1. Which department/agency of the Philippine Government has the major role in


dealing with land surveys? Support your answer. (3 points)

We have different government agencies that take part in dealing with land surveys. We
have the Land Management Bureau-DENR who undertakes land surveys of untitled land by
the administration or by private surveyors. They also provide patents. Another agency is the
Department of Agrarian Reform which deals with lands that are declared as agrarian reform
areas and they undertake their own cadastral surveys. Moreover, The Land Registration
Authority is responsible for issuing certificates of titles of the owners. They serve as the
central repository of all land records. Then lastly, we have the register of deeds and NCIP
who deals with Indigenous people.

2. What is the difference between survey order and survey authority? (3 points)

Survey order is an instruction from DENR officials to government geodetic engineers or


private ones to conduct a survey over a parcel of land of the public domain for a specific
purpose. Survey Authority on the other hand, is a permit from the DENR to private GE for
him/her to conduct an isolated survey over public land.

3. A client wants to have his 1-hectare private property to be surveyed. Upon


investigation of the documents, you found out that the property is still untitled. What
document should you acquire first (2 points) and which agency/office should you go
(2 points)?

I believe that the client should go to the Department of Environment and Natural Resources
(DENR), since this particular government agency undertakes cadastral surveys of untitled
properties either by administration or by contact with private surveyors. The client should
acquire for the Original Certificate of Title if he/she is the original owner of the lot, or TCT or
Transfer of Certificate of Title if the client just purchased it from another oweer.

4. What is CLOA (5 points)? Who are qualified to apply for it (3 points)? Which
government agency is involved in the application of CLOA (2 points)?

CLOA means Certificate of Land Ownership Award, which is a document evidencing


ownership of the land granted that must be registered at the Registry of Deeds. The
government agency that is involved for the application of CLOA is the Department of
Agrarian Reform (DAR). Those who are qualified should be a tenant farmer and that the
farm being cultivated or titled has a tenancy agreement with the landowner. The
process of choosing who the farmer beneficiaries are, the Municipal Agrarian Reform
Office (MARO) decides.
