1. OWNERS -
The person or firm ordering the project execution, including duly
appointed successors, or authorized representatives.
2. ARCHITECT - The person so named in the contract documents or his
representative duly authorized in writing to act for the architect.
3. ENGINEER - The person so named in the contract documents of his
representative duly authorized in writing to act for the engineer.
4. PROJECT REPRESENTATIVE - The full-time construction inspector hired by
the owner duly authorized in writing to assist the architect and
engineer in the supervision of the work.
5. SUB-CONTRACTOR - Anyone having a direct contract with the contract with the
contractor in executing any part of the contract not including one
who merely furnished materials w/o labor.
6. CONTRACTOR - The person or firm whose proposal has been accepted and to
whom the contract was awarded.

DIFF. DOCUMENTS:

1. SURETY - is the person or firm or corporation who provides the guarantee for
the contractor’s bond
2. PROPOSAL BOND - The cashier’s check or bidder’s bond accompanying the
proposal submitted by the bidder, as a guarantee that the bidder
will enter into a contract with the owner for the construction of the
building and the contract is awarded to him.
3. PROPOSAL - The offer of the contractor to perform the work described by the
contract documents when made out and submitted on the
prescribed by contract or proposal form, properly signed and
guaranteed.
4. PAYMENT BOND - Is the approved form of security furnished by the contractor,
and his surety is a good guarantee of good faith on the part of the
contractor to pay all obligations arising from the contract.
5. PERFORMANCE - The approved form of security furnished by the contractor and
his surety as a guaranty of good faith on the part of the contractor
to execute the work in accordance with the terms of the contract.
6. GUARANTEE BOND - The approved form of security furnished by the contract,
and his surety as guaranty to the quality of the materials equipment
installed and the workmanship performed and date of bidding.
7. ADVERTISEMENT OR INVITATION TO BID - The notice published by the
owner or the invitations issued to prospective bidders and giving
information as the nature of the proposed project conditions for the
issuance of contract document and date of building.
8. BID BULLETIN - Is an additional information in contract document issued to
bidders before date of bidding.
9. INSTRUCTION TO BIDDERS - The list of instructions stipulating the manner of
how bids are to be prepared and conditions for the award of the
contract.

project. They include all supplementary details and shop drawing.

BUILDING PERMIT APPLICATION

I. DEFINITION:

1.1 BUILDING PERMIT - a written authorization granted by the


building official to an applicant allowing him to proceed with the
construction of a specific project.
1.2 CONSTRUCTION
1.3 ERECTION
1.4 ADDITION - any new construction of increased the height or area.
1.5 ALTERATION - construction in a building involving changes in
the material used partitioning location/size of opening, structural parts
existing utilities and equipment, but does not increase its value are thereof.
1.6 RENOVATION - Any physical changes made in the bldg. to
increase its value, utility and or improve its aesthetic quality.
1.7 CONVERSION - A change in the use or occupancy of the bldg. or
any portion/thereof w/c has diff. requirement.
1.8 REPAIR - Remedial work done on any damaged or deteriorated
portions of a bldg. structure to restore its original conditions.
1.9 MOVING - The transfer of any bldg./structure or portions thereof
from its original location or position to another either w/ in the same lot or
to a diff. one.
1.10 DEMOLITION - The systematic dismantling or destruction of a
building/ structure in whole or in part.
1.11 ANCILLARY BLDG/STRUCTURE - A secondary
bldg./structure located w/ the same premises the use of which is
incidentally to that of the main bldg./structure.
BUILDING PERMIT:

No person, firm or corporation including any agency or instrumentality of the


gov’t shall erect, construct, alter, repair, move, convert, or demolished any bldg. or
structure or cause the same to be done w/c first design in the place where the subject
bldg. is located of the bldg work is to be done.

REQUIREMENT BEFORE THE ISSUANCE OF BUILDING PERMIT:

Before it is issued, it is necessary that the owner of the proposed bldg. shall meet
the ff. requirement:

1. He must have the bldg plans and specifications of the proposal bldg. duly
designed by a registered Arch’t
2. He must establish legal ownership of the site as in the case of lease a written
contract of lease.
3. The site is of the proper level not duly or unsanitary.\
4. The site is accessible from any public thorough-fare
5. Site is not under any encumbrances or under court litigation.

