Differentiate the following kinds of obligations and give examples:


 
A. Suspensive and Resolutory
A Suspensive condition in the obligations is that the fulfillment of a certain condition will
be the cause or will give rise to an obligation, the existence of obligation is hope. This
mean if the condition fulfilled the obligation will exist. While for the Resolutory condition
in obligations the fulfillment of the condition is extinguishes an existing obligation.
There's an existing obligation, and when the condition happens or come to a time
obligation will be vanish or extinguish.

Examples for Suspensive:


Mary will give her youngest brother new phone if he will be part of honor students.
Nica will buy her sister a bag if her sister cleans their house twice a month.
Sarah will give her cousin Anna a gift if she will have a top on her class.

Examples for Resolutory:


I will give Marie daily allowance while teaching to her cousin for the 1 st grading exam.
Dem lends his laptop to AJ until AJ graduates of college.
Len will support the tuition fee of AJ while he is studying in College.

B. Joint and Solidary


The Joint obligation is where the whole obligation is to be paid or fulfilled proportionately
or equal by a different debtors or to be demanded by the different creditors. This kind of
obligation is a presumption all collective obligation unless solidarity stated. In joint the
key or main thing that should be thinks of is proportionate. Words that can indicate for a
joint liability are: mancomunada, mancomunadamente, pro rata, proportionately, “we
promise to pay” this is signed by 2 or more persons. While in Solidary each of the
creditors has a right to demand to the debtors to pay, and each of debtors is bound to
render their payments or it depends what it is. For solidarity we should remember the
entire compliance. Words that indicate to know the liability is solidary are the following
solidarily, jointly and severally, solidaria, in solidum, together and/or separated,
individually and/or collectively, juntos o separadamente, “I promise to pay” this is signed
by 2 or more persons.
Examples for Joint:
Marites and Juliet owes proportionately P10,000 to Santa.
Santa owes P20,000 t
A owes P10,000 from B and C
A and B owes pro rata P10,000 from C and D
