF THE LATE

SPS. GREGORIA RIVERA-GARCIA AND MAMERTO GARCIA

KNOW ALL MEN BY THESE PRESENTS:

This Deed, made and executed by:

ROSITA GARCIA SANTIAGO, widow, of legal age, Filipino citizen and with
residence and postal address at Brgy. Malaking Pulo, Tanauan City, Batangas; and

EDILBERTO GARCIA, married to RONALYN GARCIA, of legal age, Filipino


citizen and with residence and postal address at Brgy. Malaking Pulo, Tanauan City,
Batangas;

WITNESSETH:

WHEREAS, the above-named are the legal heirs of the deceased, SPS.
GREGORIA RIVERA- GARCIA and MAMERTO GARCIA, who both died intestate at
Malaking Pulo, Tanauan City, Batangas on July 30, 2011 and December 28, 2008,
respectively, leaving no will nor debts settled to date but leaving a parcel of land
situated at Brgy. Malaking Pulo, Tanauan City, Batangas.

That said decedents died intestate, without Will or Testament, and without any
outstanding debts in favor of any person or entity;

That the decedents left a parcel of land situated in Brgy. Malaking Pulo, Tanauan
City, Batangas and more particularly described as follows:

TRANSFER CERTIFICATE OF TITLE NO. T-30488

“A parcel of land (Lot 6399-C-1, of the subdivision plan, Psd-04-


014600, being a portion of Lot 6399-C, Psd-50776, LRC Cad. Record
No. 524), situated in the Barrio of Malaking Pulo, Municipality of
Tanauan, Province of Batangas. Bounded on the SE., along line 1-2
by Lot 6378, Cad. 168, Tanauan Cadastre; along line 2-3 by Lot 6399-
B, Psd-50776; on the SW., along line 3-4 by Lot 6398; on the NW.,
along line 4-5 by Lot 6400, both Cad. 168, Tanauan Cadastre; on the
NE., along line 5-1 by Lot 6399-C-2, of the subdivision plan. Beginning
at a point marked “1” on plan x x x containing an area of EIGHT
THOUSAND EIGHT HUNDRED TWENTY SIX (8,826) SQUARE
METERS, more or less.”

That pursuant to Rule 74, Sec. 1 of the revised Rules of Court of the Philippines,
and all being with full capacity to contract, we do hereby adjudicate unto ourselves the
parcel the land above described.

That this property does not fall under the provisions of R.A. 3844 or the
Presidential Decree on Land Reform;

That the provisions of Articles 1621-1623 of the New Civil Code of the Philippines
have been complied with before this sale.

with residents and postal address at Malaking Pulo, Tanauan City, Batangas, as do hereby name, appoint,
and constitute ESTELITA L. LAMBINO married to Venancio Lambino, of legal age, Filipino citizen, and
with residents and postal address at Malaking Pulo, Tanauan City, Batangas as my true and lawful
ATTORNEY-IN-FACT, to act on our behalf and in our name, to execute and perform, all or any of the
following acts, deeds to wit:

1. To sell, negotiate, coordinate, transact to prospective buyer or buyers, alienate and dispose of a
parcel of land situated in Brgy. Malaking Pulo, Tanauan City, Batangas, with an area of EIGHT
THOUSAND EIGHT HUNDRED TWENTY SIX (8,826) square meters, more or less, which property
covered by Transfer Certificate of Title No. T-30488 with Lot 6399-C-1;
2. To sign, execute and deliver any documents, contracts and agreements, Deed of Conditional Sale,
Contract to Sell, Deed of Absolute Sale and Acknowledgement Receipt, and any other documents
in my name and in my behalf with regard to the sale, alienation and disposition of the above
described property.
3. To SELL, TRANSFER AND CONVEY the above mentioned property in my name and in my behalf;
4. To ask, demand, collect, receive, encash, deposit and withdraw all sums of money and/or checks
payable to and in the name of my said attorney-in-fact that maybe derived from the consideration
of the sale, alienation and disposition of the above described property in my name and in my
behalf.
5. To represent me before the Bureau of Internal Revenue (BIR), Department of Agrarian Reform
(DAR), Register of Deeds, Assessor’s Office and all other government agencies with respect to the
above-described property and sign document; needed for the said agencies;
6. To pay the Capital Gains Tax, Documentary Stamp Tax, Estate Tax with the Bureau of Internal
Revenue (BIR),filing fees, registration expenses , Transfer Tax, and other taxes with other
government agencies in my name and in my behalf with respect to the real property described
above.
7. To delegate the powers and authorities conferred herein to another person and appoint a substitute
for the attorney in fact herein;
8. To do and perform such acts as may be incidental or necessary to carry out the power herein
conferred.

HEREBY GIVING AND GRANTING, unto our said Attorney-in-Fact, full power and authority to do
and perform all and every act requisite or necessary to carry into effect the foregoing powers, as fully to all
intents and purposes as I might or could lawfully do if personally present, with full power of substitution and
revocation, and hereby ratifying and confirming all that my said Attorney-in-Fact or his substitute shall
lawfully do or cause to be done by virtue hereof.
