MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is made and executed on this _____ day of _____ in the
Trece Martires City, Cavite, Philippines, by and between:

NORWIN B. BABAAN, of legal, Filipino citizen, married, with residence

and postal address at Brggy. Cabezas, Trece Martires City, Cavite, hereinafter
referred to as the "FIRST PARTY";

-and-

WENCESLAO BENTULA, of legal age, Filipino citizen, married, with

residence and postal address at B3 L32 GMA Housing Bagbag I, Rosario, Cavite,
hereinafter referred to as the “SECOND PARTY”;

WITNESSETH that:

WHEREAS, on May14, 2020 around 6:30 in the morning at Brgy. Hugo

Perez, Trece Martires City, Cavite accident involving the above vehicle with
registered under the name of the DARWIN D. CAPAREDA in the possession of
ownership NORWIN B. BABAAN by virtue of Deed of Absolute Sale driven by
PAUL O. BULAN with the following description:

BODY TYPE : SEDAN-4-DOOR PLATE NO. : WCB592
YEAR MODEL: 1998 CR NO. : 13793330-5

and a vehicle with the following description:

MAKE : RUSI ENGINE NO. : RW157FMHIHHA018681

SERIES : TC 125 CHASSIS NO. : RWCLPP205BE218681
BODY TYPE : MOTORCYCLE PLATE NO. : 4789WR
YEAR MODEL: 2011 CR NO. : 12709249-0

registered under the name of REYMOND H. MAGNO driven by the

WENCESLAO BENTULA;

WHEREAS, investigation revealed that the MOTORCYCLE-RUSI

was approximate cause of the incident. As a result, the FIRST PARTY’S
vehicle incurred damages.

WHEREAS, in order to compensate for the damage and inconvenience

brought about the incident the Parties hereto agrees, that:
 1. The SECOND PARTY shall pay the amount of Sixteen Thousand
Pesos (₱ 16,000.00) in favor of the FIRST PARTY as for all the
damages cause by the accident;

2. That the FIRST PARTY will not file any civil, criminal or
administrative case against WENCESLAO BENTULA;

IN WITNESS WHEREOF, the parties have set their hands and affixed their
signatures on the date and place above stated.
