1. Lengthiest Written Constitution
The Constitution of India is the lengthiest of all the written constitutions of the world. It is a very
comprehensive, elaborate and detailed document.
Originally (1949), the Constitution contained a Preamble, 395 Articles (divided into 22 Parts) and 8
Schedules.
Presently (2018), it consists of a Preamble, 466 Articles (divided into 25 Parts) and 12 Schedules.
Four factors have contributed to the elephantine size of our Constitution. They are:
o Geographical factors, that is, the vastness of the country and its diversity.
o Historical factors, e.g., the influence of the Government of India Act of 1935, which was bulky.
o Single Constitution for both the Centre and the states except Jammu and Kashmir.
o Dominance of legal luminaries in the Constituent Assembly.

3. Blend of Rigidity and Flexibility
A rigid Constitution is one that requires a special procedure for its amendment, as for example, the
American Constitution. A flexible constitution, on the other hand, is one that can be amended in the
same manner as the ordinary laws are made, as for example, the British Constitution.
The Constitution of India is neither rigid nor flexible but a synthesis of both. Article 368 provides for
two types of amendments:
o Some provisions can be amended by a special majority of the Parliament, i.e., a two-third
majority of the members of each House present and voting, and a majority (that is, more than
50 per cent), of the total membership of each House.
o Some other provisions can be amended by a special majority of the Parliament and with the
ratification by half of the total states.
Note: At the same time, some provisions of the Constitution can be amended by a simple majority of the
Parliament in the manner of ordinary legislative process. Notably, these amendments do not come under
Article 368.

4. Federal System with Unitary Bias
Note:
the term ‘Federation’ has nowhere been used in the Constitution. Article 1, on the other hand,
describes India as a ‘Union of States’ which implies two things: one, Indian Federation is not the
result of an agreement by the states; and two, no state has the right to secede from the federation.

5. Parliamentary Form of Government
The parliamentary system is based on the principle of cooperation and co-ordination between the
legislative and executive organs
The Presidential system is based on the doctrine of separation of powers between the two organs.
The features of parliamentary government in India are:
o Presence of nominal and real executives;
o Majority party rule,
o Collective responsibility of the executive to the legislature,
o Membership of the ministers in the legislature,
o Leadership of the prime minister or the chief minister,
o Dissolution of the lower House (Lok Sabha or Assembly).
Note:
The parliamentary system is also known as the ‘Westminster’ model of government, responsible
government and cabinet government.
Indian Parliamentary System is largely based on the British pattern, however, there are some
fundamental differences between the two:
o the Indian Parliament is not a sovereign body like the British Parliament.
o Further, the Indian State has an elected head (republic) while the British State has hereditary
head (monarchy).

The Supreme Court, on the one hand, can declare the parliamentary laws as unconstitutional through
its power of judicial review. The Parliament, on the other hand, can amend the major portion of the
Constitution through its constituent power.
Note: In USA, the federal laws are enforced by the federal judiciary and the state laws are enforced by the
state judiciary.
8. Fundamental Rights
Part III of the Indian Constitution guarantees six fundamental rights to all the citizens:
o Right to Equality (Articles 14–18),
o Right to Freedom (Articles 19–22),
o Right against Exploitation (Articles 23–24),
o Right to Freedom of Religion (Articles 25–28),
o Cultural and Educational Rights (Articles 29–30), and
o Right to Constitutional Remedies (Article 32).
Note:
Fundamental rights are justiciable in nature, that is, they are enforceable by the courts for their
violation.
Fundamental Rights are not absolute and subject to reasonable restrictions:
o They are not sacrosanct and can be curtailed or repealed by the Parliament through a
constitutional amendment act.
o They can also be suspended during the operation of a National Emergency except the rights
guaranteed by Articles 20 and 21.

