By unanimous vote of the Sangguniang Panlungsod members present, the following City Ordinance
was enacted:

CITY ORDINANCE NO. 2004-A-010

AN ORDINANCE ENACTING THE MAKATI CITY ANIMAL


REGULATION & CONTROL CODE PRESCRIBING REGULATORY FEES
AND PENALTY FOR VIOLATION THEREOF AND OTHER PURPOSES.

WHEREAS, prevention of a rabies epidemic and instilling of discipline among animal owners,
particularly those with dogs and cats, call for the enactment of this Makati City Animal Regulation &
Control Code;

WHEREAS, this code seeks to address incidents of animal bites and stray animals in public places in
the interest of public safety and health. Also, as a means of discouraging breeding while encouraging
neutering; to ensure that every pet is traceable to its owner; and to promote responsible pet ownership.

NOW, THEREFORE, BE IT ENACTED, AS IT IS HEREBY ENACTED BY THE


SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF THE
POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, THAT:

ARTICLE I

GENERAL PROVISIONS

Section 1. This Ordinance shall be known as the “Makati City Animal Regulation & Control Code”.

ARTICLE II

DEFINITION OF TERMS

Section 2. DEFINITION OF TERMS – As used in this Ordinance, the following terms shall mean
and defined as follows:

Animal – refer to any animal of whatever specie, genus, family, size and purpose which
include, but not limited, to dogs, cats, birds, etc.

Animal Owner – means every person in possession of or harboring any animal or who
allows any such animal to remain about his premises for a period of ten (10) days.

Animal License - refers to the authority issued by the City Government allowing a
person to possess or keep an animal for whatever purpose, except those already covered
by separate permits.

Animal Registry - refers to a log where the identity of the animal and its owner are
registered.

Castrated Dog – means any dog of masculine gender, on which surgical removal of the
testicles has been performed by a licensed veterinarian and accompanied by a certificate
asserting that operation has been performed.

Dog – means any animal of canine species regardless of sex.

Exotic/Endangered Animal Specie - refers to animals under the endangered list of the
Department of Environment and Natural Resources (DENR).

Female dog – means any dog of the female gender on which no surgery has been
performed to alter the genital organs.

Male dog – means any dog of masculine gender, either castrated or not castrated.

Rabies – means a communicable disease of both wild and domestic animals transmittable
to humans.

Spayed female dog – means any female dog on which an ovariectomy or hysterectomy
has been performed by a licensed veterinarian and accompanied by certificate asserting
that operation has been performed.

Stray Animal – means any unlicensed or licensed animal found unattached or loose
anywhere in the city limits.

Vicious animal – means any animal with known tendency to attack unprovoked or to
cause injury, or otherwise threaten the safety of human beings or other animals, or has
bitten any person.

Vaccination – means inoculation of dog/cat with standard rabies vaccine.

ARTICLE III

ANIMAL LICENSE/REGISTRATION

Section 3. Licensing and Registration

It is hereby required that all dogs, cats and other animals which could be carriers of rabies virus must
be licensed and registered in the City and Barangay Animal Registries. Owners of animals shall be
issued a license and/or animal tag for each animal registered. It shall serve as special permit granting
privilege to the owner to possess and keep the animal identified therein. Unlicensed animals shall be
confiscated and disposed of in accordance with Article V, Section 11 hereof.

Only a maximum of two (2) adult dogs and three (3) adult cats only, per entire household, shall be
allowed for any purpose, unless a conditional use permit has been granted by the Animal City
Registrar. In addition, puppies/kittens from any of these dogs/cats may be kept until the age of four
(4) months, at which time they will be counted as adult dogs/cats. Excess number of animals shall
also be confiscated and disposed of in accordance with Article V, Section 11 hereof.

Registration and licensing of other animals, except dogs and cats, shall be optional or only upon order
of the City Mayor through a Memorandum Circular.

Section 4. Vaccination

Animals which could be carriers of rabies virus, such as dogs, cats, etc., are required to be vaccinated
to qualify for registration. Certificate of Vaccination issued and/or validated by the City Veterinarian
shall be a requirement for animal registration.

Every veterinarian performing vaccination shall furnish the owner of any dog/cat vaccinated a
certificate of vaccination, which shall be presented to the Barangay Animal Registrar who, upon
payment of city license fee, shall issue the license. No license shall be issued for any dog/cat without
the production of a certificate of vaccination and payment of license fee.

