GUIDELINES ON THE RELEASE AND UTILIZATION OF THE


BAYANIHAN GRANT TO PROVINCES
Guidelines 3.2 The grant shall be equivalent to one half (1/2) of the one-month FY 2020
Internal Revenue Allotment share of the provinces.

3.5 BGP shall be exclusively used for


3.5.1.1 Procurement of personal protective equipment;
3.5.1.2 Procurement of equipment, reagents, and kits for COVID-19 testing;
3.5.1.3 Procurement of medicines and vitamins;
3.5.1.4 Procurement of hospital equipment and supplies;
3.5.1.5 Procurement of disinfectants, sprayers, and other disinfecting supplies and misting
equipment;
3.5.1.6 Food, transportation (including fuel), and accommodation expenses of medical/health
workers and other personnel of the provincial, district, and other local hospitals operated by the
provincial government;
3.5.1.7 Expenses for the construction/repair/lease/rental of additional space/building to
accommodate COVID-19 patients and persons under monitoring/investigation;
3.5.1.8 Expenses for training of medical/health personnel of the provincial, district, and other
local hospitals operated by the provincial government relative to the conduct of COVID-19
testing and other related trainings; and
3.5.1.9 Other necessary COVID-19-related P/A/Ps and expenses of the provincial, district, and
other local hospitals operated by the provincial government; and

3.5.2 Operation and maintenance of duly established provincial checkpoints related to COVID-
19, such as provision of foods, medicines/vitamins, personal protective equipment, and
disinfecting supplies for the exclusive use of provincial government employees and personnel
concerned, including those hired under Contract of Service and Job Order schemes.
For NGAs, augment not duplicate.

For easy monitoring/tracking of the utilization of the allocation of each city and municipality, a
special account in the general fund (SAGF) for the BGP shall be created through an ordinance by
the local sanggunian pursuant to Section 313 of PA No. 7160. The creation of an SAGF for the
BGP may also be done by the l ocal sanggunian through inclusion in the pertinent appropriation
ordinance authorizing a supplemental budget covering the BGP.

Sec313 of 7160: profits or . . derived from the operation of public utilities and other econ ent after

What is Department of the Interior and Local Government-DBM Joint Memorandum Circular No. 02
dated March 30, 2020 shall also apply to the BGCM?????????
3.9 Funds which remain unutilized (BGP) after the lifting of the State of Calamity, by Presidential
Proclamation, shall be reverted to the National Treasury by the recipient provinces.

4.0 POSTING AND REPORTING REQUIREMENTS


The beneficiary provinces shall:
4.1 Comply with the posting requirements prescribed under PA No. 9184 and its 2016 Revised
IRR, and all relevant policies issued by the GPPB;
4.2 Prepare a monthly report on fund utilization and status of implementation Of PPAs using the
prescribed format (Annex B);

4.3 Post the accumulated reports on the LGU!s website and in at least three (3) conspicuous
public places in the locality at the end of every month; and
4.4 The local chief executive (LCE) of the implementing city/municipality shall send a written
notice (atleast 5) when said reports have been posted on its website to the DBM, House of
Representatives, Senate of the Philippines, House Committee on Appropriations, Senate
Committee on Finance, and other offices where the submission of reports is required under
existing laws, rules, and regulations.

ASSISTANCE TO LOCAL GOVERNMENT UNITS IN THE BAYANIHAN
TO RECOVER AS ONE ACT, REPUBLIC ACT NO. 11494
Section 4(q) of the "Bayanihan to Recover As One Act," Republic Act (RA)
No. 11494, PhPl,500,000,000.00 was appropriated to the Local Government
Support Fund (LGSF) to provide financial assistance to Local Government Units
(LGUs) in their local anti-COVID efforts.