THE BUILDING PLANS REQUIRE THE ISSUANCE OF THE PERMIT MUST


INCLUDE THE FOLLOWING:

1. Site plan 9. Electrical plan

3. At least 2 elevations 11. Detail of structural beams & cols.
4. At least 2 sections 12. Detail of trusses

Before the permit is issued for concrete work, the site will be properly excavated
to determine the nature of the soil if the soil is soft, it is necessary for the owner to test it
in order to find the bearing capacity. The testing of the soil shall be made such that 2
months after test have been made if the soil found to be unsafe, the height of the bldg.
may be reduced in accordance w/ the ordinance of Manila in no case any bldg. shall
exceed more than 30 meters.
However such bldg. may be allowed if the foundation is resting on wooden or
driven piles. If permit is granted to the owner of the proposed bldg. it shall be his duty
that the construction shall be constructed w/in a period of 180 days if the owner fails to
make effort to deal w/ the construction the bldg. permit is disqualified.
TEMPORARY PERMIT - To construct any structure temporary permit maybe issued
under the ff. condition:

1. When the bldg place is a private street or alley w/c is not yet constructed and
approved by the proper authorization provided that the owner of the proposed
bldg makes a deposit w/ the city treasurer, the amount less to the estimated cost
for the construction of the street or alley concerned.
2. When the site of the proposed bldg is affected by the proposed street line w/c is
intended to widen the street provided that the owner makes a written promote to
demolish or removed the bldg to case a new street line is laid out in order to
improve such premises.

PERMIT NOT REQUIRED WHEN:

1. For minor interior repair of any structure & that structure part of the bldg are not
affected by the repair or light & ventilation or you do not decrease or increase the
height of the floor & sanitary condition of the building are maintained.
2. If the cost of the house is not more than 5,000 – 15,000 pesos below.
3. If the nature of the work is charitable or emergency character.

PERMIT NOT REQUIRED WHEN:

When written application made to the city engineer to move or raise any bldg he
shall cause such bldg to be inspected & if he shall find that the bldg may be moved in
safety in the manner proposed & that the moving there of will violate the city ordinance
of the proper fee.
Permit of any reinforced concrete bldg or any part thereof before commencing the
erection construction, enlargement, alteration repair or any reinforced concrete bldg or
any thereof, in the city of Manila, a permit therefore shall first be obtained by the owner
& it have been unlawful to commence any such work until such permit shall first have
been obtained. Nothing in this article shall be constructed to prevent the city engineer
from issuing a permit for the bldg of the foundation for the bldg where plans & detailed
statements have been presented for the same, before the entire plans of a bldg have been
submitted, when a foundation permit is applied for the owner shall furnish sufficient
information to enable the city engineer to determine the requirement of strength of the
foundation.

GEN. CONDITION OF THE BLDG CONTRACT: (UAP document 301)

1. PROPOSAL
2. EXAMINE OF THE PREMISES - The contractor shall carefully examine the
site or location & other existing structures’ utilities w/in the
premises before submitting his proposed.
3. EXAMINATION OF DRAWING - The contractor shall verify & Check all
dimension on the plans, the drawing & specifications are intended
to cooperate, anything shown in the drawing but not mentioned in
the specification or vice versa or any thing not expressly mention
shall be furnished w/o any extra charge.
4. WORKMANSHIP & MATERIALS - To be accomplished w/ good
performance or workmanship & to the complete approval &
acceptance of the acrch’t and the owner the contractor shall
furnished, all accessories needed such as scaffold form, protection
& all other temporary works, unless otherwise specified.
5. CHANGE ORDER - It is any alteration, addition omission of works during the
progress of the construction.
6. SUB-CONTRACTOR FOREMAN AND WORK MEN - Employed
responsible foreman, tagalong speaking who shall be available to
the owner & to the arch’t at anytime in the progress of the
construction.
7. PERMIT - The contractor shall unless otherwise stimulated secure and pay for
all permit surveys, test fees, light & water & sewer connections
required by the city ordinance regulation & other authorities
relative to his work.
8. DETAIL & WORKING DRAWING - Additional detail & working drawing to
be furnished by the arch’t in application of the contract drawing if
request by the owner/contractor such drawing & detail shall be
considered of equal w/ the accompanying specification.
9. COST SPECIFICATION - The contract shall w/in 5 days after the start of the
construction submit to by the Arch’t a schedule showing of the ff:
a. Starting qualities & prices
b. Cost of each items to be made as a basic of checking &
computing estimate.
10. RESPONSIBILITIES REGARDING EXISTING STRUCTURES - The
existing & location of underground utilities, existing structures
shall be made responsible for the protection of the contractor.

