- Facts: The K to 12 law of the requires a mandatory kindergarten


offering and 12 years of basic education. 6 years in elementary, 4 years
in junior high school and 2 years in senior high school. This law is for
the Philippines to conform with the ASEAN standard of education. Aside
from the K to 12 law, there is also Kindergarten Act where the mother
tongue system of language was introduced wherein the predominant
dialect in the province should be used as the medium of instruction. The
laws were challenge on the ground that they violate inclusivity insofar as
education is concerned as stated by Art. XIV of the Constitution.

- SC: Art. XIV of the Constitution and other policies of the state for
education is considered as non-self-executing provision of the
Constitution, hence, requires enabling law to be mandatory.