यद्यपि भारतीय संपिधान के , कई तत्व दु पनया के लगभग हर संपिधान से उधार पलए गए है , पकन्तु भारत
के संपिधान में कई प्रमुख पिशेषताएं हैं जो इसे अन्य दे शों के संपिधान के गठन से अलग करती हैं ।
संपिधान की कई मूल पिशेषताओं (1949 में अिनाई गई) में कई संशोधनों, पिशेषकर 7 िें, 42 िें, 44 िें ,
73 िें और 74 िें संशोधनों के कारण, एक महत्विूणण बदलाि आया है । िास्ति में, 42 िें संशोधन

संपिधान
एक कठोर संपिधान िह होता है पजसके संशोधन के पलए एक पिशेष प्रपक्रया की आिश्यकता होती है ,
उदाहरण के पलए, अमेररकी संपिधान। दू सरी ओर, एक लिीला संपिधान िह है पजसे उसी तरह से
संशोपधत पकया जा सकता है जैसे सामान्य कानून बनाये जाते हैं , उदाहरण के पलए, पिपटश संपिधान।
भारत का संपिधान न तो कठोर है और न ही लिीला लेपकन दोनों का पमला-जुला रूि है । अनुच्छेद 368
में दो प्रकार के संशोधन का प्रािधान हैं :
1. कुछ उिबंधों को संसद के पिशेष बहुमत िारा संशोपधत पकया जा सकता है , अथाण त, प्रत्येक सदन के
उिखस्थत और मतदान करने िाले सदस्ों का दो-पतहाई बहुमत, और प्रत्येक सदन में कुल सदस्ों का
नोट : एक ही समय में, संपिधान के कुछ प्रािधानों को साधारण पिधायी प्रपक्रया के तरीके से संसद के साधारण
बहुमत िारा संशोपधत पकया जा सकता है । इस प्रकार संशोधन अनुच्छेद 368 के तहत नहीं आते हैं ।

नोट : संपिधान में कंही भी संघीय शब्द का इस्तेमाल नहीं पकया गया दू सरी ओर, अनुच्छेद 1, भारत को एक
राज्ों के संघ ’के रूि में िपणणत करता है , पजसके दो अपभप्राय है : एक, भारतीय संघ राज्ों िारा पकसी
समझौते का िररणाम नहीं है ; और दू सरा , पकसी भी राज् को संघ से अलग होने का अपधकार नहीं है ।
संसदीय प्रणाली पिधायी और कायणकारी अंगों के बीि सहयोग और समन्वय के पसद्ां त िर आधाररत है
जबपक राष्ट्रिपत प्रणाली दोनों अंगों के बीि शखक्तयों के िृथक्करण के पसद्ां त िर आधाररत है ।

ध्यान दें
संसदीय प्रणाली को िेस्टपमंस्टर सरकार के मॉडल , पजम्मेदार सरकार और कैपबने ट सरकार के रूि में भी
जाना जाता है ।
भारतीय संसदीय प्रणाली काफी हद तक पिपटश प्रणाली िर आधाररत है , हालां पक, दोनों के बीि कुछ
इसके आलािा भारतीय राज् में एक पनिाण पित प्रमुख (गणतंि) होता है जबपक पिपटश राज् में िंशानुगत
प्रमुख (राजशाही) होता है ।
भारतीय संपिधान पनमाण ताओं ने संसदीय संप्रभुता के पिपटश पसद्ां त और न्यापयक ििणस्व के अमेररकी
घोपषत कर सकता है । िही दू सरी ओर संसद अिनी संसदीय शखक्त के माध्यम से संपिधान के बडे भाग में
संशोधन कर सकती है ।
भारतीय संपिधान एक न्यापयक प्रणाली स्थापित करता है जो एकीकृत होने के साथ-साथ स्वतंि भी है ।
सिोच्च न्यायालय दे श में एकीकृत ’न्यापयक प्रणाली में सबसे ऊिर है :

अदालतों की यह एकल प्रणाली दोनों ,केंद्रीय कानूनों के साथ-साथ राज् कानूनों को लागू करती है
संपिधान में इसकी स्वतंिता सुपनपित करने के पलए पिपभन्न प्रािधान पकए हैं :

नोट : संयुक्त राज् अमेररका में संघीय कानूनों को संघीय न्यायिापलका िारा लागू पकया जाता है और राज्
कानूनों को राज् न्यायिापलका िारा लागू पकया जाता है ।
8. मौनलक अनधकार
ध्यान दें :
मौपलक अपधकार प्रकृपत में न्यायसंगत हैं , अथाण त्, िे अिने उल्लंघन के पलए अदालतों िारा प्रितणनीय हैं ।
