Question 1:
There was an agreement between Ali & Amjad for the sale of 4,000 boxes of canned fruit packed in cases
of 50 boxes. When delivered it was discovered that half the cases contained only 40 boxes although the
total number of boxes was still 4,000. The market value was not affected. Solve the case; tell
consequences and solutions by keeping in mind discharge of contract.

ANSWER:
As a result of the past strategy, 4,000 boxes of canned natural item squeezed in occurrences of 50 boxes
will be sold. At the hour of movement, it was observed that piece of the cases contained only 40 boxes,
regardless the way that the full scale number of boxes was at this point 4,000, showing that there was
some material change, i.e., one party makes a material change in the term of understanding without the
consent of the other party. Appropriately, the understanding has been finished.

Course of action:

The course of action is Nominal Damages. Since no damages were caused (market regard was
unaffected), we were not paid or rebuffed.

Question 2:
Aslam agrees to sell his mobile to Sarah for an amount of Rs. 20,000. He also promises to deliver it
within 2 days. The next day, when Aslam approached Sarah with his phone, Sarah refuses to accept it
without any valid reason. Solve the case; tell consequences and solutions by keeping in mind discharge of
contract.

Answer:
Agreement: For the circumstance of an Offer to Perform, this matter is finished by Discharge by
Performance. Since the promisor pledges to fulfill the assurance, but the guarantee will not do
accordingly.

Likewise,

Aslam advanced towards Sarah with his phone, which she would not recognize though no one can really
say why. As needs be, the understanding has been finished. Aslam, of course, has the advantage to sue
Sarah for break of understanding.

Type of damage:

The plan is (Nominal Damages). Since no damages were caused in the principal situation, we were not
paid or rebuffed.
