Note:
Constitution itself declares that “these principles are fundamental in the governance of the
country and it shall be the duty of the state to apply these principles in making laws”.
Hence, they impose a moral obligation on the state authorities for their application. But,
the real force (sanction) behind them is political, that is, public opinion.
In the Minerva Mills case (1980), the Supreme Court held that ‘the Indian Constitution is
founded on the bedrock of the balance between the Fundamental Rights and the Directive
Principles’.
Note:
The original constitution did not provide for the fundamental duties of the citizens. These were
added during the operation of internal emergency (1975–77) by the 42nd Constitutional
Amendment Act of 1976 on the recommendation of the Swaran Singh Committee.
The 86th Constitutional Amendment Act of 2002 added one more fundamental duty – Article 51A
(k) to provide opportunities for education to his child or ward between the age of six and fourteen
years.

A secular state claims to treat all its citizens equally regardless of religion, and claims to avoid
preferential treatment for a citizen from a particular religion over other religion.
A true secular state should steadfastly maintain national governance without influence from
religious factions

Note:
What is a Negative concept of Secularism?
The Western concept of secularism connotes a complete separation between the religion (the
church) and the state (the politics).
What is a Positive concept of Secularism?
The Indian Constitution embodies the positive concept of secularism, i.e., giving equal respect to all
religions or protecting all religions equally. (The negative concept of secularism is inapplicable in the
Indian situation where the society is multireligious).
The following provisions of the Constitution reveal the secular character of the Indian State:
The term ‘secular’ was added to the Preamble of the Indian Constitution by the 42nd
Constitutional Amendment Act of 1976.
The Constitution secures to all citizens of India, liberty of belief, faith and worship.
The State shall not deny to any person equality before the law or equal protection of the
laws (Article 14).
The State shall not discriminate against any citizen on the ground of religion (Article 15).
Equality of opportunity for all citizens in matters of public employment (Article 16).
All persons are equally entitled to freedom of conscience and the right to freely profess,
practice and propagate any religion (Article 25).
Every religious denomination or any of its section shall have the right to manage its religious
affairs (Article 26).
No person shall be compelled to pay any taxes for the promotion of a particular religion
(Article 27).
No religious instruction shall be provided in any educational institution maintained by the
State (Article 28).
Any section of the citizens shall have the right to conserve its distinct language, script or
culture (Article 29).
All minorities shall have the right to establish and administer educational institutions of
their choice (Article 30).
The State shall endeavour to secure for all the citizens a Uniform Civil Code (Article 44).

12.Universal Adult Franchise
The Indian Constitution adopts universal adult franchise as a basis of elections to the Lok Sabha and
the state legislative assemblies.
Every citizen who is not less than 18 years of age has a right to vote without any discrimination of
caste, race, religion, sex, literacy, wealth, and so on.
Note: The voting age was reduced to 18 years from 21 years in 1989 by the 61st Constitutional
Amendment Act of 1988.
13.Single Citizenship
Though the Indian Constitution is federal and envisages a dual polity (Centre and states), it provides
for only a single citizenship, that is, the Indian citizenship.
In India, all citizens irrespective of the state in which they are born or reside enjoy the same political
and civil rights of citizenship all over the country and no discrimination is made between them
excepting in few cases like tribal areas, Jammu and Kashmir, and so on.
Note: In countries like USA, each person is not only a citizen of USA but also a citizen of the particular state
to which he belongs. Thus, he owes allegiance to both and enjoys dual sets of rights—one conferred by the
National government and another by the state government.
14.Independent Bodies
The Indian Constitution establishes certain independent bodies. They are envisaged by the
Constitution as the bulwarks of the democratic system of Government in India. These are:
Election Commission
Comptroller and Auditor General
Union Public Service Commission
State Public Service Commission
Note: The Constitution ensures the independence of these bodies through various provisions:
security of tenure,
fixed service conditions,
expenses being charged on the Consolidated Fund of India, and so on.
15.Emergency Provisions
The Constitution envisages three types of emergencies -
National emergency on the ground of war or external aggression or armed rebellion16
(Article 352)
State emergency (President’s Rule) on the ground of failure of Constitutional machinery in
the states (Article 356) or failure to comply with the directions of the Centre (Article 365)
Financial emergency on the ground of threat to the financial stability or credit of India
(Article 360)

