Pursuant to the North Carolina False Claims Act, N.C. Gen. Stat. § 1-608(b)(4)(b),

the State ofNorth Carolina is writing to notifY the Court of its decision to decline

intervention in this case.

will serve to fulfill our obligation to notifY the Court ofour declination.

Because the United States and other states are still timely considering

whether to intervene, this case should presently remain under seal. By copy of this
