SECTION-3. THE CONDUCT OF ELECTIONS RULES, 1961.1
The public notice of an intended election referred to in section 31 shall be in Form 1 and
shall, subject to any directions of the Election Commission, be published in such manner as
the returning officer thinks fit.
On the issue of a notification under section 30, the returning officer 2 shall give public notice
of the intended election in such form and manner as may be prescribed, inviting nominations
of candidates for such election and specifying the place at which the nomination papers are to
be delivered.
The Election Commission can regulate its procedures and it can authorize officer on
special duty to sign and authenticate the notification issued in the name of the
Election Commission.
Proper notice of election must be given as required by law. The rule requiring the giving of
such notice cannot be dispensed. It may be noticed that notice for election is to be issued
under Sections 12 to 18 of Representation of the People Act, 1951. Certain other notices such
as the notice appointing the date for nominations, scrutiny of nominations etc., are also to be
given. Sometimes questions arise as to how the election is affected, if there are some errors in
the notice.

CONCLUSION
This Conduct of Election Rules, 1961 was amended in 2013. The notification as per the
Official Gazette states that in exercise of the powers conferred by Section 169 of the
Representation of the People Act, 1951 (43 of 1951), the Central Government, after
consulting the Election Commission, hereby makes the following rules further to amend the
Conduct of Election Rules, 1961 and that these rules may be called the Conduct of Election
(Amendment) Rules, 2013.
The Acts and Rules listed above empower the Election Commission to issue directives to
deal with different aspects involved with the preparation of electoral rolls, its revision and
the actual conduct of elections. All grievance related to the elections will have to be resolved
under the Representation of the People Acts 1950 and 1951, and the Registration of Electors
Rules 1960 and Conduct of Elections Rules 1961. These Acts and Rules form a complete set

of rules and a code for all matters relating to the elections to the State Legislatures and
Houses of Parliament.
