THE ADVOCATES ACT

The Advocates (professional Requirements for Admission to Post-Graduate Bar Course)


(Amendment) Notice, 2010.
(under Section 6C(1)(c) of the Advocates Act, Cap 267)

IN EXERCISE of the powers conferred upon the Committee on Legal Education and
Training by section 6C (1) (c) of the Advocates Act, this Notice is issued this 7th day of
June, 2010.

1. Title

This Notice may be cited as the Advocates (professional Requirements for Admission to
Post-Graduate Bar Course) (Amendment) Notice, 2010.

2. Amendment of paragraph 3 of Legal Notice No. 17 of 2007

Paragraph 3 of the Advocates (Professional Requirements for Admission to Post-

Graduate Bar Course) Notice, 2007 is amended by inserting immediately after


paragraph (b) the following:-

“(C) he or she has passed an examination or examinations,


whether oral or written, approved by and conducted under the

supervision of the Law Council.”

3. Insertion of new paragraph 11

The Advocates (professional Requirement for Admission to Post-Graduate Bar Course)

Notice, 2007 is amended by inserting immediately after paragraph 10, the following new
paragraph:-

“11. Admission examination to post-graduate bar course


(1) An examination or examinations under paragraph 3(c) of this Notice shall:-

(a) be conducted and concluded within thirty days before the


commencement of the post-graduate bar course programme; and

(b) be based on the knowledge obtained from an approved law degree

programme, aptitude and the values an applicant attaches to the


legal profession.

(2) A person shall pay for the examination, a fee of fifty thousand shillings.

(3) A person who fails the examination or examinations under this paragraph may
apply to retake the examination at any subsequent examination for admission

to the post-graduate bar course.

(4) For the purpose of an oral examination, there shall be a panel of examiners,
consisting of not less than three persons, drawn from representative of-
(a) the Attorney General’s Chambers;
(b) the Universities or institutions whose law degree programme is
accredited by the Committee;
(c) the Judiciary; and
(d) the institution offering and conducting the post-graduate bar course;
(e) The Uganda Law Society;

(5) Every panel constituted under subparagraph (4) must have a representative of
an institution offering and conducting the bar course referred to in
subparagraph 4(e).

(6) A person is qualified for appointing as a member of the panel of examiners


under subparagraph (4) if that person-
(a) is an advocate of not less than five years standing; or

(b) for the purposes of a member representing a university or institution


under subparagraphs (4)b and (e), is a lecturer of 5 years standing at
the University or institution that he or she is representing.

(7) The Law Council shall determine the terms and conditions of service of the
U members of the panel of examiners.”
