- Political questions are questions to be decided by:

1. the people in their sovereign capacity or


2. regarding which, full discretionary power is given to executive or
legislative branch of government.

Self-Executing and Non-Self-Executing Provision of Constitution


Self-Executing Provisions
- Provisions that do not require an implementing or enabling law. The
provision of the Constitution itself is considered mandatory and it will not
require further legislation. Ex: Art. III- Bill of Rights is self-executing and does
not even require a constitution to be mandatory.

Non-Self-Executing Provisions
- Provisions which require an implementing or enabling law before that
constitutional policy can be implemented.

- In the rule of Statutory Construction, provisions of the Constitution should


be treated as self-executing rather than non-self-executing.

- However, there are still some provisions of Constitution that still require
further legislation so that they can implemented as mandatory. Ex: Art. II-
State Principles and Policies wherein most provisions required implementing
law or transforming law.