11. RESPONSIBILITIES FOR ACCIDENTS - The
contractor shall bear all losses & damages from accidents w/c may
occur to any person by or on account of the prosecution of work,
possession is taken over by the owner.

THE CONTRACTOR SHALL PROVIDE THE FF:


a. All the necessary guards
b. Railing
c. Light
d. Warning signs & all safety precaution for all workers.

12. TIME COMPLETION - Completion of work w/in the


max. period time of completion agreed upon in case of delayed
beyond the max. limit of time the contractor will be require to pay
the owner a certain sum in Phil. currency of each delay (Sunday &
legal holiday are included) beyond completion of the contract. The
said payment to be paid will be considered as liquidated damages
& not by way of penalty the owner may deduct from any sum due
or become due to the contractor any sums accruing for liquidated
damages.
13. EXTENSION OF THE TIME W/IN THE CONDITIONS
STIPULATING W/IN - A contract shall be applied by the
contractor to the architect & the owner. Such applications shall be
made one week after the unforeseen eyes.
14. PROTECTION OF WORK - Materials delivered to the
work jobsite design for the incorporated into the work shall be at
all times, suitably protected from injury.
15. DEFECTIVE OR IMPROPER WORK - All design, all
materials not acceptable must be removed and planned w/o extra
compensation.
16. INSPECTION
17. CLOSING OF WORK - No piping, wiring ducts hidden
& work, etc. shall be covered up until properly inspected &
checked by the authorized person on agencies. It must be given an
approval & issue certificate of work
18. WORK OUTSIDE OFFICE HOUR - If the contractor
desires to do work outside regular hours, he may submit
application to the architect & owner.
19. STAKING - Re-establishment of line & grades were
necessitated by the negligence of the contractor can be called for
by the arch’t & owner.
20. PRIVY – The general contractor shall provide a
temporary privy w/ proper enclosure. This shall be removed upon
completion of work & the premises shall left clean & in perfect
condition.
21. TEMPORARY SUPPLY & WATER CONNECTIONS -
The contractor shall make his own agreement for temporary water
supply & electrical service for the bldg purposes.
22. QUESTION & DISAGREEMENT BETWEEN THE
OWNER 7 THE CONTRACTOR - Relating to the interrelation
of the drawing & or specifications & kind of work shall be referred
to the arch’t.
23. FINAL PAYMENT - Whenever this contract in the
opinion of the arch’t have been completely performed on the part
of the contractor, same shall be measured & final acceptance &
certificated of completion shall be made.
24. OTHER REQUIREMENT FOR FINAL CERTIFICATION
OF PAYMENT
1. “as built” plumbing & electrical drawings
2. Bldg. permit
3. Plumbing permit & final inspection certificate
4. Electrical permit & final inspection certificated
5. Certificate of occupancy
6. Contractors affidavit
7. Industrial safety permit (if industrial bldg)
25. TURN OVER OF WORK - Procedure to be followed in
turn-over of work are as follows:
1. The contractor shall modify the arch’t 1
week in advance of the date, the contractor proposes to turn over
the work he must submit in advance all document required before
the certificate of final acceptance can be made.
2. The arch’t shall inspect then the work, if the work
passes, the arch’t shall prepare the certification of acceptance
subject to the condition. The dates issued of certificate and shall
be the basis of establishing penalties.
3. If after, the arch’t inspection the work is generally
complete & acceptable, except for minor retouching & 2 weeks
grace period will be granted to finish & correct the damages &
defects.
4. If after the inspection, is not considered complete,
the contractor shall performed all work for satisfaction of the arch’t
& again notify the arch’t in advance of the date, he proposed to re-
submit the work during the time the contractual provision on
liquidated damaged shall then remains in effect.
26. RECISSION OF THE CONTRACT COMPLETION OF
WORK BY OWNER OR BY RELETTING - If the contractor
failed to comply w/ the agreement complete his work or failed to
comply w/ the owners representative & refused to removed
materials not needed in work, the owner shall have the right to
suspend the payment of the contractor & to take over the work.