exclusively used for financial assistance to LGUs to support the following


COVID-19-related programs, projects, and activities (PPAs) and expenses;
3.1.1 Procurement of personal protective equipment;
3.1.2 Procurement of equipment, reagents, and kits for COVID-19
testing;
3.1.3 Procurement of medicines and vitamins;
3.1.4 Procurement of hospital equipment and supplies,
3.1.5 Procurement of disinfectants, sprayers, disinfection tents, and
other disinfecting supplies and misting equipment;
3.1.6 Food, transportation (including fuel), and accommodation
expenses of medical personnel and other LGU personnel directly
involved in the implementation of COVID-19-related PPAs;
3.1.7 Procurement, maintenance, repair of ambulance, medical transport vehicle, and emergency
response vehicle;
3.1.8 Food assistance and other relief goods for affected households;
3.1.9 Expenses for the construction, repair, lease, or rental of additional space or building to
accommodate COVID-19 patients and persons under monitoring/investigation;
3.1.10 Expenses for the operation of stand-alone/mobile testing
laboratory;
3.1.11 Expenses for the purchase or rental of tents or spaces for
temporary shelters of the homeless;
3.1.12 Expenses for training of personnel in the conduct of COVID-19 testing and other related
trainings; and
3.1.13 Other necessary COVID-19-related PPAs and expenses.

3.3 All requests for financial assistance chargeable against the LGSF-COVip-19 FA to LGUs under the
"Bayanihan to Recover As One Act shall be
signed by the local chief executive (LCE) of the province. . .and shall be addressed to the Secretary of the
DBM.

3.4 All requests, together with the documentary requirements as prescribed herein be submitted to the
DBM Central Office (CO)
not later than October 31, 2020

3.5 support of the requests above


3.5.1 a list of programs and/or projects in order of their priorities signed by LCE if 2or more prog&/proj
3.5.2 Certification under oath from the LCE
3.5.3 Project Profile/Proposal approved by the LCE, including the
ff info:
3.5.3.1 Project/Program/Activity Title;
3.5.3.2 Target Beneficiaries;
3.5.3.3 Implementation Process; and
3.5.3.4 Period of implementation.
3.5.4 LGU contact details (annex B)together with photocopies of the LGU ID of the LCE and
his/her designated project contact person
3.5.5 Considering that the LGSF-COVID-19 FA to LGUs is intended to
boost the LGUs' capacity in their local anti-COVID efforts, the submission of the status of
previously issued funding support from the FY 2016 to 2020 LGSF-FA to LGUs will not be
required to facilitate release of funds.??????????????????????
3.7 Only requests prepared, signed, and submitted by the LCEs shall be evaluated by the DBM
3.9 The LGSF-COVID-19 FA to LGUs under RA 1494 shall be recorded as trust receipts for the
specified purpose(s) for which the funds were received. Unutilized fund as of December 31, 2021, shall
be reverted to the National Treasury. However, if determined earlier that the funds can no longer be
utilized, e.g. when the prog and/or proj cannot be implemented for any reason, it shall be immediately
reverted to the National Treasury.

6.0 POSTING AND REPORTING REQUIREMENTS


6.1 Comply with the posting requirements prescribed under RA 9184 and its IRR and all relevant policies
issued by the GPPB including the GPPB online portal pursuant to Section 4(u) of the
"Bayanihan to Recover As One Act," RA No. 11494;
6.2 Prepare quarterly reports on fund utilization and status of program/project implementation (Annex C),
until the Unified Reporting System for LGUs has been developed and can be used by the LGUs.
6.3 Consistent with the Full Disclosure Policy of the DILG, the said reports shall be posted in at least
three (3) conspicuous public places in the locality and on the LGU's website within twenty (20) cds from
the end of each quarter.

6.4 The LCE of the LGU shall send a written notice (atleast 5) to the Secretary of DBM, Speaker
of the House of Representatives, President of the Senate of the Phiiippines, and the Chairpersons
of the House Committee on Appropriations and Senate Committee on Finance upon posting of
the reports on the LGU's website. The date of notice to said agencies shall be considered the date
of compliance with the requirement

7.0 the LGU shall ensure that no duplication of funding will occur. As such, the LGU, through
its LCE, shall immediately inform the DBM if it has received funding from other sources for the
same programs or projects.

4.2 In case of conflict between the terms of the Treaty or International or Executive Agreement
and this IRR, the former shall prevail.
4.3 Foreign-funded Procurement of Goods, Infra, and Consulting Services by the GoP follow
9184 and IRR unless treaty. . . provides otherwise
4.4 This IRR shall not apply to the following activities
Official Development assistance (oda) unless the GoP and the foreign grantor agree
otherwise;
Acquisition of real property
Public-Private sector infrastructure or development projects and other procurement
covered by R.A. 6957, as amended by R.A. 7718, entitled “An Act Authorizing the
Financing, Construction, Operation and Maintenance of Infrastructure Projects by the
Private Sector, and for Other Purposes,” as amended: Provided, however, That for the
portions financed by the GoP, in whole or in part, the provisions of the Act and this IRR
shall apply.