It shall be the duty of every person who owns or harbors any dog/cat in the city to have such dog/cat
inoculated by a licensed veterinarian. Vaccination shall be valid for a period of one (1) year from the
date of inoculation.

Section 5. License/Animal Tag

The City Animal Registrar, through the Barangay Animal Registrar, shall issue a license or tag to the
owner or harborer of the animal containing the following information:

a. Name and address of the owner/harborer


b. Date of inoculation and date of license
c. Year and series of animal tag
d. Breed, age color and sex of the animal

The animal tag shall be made of durable material suitable to be attached to the collar or harness of the
animal. The tag shall state the year for which it is issued and the series number of the license and tag.
The tags shall be of different color for each year.

Other dog identification system may also be established by the City Animal Registrar such as:

a. Dog identification card/vaccination card


b. Ear tattooing

Dogs which are duly registered shall be given 20% discount on laboratory fees for services provided
by the City Animal Control Facility.

Section 6. Wild/Endangered Animals

Keeping of wild/endagered animal specie in residential areas is prohibited, with the following
exceptions:

Birds, except as otherwise provided by law;


Hamster
Guinea pigs
White rats/mice
Nonpoisonous snakes not exceeding 6 feet in length
Turtles
Nonpoisonous toads
Lizards
Salamander
Chameleons
Fish, except piranha

Section 7. Regulatory fees

The following regulatory fees for license shall be collected from dog and cat owners:

Animal licenses shall be renewed annually for a fee of P100.00.

License fees collected hereunder shall accrue to the City General Fund while fees for costs of vaccine
and tag in the amount of P40.00 and P30.00, respectively, shall be shared by the barangay concerned
and the city government at the ratio of 40-60 in favor of the barangay.

ARTICLE IV

OWNERS’ DUTIES AND RESPONSIBILITIES

Section 8. Animal owners shall have the following duties and responsibilities:

(a.) Take care and provide for the needs of their animals and to prevent any form of
cruelty to their animals in accordance with Republic Act 8485, otherwise known
as Animal Welfare Act of 1998.

(b.) Should keep their animals within their premises;

(c.) To keep his animal, particularly dog, under control or physical restraint as to
prevent such animal from becoming a danger to persons or property or from
trespassing upon the property of the other.

(d.) Prevent his/her animal, particularly dog, to run loose in public places, and must
be kept on leashes.

(e.) Must not allow animal to defecate on another person’s property, on any street,
lane, boulevard, pathway or on any public place.

(f.) Must not to allow animal to cry, bark, yelp, howl or make noises frequently so
as not to disturb the peace and quite of the neighborhood.

(g.) May keep small livestock such as poultry and rabbits; provided, coops or pens
are located in owners’ premises.

(h.) Should be liable for any damage to property and/or injury to person, including
medical expenses, caused by their animal while outside their premises.

Owner/harborer shall execute an Undertaking to perform the aforementioned obligations and that
he/she will be liable for any damage to property and/or injury to person caused by his/her animal
while outside his/her premises or at stray. The Undertaking shall be part of the requirements for
registration.

Failure to perform by the owner of any of the aforementioned duties and responsibilities shall be a
ground for the revocation of license without prejudice to the penalty provided under Section 13
hereof.

ARTICLE V

IMPOUNDMENT & DISPOSITION OF ANIMALS

Section 9. Impoundment of stray animals

It shall be the duty of the Makati Public Safety Department and the Barangay to impound at the City
Pound any animal or animals running at large within the city limits. Animal impounded shall only be
released to its owner after paying the fines imposed under this ordinance and cost of safekeeping at
the rate of P50 for the first day of impounding and P30 everyday thereafter.

An animal shall be deemed to be “at large” when off the owner’s premises and/or either not on a leash
and controlled by its owner or other person, or pollutes property or vegetation belonging to someone
other than the owner, or by any means whatsoever injuring or damaging the property of one other
than its owner or members of his or her household except in defense of the owner, his family or
property, and this shall be true whether under control or not.

Section 10. Unvaccinated dogs/cats.

