Reflection Note of Photo Essays

1. What, according to your research, does this right mean for the
respective country’s citizens specifically? What is allowed/not
allowed? When was it instituted?
The Indian Constitution upholds the principles of one individual, one vote,
one value, and equity in all respects, so equality can only be justified where
there is no exploitation. The poor have always been seen as being used by the
strong. Minorities in India, such as Dalits and Adivasis, are seldom seen by
the wealthy. As a result, in 1954, the Right To Exploitation was introduced to
shield people from exploitation. Essentially, the act ensures that no being of
any kind can be used. This right does not, under any circumstances, cause any
being to manipulate another. It bans human trafficking as well as begat and
other forms of slave labor.

2. What legal provisions are in place to protect this right?


Articles 23 and 24 of the Indian constitution, as well as Articles 23-28 and the
Bonded Labour Scheme Act of 1976, provide legal authority for this act. The
Child Labor Act of 1986 made it illegal for children under the age of 14 to
work as factory laborers. On the other hand, the child labor act is often
abused.Child labor and the exploitation of girls and women for any illegal or
unethical activity are also illegal.

3. What were your observations whilst seeing this right in practice


through the photographs available from online sources? Why

would you argue that it is being maintained/not being maintained/
being distorted in practice?
Last year, India was dubbed "the world's most dangerous country for women,"
a moniker that highlights the issue of women being trafficked for commercial
sexual exploitation and forced marriage in areas with a skewed sex ratio.
Because of a lack of resources, education, and prevalent practices, the
epidemic of sex trafficking went unnoticed. The rural children and women
were and continue to be the most impacted by these issues; they are unable to
lift their voices because of a lack of support, education, and prevalent
practices. The persistence of superstition, patriarchal culture, and the
predominance of some misconceptions are all factors in the religiously
sanctioned degradation of women.

4. What research backs up your claim? Show the sources from


which you acquired your evidence. Are these reliable sources?
According to Census 2011 statistics, approximately 10.1 million children are
employed as child laborers, and the number is steadily rising. Child labor is
also related to child slavery, which often leads to exploitation of children.
India is ranked fourth in the global slavery ranking, indicating that the form of
labor practiced there is slavery. Many of the slaves on it are women and girls,
who are among the most disadvantaged groups affected by the economic
downturn and hunger.
According to the IANS, about 1,500 children under the age of 15 went
missing in 2016-17, with just a handful of them returning home.
The lower castes of society, especially Dalits, are exploited; they are denied
access to education, freedom, and other basic rights. They are the ones who
clean the NALLAS (human scavengers) and receive death as a result of the
poisonous gases in the unattractive areas. The key point is that the act has
been passed, but the government and people have failed to properly enact it.

5. How does the fundamental right you have chosen compare to the
same or similar human rights listed in the UDHR? What do UN
reports suggest about the practice of your chosen fundamental
right in your country?
My chosen right is the right against slavery, which India grants to all of its
citizens living within its borders. Even if the UDHR recognizes the right
against exploitation, all of the rights are meaningless if people are abused and
mistreated.According to UN reports, the government officials abused
Kashmiris in 2018. Even the government struggled to slow down the mob's
attacks on blacks, marginalized groups, and government opponents.

6. Explain why you think there is no gap/a gap between the


country’s claims to protecting this right and the UN’s findings.
Between India's claim to shield its people from corruption and the UN's
findings, there is a disconnect. The persecution of Dalits, marginalized people,
women, and children has continued well since the provisions were enacted. I
am not denying the right, but I am curious as to how widely the right has been
implemented and how well people are aware of its presence. The fair
application of the law would always result in positive results.

7. What did you learn about the fundamental right from this activity?
The universal right to freedom from slavery taught me that even though all
other rights are upheld, exploitation of human beings hurts their mental and
physical health, as well as their overall well-being, and puts the nation's
prosperity at risk.
We have been dealing with the issue of child labor for a long time, (in basic
terms, we call it Chotu ek chai la na) “CHOTU” works in an industry or

somewhere else to supplement his family's income, such a small matter has a
huge effect on people's lives, women/girls are trafficked as children for the
sake of desire and forced marriages, As a result, their lives are destroyed.
According to statistics, sex trafficking still occurs (on a wide scale) in India,
with at least three women or children being victims of trafficking or violence
in the modern-day.

8. What are some ways that citizens globally can help citizens of
your country protect this right?
To begin, people should be educated about the issues of abuse and their
implications. Strict laws and standards, as well as penalties for company
owners who neglect children. Boycott goods that are made with child labor.
Creating a joint venture between the government and non-governmental
organizations to offer employment, schooling, and protection to the most
needy people.
