Arbitration Problem:

M/s Aditya and Sons is a firm consisting of Father and 3 sons. The firm owns 3
complexes, 3 shopping bulidings situated in different places which have been
leased out on monthly rent basis and the firm is also involved in real-estate
business. This firm turnover is 8 lakhs / month.

M/s Hot and sour Restaurant is Restaurant run by Mr. Sandeep who runs three
restaurants under the same name in three different cities.
Mr. Sandeep and M/s Aaditya and sons firm have entered lease deed for period
of 10 years dated 2019 February. Mr. Sandeep is a tenant of M/s Aaditya and
sons firm. Accordingly Mr. Sandeep have occupied 3 floor complex situated in
Infantry road Ballari on monthly rent of Rupees 1, 50,000/- and Rupees
80,00,000 as deposit. And 6% increase of rent on every 12 months.

Under the same deed they have executed an Arbitration clause to resolve their
dispute relating to the subject matter of the lease deed. And both the parties
have agreed to appoint chairman of ‘Chamber of Commerce' as an Arbitrator.
Now due to corona pandemic Restaurant business is under loss. Due to which
Mr. Aditya has not paid 7 month’s rent even after several notice by M/s Aditya
and sons.
Hence M/s Aditya and sons, has served notice to Mr. Sandeep for Arbitration.
