IT’S ABOUT THE LAW ENFORCEMENT GOT AS ORGANIZED AS

ORGANIZED AS CRIME
- RUDY GIULIANI

INTRODUCTION
Crime is a social product. It is first and foremost seen through the eyes of society as it is a
social occurrence. Criminal law is simply one of the instruments by which organized societies
safeguard the safety and survival of individual interests.

Facets of criminal law

“When there's a person, there's a problem. When there's no person, there's no problem”.
- Josef Stalin

In the contemporary world, all facets of criminal law and justice are constantly taken into
account for the greater good of society. Although Orthodox academics bemoan the incoherent
state of present criminal law, they believe they are optimistic about the possibility of
improving its condition1. As the judicial role is so burdensome in criminal cases, judges have
to face the complexity of law due to 'non liquet'. "Justice delayed is justice denied." If justice
is not carried out at the right time, then even if it is carried out later, it is not real justice,
because when there was a demand for justice, there was a lack of justice. Current example in
Nirbhaya case convict finally hanged 7 year after brutal crime2.

Criminal law favour

Criminal law is precise and firmly favours the accused.

Acquittal on the basis of presumption of innocence (benefit of doubt) in severe crimes breeds
parochialism in society and spurs false complaints under section 498A of the IPC. If these
provisions are not at peace with modern society, how come? Justice can be achieved in
criminal conflict. Punishment in criminal cases require transformations in punishment. It play
a vital role in transforming human desire towards negative aspects of life.

Justice and crime

Law and justice are two distinct concepts. The law is a means of obtaining justice. If we want
to keep up with contemporary crime in today's society, we must likewise modernise justice.
We must not only punish offenders, but also eliminate the underlying causes of crime (drug
abuse, sexuality, violence). First and above, the traditional, recognised notion of the
appropriate treatment of convicted offenders remains traditional punishment. "The law is
everywhere but not inside the prison". Force is required for the commission of terrible
crimes, and law without force has no meaning in society. Fear must exist in order to deter
crime. If criminal law is rigorous, then the circumstances surrounding the law are likewise
preserved via storey. .

Conclusion
In the modern day, criminal law serves primarily as a negative image in society, since the
death penalty is also applied sooner, but the offences do not escape society. Numerous
research will be conducted in order to modify punishment. It will result in improved justice.
Justice must be loyal to society; only then can his presence be productive. The force will be
proportionate to the severity of the offence. In the current environment, deficient criminal
legislation should be amended as quickly as feasible, taking into account all facets and
demands of society.