Note:
During an emergency, the Central Government becomes all-powerful and the states go into the
total control of the centre.
It converts the federal structure into a unitary one without a formal amendment of the
Constitution.
This kind of transformation of the political system from federal
(during normal times) to unitary (during emergency) is a unique feature of the Indian Constitution.
16.Three-tier Government
The 73rd Amendment Act of 1992 gave constitutional recognition to the Panchayats (rural local
governments) by adding a new Part IX and a new Schedule 11 to the Constitution.
The 74th Amendment Act of 1992 gave constitutional recognition to the municipalities (urban local
governments) by adding a new Part IX-A and a new Schedule 12 to the Constitution.
17.Co-operative Societies
The 97th Constitutional Amendment Act of 2011 gave a constitutional status and protection to co-
operative societies.
It made the following three changes in the constitution:
It made the right to form co-operative societies a fundamental right (Article 19).
It included a new DPSP on promotion of co-operative societies (article 43-B)
It added a new Part IX-B in the constitution which is entitled as “the c-operative societies”
(article 243-ZH to 243-ZT).

करते हुए, उन्हें अपने दे श, समाज और अपने साथी नागररक ं के कतिव्य ं के प्रवत भी सचेत रहना ह गा।

मूल संविधान में नागररक ं के मौवलक कतिव्य ं के वलए प्रािधान नहीं वकया गया था। स्वणि वसंह सवमवत की
वसफाररश पर 1976 के 42 िें संिैधावनक संश धन अवधवनयम द्वारा आं तररक आपातकाल (1975-77) के
संचालन के दौरान इन्हें ज डा गया था।
2002 के 86 िें संिैधावनक संश धन अवधवनयम द्वारा छह से चौदह िषि की आयु के बीच के बच् ं क
वशक्षा के अिसर प्रदान कराने सम्बधी एक और मौवलक कतिव्य - अनुच्छेद 51 ए(क) क ज डा
इसवलए, यह भारतीय राज्य के आवधकाररक धमि के रूप में वकसी विशेष धमि क स्वीकार नहीं करता है |
एक धमिवनरपेक्ष राज्य अपने सभी नागररक ं के वलए धमि की परिाह वकए वबना समान रूप से व्यिहार
करने का दािा करता है , और वकसी अन्य धमि के ऊपर वकसी विशेष धमि के नागररक क प्राथवमकता दे ने
से बचने का दािा करता है ।
एक सच्े धमिवनरपेक्ष राज्य क धावमिक गुर् ं से प्रभावित हुए वबना लगातार राष्टरीय शासन बनाए रखना
चावहए
ध्याि र्दें :
धमिवनरपेक्षता की पविमी अिधारणा धमि (चचि) और राज्य (राजनीवत) के बीच पूणि अलगाि का संकेत दे ती
है ।
भारतीय संविधान धमिवनरपेक्षता की सकारात्मक अिधारणा का प्रतीक है , अथाि त, सभी धमों क समान
सम्मान दे ना या सभी धमों की समान रूप से रक्षा करना। (धमिवनरपेक्षता की नकारात्मक अिधारणा
धमिवनरपेक्ष ’शब्द 1976 के 42 िें संिैधावनक संश धन अवधवनयम द्वारा भारतीय संविधान की प्रस्तािना में
ज डा गया था।