6.2 Procuring Entities are mandated to use the Generic Procurement Manuals (GPMs), Philippine
Bidding Documents (PBDs), and other standard forms issued by the GPPB. However, whenever
necessary, to suit the particular needs of the Procuring Entity, modifications may be made,
particularly for major and specialized procurement, subject to the approval of the GPPB.

7.1 The APP shall include provisions for foreseeable emergencies based on historical records

consolidation into an indicative app and to the BAC for final recommendation of the appropriate
procurement modality.

7.3.2 In the preparation of the indicative APP, the end-user shall formulate their respective
Project Procurement Management Plans (PPMPs) for their different PAPs.
The PPMP shall include

a) information on whether PAPs will be contracted out, implemented by administration in


accordance with the guidelines6 issued by the GPPB, or consigned;
b. the type and objective of contract to be employed;
c) the extent/size of contract scopes/packages;
d) the procurement methods to be adopted, and indicating if the procurement tasks are to be
outsourced as provided in Section 7.3.3 of this IRR;
e) the time schedule for each procurement activity and for the contract implementation; and
f) the estimated budget for the general components of the contract.

RULE VI - PREPARATION OF BIDDING DOCUMENTS

The Bidding Documents shall include the following:


a) ABC;
b) Invitation to Bid/Request for Expression of Interest;

c) Eligibility Requirements;

d) Instructions to Bidders, including scope of bid, documents comprising the bid, criteria for
eligibility, bid evaluation methodology/criteria in accordance with the Act, and post-qualification,
as well as the date, time and place of the pre-bid conference (where applicable), submission of
bids and opening of bids;

e) Terms of Reference, for Consulting Services;

f) Scope of work, where applicable;

g) Plans/Drawings and Technical Specifications;

h) Form of Bid, Price Form, and List of Goods or Bill of Quantities;

i) Delivery Time or Completion Schedule;

j) Form, Amount, and Validity Period of Bid Security;

k) Form, Amount, and Validity of Performance Security and Warranty; and

l) Form of Contract and General and Special Conditions of Contract.

17.6.Detailed Engineering for the Procurement of Infrastructure Projects (dapat)mine!


Except design and build scheme, submit only its preliminary engineering designs as part of its
bid .
In case of projects with pending acquisition of right-of-way site or location, the procurement
process may commence, but no award of contract shall be made until an authority or permit to
enter is issued by the property owner; or a notarized deed of sale or deed of donation is
executed in favor of the government; or a writ of possession is issued by a court of competent
jurisdiction, as the case may be.

RULE VII – INVITATION TO BID

L. Notice of Award; Contact Approval; Notice to Proceed.

1) Except in Shopping, and Negotiated Procurement through Emergency Cases, Agency-to-Agency and Small Value Procurement ,
the following procedures shall apply in the issuance of the (NOA), (PO) and (NTP) for the
Alternative Methods of Procurement:

a. -the BAC - recommend to the HOPE the award of contract.


-the HOPE - approve or disapprove the recommendation w/in fifteen (15) cds from
receipt,.
-approval, the HOPE -issue the NOA to the Supplier, Contractor or Consultant.
-disapprove, such disapproval shall be based only on valid, reasonable, and justifiable
grounds to be expressed in writing, addressed to the BAC.

c. The HOPE or . . . . shall issue the NTP, if necessary, and a copy of the approved
contract to the Supplier, . . .within three (3) calendar days from the date of approval of the
contract by the appropriate government approving authority.

Posting of Notice of Award, Contract and Notice to Proceed 38. Unless . .national security
as determined by the HOPE, the BAC, through its Secretariat, shall post the
NOA,
Contract/PO,
including the NTP if necessary,

in the PhilGEPS website, the website of the Procuring Entity concerned, if available, and at any
conspicuous place within ten (10) days from their issuance, except ABC of ₱50,000.00 and
below.
