BIONAT, JUSTIN FRANCIS

JD-1E
CONSTITUTIONAL LAW II
SURPRISE QUIZ

1. Ferdinandinho is a Satanist who is living in Jaro, Iloilo City. Because of concerns that his belief might
spread to other people, the City Government decided to eject him and forced him out of Iloilo City. Was
the act of the City Government valid?

No, the act of forcing the person out of his place of residence is not a valid police power measure in this
instance. The right to practice one’s religion is a Constitutional guarantee. This includes not having a
religion and other non-conventional forms of faith. Having no intent or bad faith to spread the Satanist
religion or a clear act that is against the general welfare, Ferdinandinho cannot be ejected.

2. Would you answer in number 1 change if Ferdinandinho was a previous City Councilor who was
removed from office but is spreading rumors that other government officals are inutile? Why or why not?

Still No, the Liberty of Abode and Travel is a constitutional guarantee and cannot be violated on these
grounds. Spreading rumors against other government officials may subject him to a criminal and
administrative case but not from ejectment from his residence.

3. Is Satanism prohibited in the Philippines? Why or why not?

No it is not. Freedom of Religion guarantees the right to believe (and not to believe) in certain faith and
belief systems.
