PETITION TO REVIVE ABANDONED APPLICATION WITH COST

Dear Director:

We respectfully acknowledge the fact that the Response to the outstanding Office Action was
not timely filed. The responsibility to said trademark was not duly endorsed from the previous
responsible person to the undersigned. For this reason, we would like to humbly request for the
revival of the present application.
In compliance with the requirements set forth under the Rules, we hereby submit the
following:
1. The Revival Fee with LRF; and
2. The Applicant’s Response to Official Action.

Re. Response to Registrability Report/ Doc. No. 2021/45439

Dear Director:

This is a Response to the outstanding Official Action with Document No. 2021/45439.

We take note of the refusal based on the findings that the mark consists of designation of the
kind, quality and purpose of the goods covered.

We humbly submit before the esteemed Examiners that the mark is label mark which distinct
appearance and presentation are unique and distinctive. The label mark in its entirety presents an
original and unique combination of verbal and non-verbal elements and is not common in the
industry, unless a third party’s use of the same label mark has an intention to imitate.

With this response, we respectfully request the esteemed Examiners the grant of allowance
of the present application.
