NEW JERSEY'S NOTICE OF ELECTION TO DECLINE INTERYENTION

Pursuant to the New Jersey False Claims Act, N.J.S.A. 2A:32C-5(g)(2), the State of New

Jersey ("New Jersey"), through its counsel, John J. Hoffman, Acting Attomey General of New

Jersey (the "Attorney General"), Janine Matton, Deputy Attorney General, appearing, hereby

notifies the Court of its decision not to intervene in this action.

Although New Jersey declines to intervene, it respectfully refers the Court to

N.J.S.A. 2A:32C-5(b), (c) and2\:32C-6(f), which allow Laurence Schneider ("Relator") to

maintain the action in the name of New Jersey; however, "the action may be voluntarily

dismissed by the person bringing the action if the Attomey General gives written consent to the

dismissal along with the reason for consenting, and the court approves the dismissal."

Therefore, New Jersey respectfully requests that, should either the Relator or Defendants

propose that this action be dismissed, settled, or otherwise discontinued, this Court solicit the

written consent of the Attomey General before ruling or granting its approval.

Furthermore, pursuant to N.J.S.A. 2A:32C-6(f), New Jersey respectfully requests that all

pleadings and orders filed in this action be served upon the Attomey General. Additionally, New

Jersey reserves its right to order any deposition transcripts and to intervene in this action, for

good cause, at alater date.
