CASE PROBLEM NO. 1 – SET 1


I. ANSWER EACH QUESTION BRIEFLY AND DIRECTLY. WRITE YOUR ANSWERS ONLY.

A. Mr. Lee, a Chinese Citizen living for 10 years in the Philippines, gave food and supplies to enemy
Japanese soldiers, and healing them, offering help during the war. He openly admits that he does not
like the Philippines and he dislikes the Filipinos, and would rather help the Japanese. Due to his
actions, he was arrested by the Philippine government because of treason under Art. 114 of the
Revised Penal Code. Is the arrest correct or not? Why? (5pts)

B. Two soldiers, Hanna and Jemima, are cooperating and planning, with other of members of their
squad, to leave the Philippine army in order to join a terrorist group known as ISIS, since they no
longer feel the patriotism to defend the Philippines, and they wanted to support the enemy instead.
One of their soldiers - comrade, Caloy, knew about this, but did not tell his superiors of the betrayal of
the two soldiers.

(1) What crime was committed by Hanna and Jemima? Explain. (5pts)
(2) Did Caloy commit any crime in this situation? Why or why not? (5pts)

C. A cruise ship was taken over by three strange men. They killed the captain of the ship; and
tortured the passengers on board, leaving them half – dead, and took all their jewelries and wallets.
What was the crime committed by the crew? Explain. (5pts)

D. Veronica is working as an undersecretary for the Department of National Defense. For four (4)
months, she has been in contact with an ambassador of another country, and she has been
presenting documents that contain data about the weapons that the Philippines bought to the
ambassador. What was the crime committed by Veronica? Explain (5pts.)
