AN ORDINANCE ESTABLISHING THE CIVIL SOCIETY ORGANIZATION DESK AND

INSTITUTIONALIZATION OF PEOPLE’S COUNCIL IN THE LOCAL GOVERNMENT OF STA.


MAGDALENA, PROVINCE OF SORSOGON

WHEREAS, the 1987 Philippine Constitution provides the following mandates, to wit:

1. Article II, Section 23: “ The State shall encourage non-governmental,


community-based, or sectoral organizations that promote the welfare of the
nation”.
2. Article XIII, Section 15: “ The state shall respect the role of independent
people’s organizations to enable the people to pursue and protect, within the
democratic framework, their legitimate and collective interest and aspirations
through peaceful and lawful means.”
3. Article XIII, Section 16: “ The right of the people and their organizations to
effective and reasonable participation at all levels of social, political, and
economic decision-making shall not be abridged. The state shall, by law,
facilitate the establishment of adequate consultation mechanisms”

WHEREAS, Chapter 4 of the Republic Act 7160 otherwise known as the Local
Government Code of 1991 provides the following:

1. Section 34, Local government units shall promote the establishment and
operation of people’s and non-governmental organizations to become active
partners in the pursuit of local autonomy.
2. Section 35, Local Government units may enter into joint ventures and such
other cooperative arrangement with people’s and non-governmental
organizations to engage in the delivery of certain basic services, capability-
building and livelihood projects, and to develop local enterprises designed to
improve productivity and income, diversify agriculture, spur rural
industrialization, promote ecological balance, and enhance the economic and
social well-being of the people.
3. Section 36, a local government unit may, through its local chief executive and
with the concurrence of the Sanggunian concerned, provide assistance,
financial or otherwise, to such people’s and governmental organizations for
economic, socially-oriented, environmental, or cultural projects to be
implemented within territorial jurisdiction.

WHEREAS, Under Rules X, Section 27 (a) of Municipal Ordinance No. 04B, Series
of 2012 titled “ An ordinance Creating the Local Legislative-Executive Development
Advisory Council (LLEDAC) of the Municipality of Sta. Magdalena, Sorsogon”, expressly
provides priority concerns to actively involve private sector, non-government groups and
people’s organizations in the process of socio-economic development planning by local
government entities and special bodies, as well as in monitoring the implementations of
development projects;
NOW THEREFORE, be it ordained by the Sangguniang Bayan of Sta. Magdalena,
Sorsogon, in regular session assembled:

SECTION 1. Title – This Ordinance shall be known as the “ Anti-Road Obstruction Ordinance of
2021 “.

Section 2. Declaration of Policy. It is hereby declared the policy of the local government to
provide unobstructed public roads in the municipality from unauthorized commercial or personal
use to facilitate the smooth passage of persons and clear all obstructions to traffic and vehicular
flow to ensure safety and good order by providing rules and regulation in the utilization of roads
in its jurisdiction.

Section 3. Objective – This ordinance aims to ensure that the flow traffic is improve and
properly regulated, all public roads and sidewalks are free from any encroachments or obstacles
in order to make safe and convinient for the use of pedestrians.

DEFINATION OF TERMS:

1. Civil Society Organization – refers to a non-profit, citizen-based group that functions


independently of government. NGOs, sometimes called civil societies are organized on
community, national and international level to serve specific social or political purposes.
2. Federation – refers to an encompassing political or societal entity formed by uniting
smaller of more localize entities e.g. federal government; a union or organization.
3. Institutionalization – refer to the process of embedding some conception within an
organization, social system, or society as a whole.

ROLES AND RESPONSIBILITIES:

A. Civil Society Organization (CSO) Desk through its Desk Officer, shall perform the
following:

1. Cause the organization of federation or coalition of sectoral CSO’s from the barangay
level to municipal level and municipal level to provincial level, including the formation
of Peoples Council in the LGU.
2. Mobilize and ensure participation of accredited or recognized CSOs in the various
processes and activities of the local government, particularly in the planning,
budgeting, monitoring and service delivery areas.
3. Coordinate with the established Federation of Local CSO and Peoples Council, the
holding of regular meetings, and other relevant activities of the CSO.
4. Through the Peoples Council, monitor the CSO participation in the programs,
projects and activities of the Local Government Units
5. Maintain and update local CSO database.
6. Collaborate and submit reports to the concerned DILG field officers on matters
related to the programs, projects and activities of the CSOs
7. Perform other relevant functions as maybe necessary.