प्रस्तािना भारत के सभी नागररक ं क विश्वास, आस्था और पूजा की स्वतंत्रता प्रदान करती है ।
राज्य कानून के समक्ष वकसी व्यक्ति की समानता या कानून ं के समान संरक्षण से इनकार नहीं करे गा
(अनुच्छेद 14) ।
राज्य धमि के आधार पर वकसी भी नागररक के साथ भेदभाि नहीं करे गा (अनुच्छेद 15) ।
साििजवनक र जगार के मामल ं में सभी नागररक ं के वलए अिसर की समानता (अनुच्छेद 16) ।
सभी व्यक्ति समान रूप से वििेक की स्वतंत्रता और वकसी भी धमि क स्वतंत्र रूप से मानने, आचारण
(अनुच्छेद 26) ।
वकसी व्यक्ति क वकसी विशेष धमि के प्रचार के वलए क ई कर दे ने के वलए बाध्य नहीं वकया जाएगा
(अनुच्छेद 27) ।
राज्य द्वारा अनुरवक्षत वकसी भी शैक्षवणक संस्थान में क ई धावमिक वनदे श नहीं वदया जाएगा (अनुच्छेद 28) ।
नागररक ं के वकसी भी िगि क अपनी विवशष्ट भाषा, वलवप या संस्कृवत के संरक्षण का अवधकार ह गा।
(अनुच्छेद 29)
राज्य सभी नागररक ं क एक समान नागररक संवहता (अनुच्छेद 44) बनाने का प्रयास करे गा।
मतावधकार क अपनाता है ।
प्रत्येक नागररक वजसकी उम्र कम से कम 18 िषि है , उसे जावत, नस्ल, धमि, वलंग, साक्षरता, धन और वकसी
ियट : 1989 में 61 िें संविधान संश धन अवधवनयम अवधवनयम द्वारा मतदान की आयु क 21 िषि से घर्ाकर 18 िषि
कर वदया गया।
हालां वक भारतीय संविधान संघीय है और एक द हरी राजनीवत (केंद्र और राज्य )ं की पररकल्पना करता है ,
लेवकन यह केिल एक ही नागररकता, यानी भारतीय नागररकता प्रदान करता है ।

भारत में, चाहे िे वजस भी राज्य में पैदा हुए ह ं या वनिास करते ह ,ं सभी नागररक पूरे दे श में नागररकता के
समान राजनीवतक और नागररक अवधकार ं क प्राप्त करते है , और उनके बीच क ई भेदभाि नहीं वकया
जाता है , वसिाय कुद मामल ं में जैसे - आवदिासी क्षेत्र ,ं जम्मू और कश्मीर जैसे कुछ मामल ं क छ डकर ।

भारतीय संविधान कुछ स्वतंत्र वनकाय ं की स्थापना करता है । उन्हें भारत में सरकार की ल कतां वत्रक
प्रणाली के महत्वपूणि स्तम्भ के रूप में संविधान द्वारा पररकक्तल्पत वकया गया है । ये हैं :

आपातकाल के दौरान, केंद्र सरकार सिि शक्तिशाली ह जाती है और राज्य केंद्र के प्रभािी वनयंत्रण में चले
जाते हैं ।
यह संविधान के औपचाररक संश धन के वबना संघीय ढां चे क एकात्मक में पररिवतित करता है ।
1992 के 73 िें संश धन अवधवनयम ने संविधान में एक नया भाग 9 और एक नई अनुसूची 11 ज डकर
2011 के 97 िें संिैधावनक संश धन अवधवनयम ने सहकारी सवमवतय ं क संिैधावनक दजाि और संरक्षण
वदया।
इसने संविधान में वनम्नवलक्तखत तीन बदलाि वकए:
इसने सहकारी सवमवतय ं क बनाने के अवधकार क मौवलक अवधकार बनाया (अनुच्छेद 19)।
इसमें सहकारी सवमवतय ं के संिद्र्िन हे तु एक नया नीवत वनदे शक शावमल वकया | (अनुच्छेद 43-बी)
इसने संविधान में एक नया भाग 9-B ज डा है वजसे "सहकारी सवमवतयां " (अनुच्छेद 243-ZH से 243-ZT)
के रूप में स्थावपत वकया गया है ।

प्रकृवत रखती थी । अतः गां धीिादी विचारधारा पूरी तरह से प्रवतवबंवबत नहीं ह ती है ।