Unvaccinated dogs/cats, or dogs/cats not vaccinated within one (1) year, known to have been bitten or
exposed to a rabid animal, shall be euthanized. Dogs/cats vaccinated within one (1) year and known
to have been bitten by a rabid animal shall be revaccinated immediately and confined for forty (40)
days.

Section 11. Disposition.

In case nobody claims the animal after three (3) days from date of impoundment, the same shall be
put or offered for sale/adoption for petting purposes, donate to institutions for medical/scientific study
purposes and/or disposed of by means of euthanasia. The adopter shall pay an adoption of fee of
P150.00 plus the cost/s of safekeeping, such amounts shall also be incorporated in the price in case of
sale.

Section 12. Quarantine

A dog/cat which is known to have bitten or injured any person so as to cause an abrasion of the skin,
or a dog/cat which in the opinion of any licensed veterinarian to be rabies suspects, shall be closely
confined by its owner in accordance with the direction of the city veterinarian or barangay.

If the owner of the dog/dogs referred to in Subsection A cannot be determined or located, then the
City Veterinarian or Barangay shall order the confinement of the dog at the City/Barangay Pound for
a period of not less than ten (10) days. If the dog is determined to be suffering from rabies, or the
symptoms thereof, it shall be destroyed forthwith.

It is unlawful for any person knowing or suspecting a dog has rabies shall allow such dog to be taken
off his premises or beyond the city limits without the written permission of City Veterinarian. Every
owner or other person, upon ascertaining a dog/cat is rabid, shall immediately notify the
barangay/city veterinarian which shall either remove the dog to the pound or summarily dispose it.

ARTICLE VI

PENALTY

Section 13. The penalty for violation of any of the provision of this ordinance shall be penalized as
follows:

For violation of Section 3:

First Offense - P1,000 fine and registration of the animal


Second Offense - 1,500 fine and registration of the animal
Third Offense - 2,000 fine and confiscation of the animal

For violation of Section 4:

First Offense - P1,000 fine and submit the animal for


Vaccination.

Second Offense - 1,500 fine and submit the animal for


Vaccination

Third Offense - 2,000 fine and submit the animal for


Vaccination.

For violation of Section 6 & 12:

First Offense - P500 fine and confiscation of animal


Second Offense - 1,000 fine and confiscation of animal
Third Offense - 2,000 fine and confiscation of animal

For violation of Section 8:

First Offense - P200 fine


Second Offense - 500 fine
Third Offense - 1,000 fine and confiscation of the animal

ARTICLE VII

MAKATI CITY ANIMAL REGISTRY

Section 14. Establishment of Animal Registries

It is hereby established the City and Barangay Animal Registries in Makati. The City Veterinary
Office and Barangay Secretary of each barangay are hereby designated as City and Barangay
Registrars, respectively.

Section 15. Barangay Animal Registry

The Barangay Registrar shall be charged with the duty of registering animals, particularly dogs and
cats, within the barangay.

The Barangay shall make a quarterly report of the animals registered in the barangay to the City
Animal Registry.

Section 16. City Animal Registry

The City Animal Registrar shall be charged with the duty of collating data from the Barangay
Registries and shall manage the centralized animal registry for Makati City, including the supervision
and control on the issuance of animal licenses/tags.

ARTICLE VIII

ANIMAL CONTROL FACILITY

Section 17. Establishment of Facility

It is hereby established a City Animal Control Facility under the control and supervision of the City
Veterinary Office. The facility shall consist of:

1. Animal Diagnostic Laboratory


2. Spay Center
3. Existing Impounding Area

Section 18. Collection of Fees

The following laboratory examination fees may be collected from walk-in or private clients.

A. Fecalysis

Fees collected under this Section shall go to a Trust Fund for the exclusive use of the City Veterinary
Office. The fund shall be disbursed through an appropriate Ordinance.

ARTICLE IX

MISCELLANEOUS PROVISIONS

Section 19. If for any reason/s, any part of this Ordinance is declared illegal or invalid, other parts or
provisions not affected shall remain valid and in full force and effect.

Section 20. The Makati Public Safety Department, City Veterinarian and the Barangays are directed
to strictly implement this Ordinance.

Section 21. This Ordinance shall take effect after its enactment by the Sangguniang Panlungsod and
approval of the Mayor and fifteen (15) days after its posting and publication in a newspaper of local
circulation.