ETHICAL RELATION OF THE ARCHITECTS:

“CODE OF ETHICS”

1. An arch’t must not be a careless estimator mislead by the client as to probable


cost of the bldg.
2. An arch’t must condemned workmanship and materials done by the contractor
w/c are not in conformity w/ the contract documents.
3. An arch’t must not accept the offer of free engineering services from
manufacturers or dealers of the bldg materials & equipment during the
preparation of the contract documents.
4. The arch’t must charge his professional fee to the client only. He must not
receive commission, gift, favor substantial services from a contractor or any
interested person other than the client.
5. An arch’t must not knowingly compete w/ a fellow arch’t on the basis of
professional fees.
6. An arch’t must not engaged in false publicity, take part nor give assistance in
obtaining advertisement or other supports towards meeting the expenses of any
publication illustrating his works.
7. An arch’t may introduced to the possible client the services he may be able to
perform but must not perform any services unless he was been awarded the
commission.
8. An arch’t must not falsely & maliciously injure directly or indirectly the
professional reputation, prospect or business of a fellow arch’t.
9. An arch’t must not attempt to supplant another arch’t after definite steps have
been approved by the client toward the latter’s employment nor will be undertake
the commission unless the original arch’t has been paid his professional fee & the
contract terminated to the client.
10. An arch’t must not take part in any competition unless the rules are in accordance
w/ the code.

LABOR: CIVIL CODE ART. 1723

The engineer or the arch’t who drew up the plans and specification for bldg is
liable for damage w/in 15 years from the time of the construction was completed. If the
bldg collapsed by resign of a defect on the ground and contract is liable for damages on
the account the quality material furnished by him.
If the engineer or arch’t supervise the construction he also liable to the contractor
other condition of the regular service.
1. Project representative, project superior and construction inspector. Their skill
be under the technical control and supervision of arch’t and shall make
periodic reports to the owner and to the arch’t about the progress and quality
of work done.
2. Design and placement of signs. All signboard of contractors, sub-contractor
job and dealers that shall be place at the project and during the progress of the
construction shall be approved by the arch’t as to:
a. Size
b. Design
c. Contest

DOCUMENT P.D. NO. 49:

All design, drawings, specification & codes there of compared and furnished by
the Arch’t in the construction w/ the project are instruments of professional services they
are the property of the arch’t whether the work for w/c they are maybe executed or not, &
are not to be reproduced and used by work except w/ a written agreement w/ the Arch’t.

1. EXECUTIVE ARCH’T - When he assumes the duties &


responsibilities to his regular services.
2. SUPERVISING ARCH’T - When he acts as coordinator of the work of
several arch’t are employed in executive capacities by the same client for
the project at the same time or a coordinate is required. The supervising
arch’t presides over the entire work in accordance to the purposed design
& action.
3. CONSULTING ARCH’T - When he is preceded the work of an
executive & or supervising Arch’t in an advisory capacity, this office acts
when the project requires the services of expert who are considered to
have specialized knowledge and experience of the special problem.

