NOTICE
Sirs/Mesdames:

Please take notice that the Court en banc issued a Resolution


dated OCTOBER 6, 2020, which reads as follows:

“G.R. No. 217590 (Philippine Contractors Accreditation Board v.


Manila Water Company, Inc.). ‒ From the Decision1 dated March 10, 2020
of this Court, petitioner Philippine Contractors Accreditation Board, et al.
filed a Motion for Reconsideration on the ground that an event supervened
whereby the assailed regulation was amended and the restriction on equity
was replaced by a requirement on paid-up capital.2

Moreover, three (3) groups moved to intervene in this case and filed
their respective pleadings similarly praying for the reconsideration of the
same Decision:

1. Motion for Intervention with the attached Intervention of the


National Constructors Association of the Philippines, Inc.;3

2. Motion for Leave to Intervene and to Admit Attached


Motion for Reconsideration-in-Intervention with the attached
Motion for Reconsideration in Intervention (Re: Decision dated
10 March 2020) of PCA Pampanga, Contractors Association of
Negros Oriental, Inc., Association of Carrier & Equipment
Lessors Davao Chapter Inc., Los Contratistas de la Ciudad de
Zamboanga, Inc. and Davao Constructors Association Center,
Inc.;4 and

3. Motion for Leave to Intervene with the attached Motion for


Reconsideration-in-Intervention of C.M. Pancho Construction,
Inc., EEI Corporation, DATEM Inc., D.M. Consunji, Inc., Will
Decena and Associates, Inc., DDT Konstract, Inc., IPM
Construction and Development Corporation, First Balfour, Inc.,

Kanlaon Construction, Inc., as represented by Philippine
Constructors Association, Inc.5

WHEREFORE, the Court DIRECTS the respondent to file


Comment on the Motion for Reconsideration of petitioner, as well as on the
aforementioned Motions for Intervention and Motions for Reconsideration-
in-Intervention, within ten (10) days from notice. Chairperson Arsenio M.
Balisacan of the Philippine Competition Commission is likewise
DIRECTED to file an amicus curiae brief on petitioner’s Motion for
Reconsideration and Motions for Reconsideration-in-Intervention also
within ten (10) days from notice. The Clerk of Court En Banc shall send
notices to the Philippine Competition Commission at its new address at the
25th Floor, Vertis North Corporate Center 1, North Avenue, Quezon City,
