Dear Sir,

Under the instruction of my client K. Chandrappa S/o Siddaveerappa, aged


about 58 years, residing at No.823, 1st Floor, 11th Main, HAL 2nd Stage,
Indiranagar, Bangalore-08, do hereby issue this notice to you as follows.

1. My client represents to me that my client had close acquaintance with you,


you have approached my client and borrowed a sum of Rs.1,20,000/- for your
family necessities. In discharge of the above said liability, you had issued a
cheque bearing No.5923 dated.5-04-2010 drawn on Viswakarma Credit Co-
Operative Society Limited Bank, Cituvalli Branch, Davangere-1 for a sum of
Rs.1,20,000/- assuring my client that you have got sufficient funds to honour the
cheque.

2. My client represents to me that my client believing your assurances, my


client presented the cheque on.4-5-2010 through his banker, but was shocked to
find that the cheque was dishonored due to insufficient funds in your account, the
endorsement dated 7-5-2010. Immediately thereafter, my client contacted you and
enquired regarding the same. You informed my client that you had undergone
some sudden financial commitments and therefore was unable to clear the cheque
by keeping requisite balance in the account.
3. My client represents to me that under the foregoing facts and
circumstances you requested my client to present the cheque during 25th May
2010 and further assured that the same would be honored on presentation. My
client presented the cheque on 28th May 2010 and was once again shocked to
find that the cheque was returned due to insufficient finds in your account. The
endorsement dated 19-6-2010. By this, it is clear knowing fully well you have not
got sufficient funds to honour the cheque with dishonest intention you have
issued the cheque in order to have a wrongful gain to you to cause a wrongful loss
to my client, thereby you have committed an offence liable to be punished under
Section 138 of the Negotiable Instruments Act as well as under Section 420 of
Indian Penal Code. Hence, my client has instructed me to issue this notice to you
in compliance with Section 138 of the Negotiable Instruments Act.

My client hereby calls upon you to pay the amount covered under the
aforementioned cheque to him within 15 days from the date of receipt of this
notice. In event of your failure to comply with the same, you will be committing
an offence punishable under the provision of the Negotiable Instruments Act.
Consequently, my client will be constrained to initiate suitable action under the
law holding you responsible for all the cost and consequences thereof.

Please pay Rs.1,000/- being the cost of this Notice.