CIVIL CODE ART. 1723


P.D. 1723 - THE NEW CIVIL CODE

ARCHITECT’S LEGAL RESPONSIBILITY - ARTICLE 1723

The engineer or architect who come up the plans & specification of a bldg is
liable for the damages if w/in 15 years from the completion of the structure the same
should collapse by reason of a defect in those plans and specifications, or due to the
defects in those in the ground. The contractor is likewise responsible for the edifice fails,
w/in the same period, an account of defect in the construction or they are of materials of
inferior quality furnished by bid, or due to any violation of the terms of the contract. If
the engineer or architect supervises the construction, he shall solidary liable w/ the
contractor.
Acceptance of the bldg, after the completion does not imply waiver of any action
by reason of any defect mentioned.
The action must be brought w/in 10 years following the collapse of the bldg.

ARTICLE 1727:

“The contractor is responsible for the work done by persons employed by him”

ARTICLE 1719
Acceptance of the work by the employer relieves the contractor of liability for
defect in the work, unless:

1. The defect is hidden & the employer is not by his special knowledge, expected
to recognize the same
2. The employer expressly reserves his right, against the contractor by reason of
the defect.

THE VIRTUES OF AN ARCHITECT

May the Architect by high-minded; not arrogant, but faithful; just, and easy to
deal with; with at avarice; not let his mind be occupied in receiving gifts, but let him
preserve his good name w/ dignity.

THE ARCHITECT’S CODE OF ETHICS


1. I shall work with this that my duty is not only to myself, but to country &
God.
2. I shall uphold the ideals & full duty of conduct of a noble profession to further
its just ends.
3. He shall advise the client preceding the projects if in case it will not be
continued due to short financial even. I will mean a loss of project in the part
of the arch’t.
4. The arch’t will explain the total cost estimate submitted by the contractor &
see to it that he will not mislead the client just to secure commission.
5. He also takes into consideration the effect of his design for the aesthetic &
functional req’t of the client.
6. He shall charge his client based upon the basic min. fee, under the standards
of professional practice of the architecture nat’l code.
7. He shall not undertake under a fixed contract sum agreement thou in certain
cases, he may undertake constructions of the project provided he’ll abide w/
the conditions set forth under sections covering construction services,
comprehensive services of the documents on standards of professional
practice.
8. He shall charge his professional fee only to the client & no other source.
9. He shall be free from his outside sidelines, & shall be concentrated only w/ his
client’s project or else shall inform the clients.
10. The arch’t shall include in his agreement w/ the client a clause providing for
arbitration as a method for settlement of dispute.

ARCHITECTSD RESPONSIBILITIES IN RELATION TO THE CONTRACTORS:


1. He shall explain & furnish the contractor every detail what is in the contract
documents to avoid mistakes of extra costs.
2. He shall not knowingly call upon the contractor to correct oversights or error
in the contract documents to the contractor’s financial disadvantage.
3. He shall immediately upon personal inspection, reject equipments or
workmanship w/c are not inconformity w/ contract document in order not to
delay & will add expense to the contractor.
4. He shall not accept in anytime free services, gift from the contractor or
subcontractor w/c will tend to place him in any kind of moral obligations.
5. He shall upon request by the contractor inspect each phase of work if
completed already that he may issue certificate of payment & financial
certificate of completion to the contractor.

ARCHITECTS RESPONSIBILITIES IN RELATION TO DEALERS AND AGENTS:


1. The architect shall not avail or make use of engineering or other technical
advice offered by manufacturers, or suppliers, of the bldg materials or
equipment w/c maybe accompanied by an obligation detrimental to the best
interest of the client or w/c may adversely affect the arch’t professional
opinion.
2. The architect shall not at any time receive commissions, discounts, fees, gifts
or favor from agents or firms handling bldg materials or equipment w/c may
place him in a replaced frame of mind. He may however, accept needed
discount w/c shall be credited to the client.

The one method of project delivery is the Design-build service w/c could be
performed by the architect. There are two ways to undertake Design-Build Service.

or civil engineer to undertake the full-time inspection and
supervision
3. Failure of the licensed architect or civil engineer to
submit the logbook, certificate of completion, as-built plans
specifications, building inspections sheet and fire safety inspection
certificate duly signed and sealed to the Building official upon
completion of the construction.
