This presentation aims to provide a proper knowledge
in The 1986 Freedom Constitution and the 1987
Constitution of the Philippines.

Was this Law created to protect the people of the


country's basic rights? What triggered the government
to create The 1986 Freedom Constitution Law and The
1987 Constitution, and what are the goals of this
Freedom Constitution?

CONSTITUTION
The 1986 Freedom Constitution was intended to be a
transitional constitution from the 1973 constitution to a
new constitution.

After the successful people power, trumped the martial


law regime, Cory Aquino was given three (3) options;

revert back to the 1935 Constitution

make changes and amendments and revisions to the


1973 Constitution

to draft and legislate a new constitution.


*Cory Aquino chose to create and draft legislate a new


constitution which is now the
“1987 CONSTITUTION".*

The purpose of the freedom constitution is to


introduce democracy and to ensure democracy for the
Filipino people and for the republic of the Philippines,
so it was in place for a year while the framers of the
1987 constitution worked hard to frame and to draft
and legislate a permanent constitution which is now
the 1987 constitution.

1987
CONSTITUTION
The 1987 Constitution was framed/ drafted by a
constitutional commission which was composed of
48 members. They presented it the then President
Cory Aquino on October 1986.

And in 1987, it was ratified through a plebiscite.


(It was February 8, 1987 when the 1987 constitution
was ratified by the public)

Under this constitution, we are a democratic


republic which ensures the democracy and the
freedom of the Filipino people.
The 1987 constitution provided for three (3) branches of
government which as we know are the;
legislative
executive, and
judiciary

This ensures that all three branches are of equal power


and one of the notable provisions in the 1987 constitution
is that the president can still declare martial law, but
cannot last as long as it did when the Marcos reign. In the
1987 constitution, a Martial law can only last for 60 days.

*After the expiration of the 60 days,


the senate or the congress can either extend it or reject it.*

There is a concept of cheque's and balances to ensure
that none of the three branches are exceeding its
power or its mandate under the constitution and if so,
the judiciary is responsible for putting them in place.

(eg. The executive does something that over powers


the power of the legislative or exceeds its mandate
under a constitution, the supreme court is
responsible for calling them out and calling these acts
unconstitutional).
*This is because of what happened during the Marcos Martial law,
that the power of the President became unlimited which the 1987 wants to avoid.

So now, the executive, legislative and the supreme court has now equal powers*

It is also important to note that under the 1987


constitution, three (3) independent commissions
were created. And these are the;

Another important part of the 1987
constitution is the Bill of Rights (Article 3)
where you can find constitutionally
protected rights of the Filipinos.

Basically, the 1987 constitution ensures that the Filipino
people lives in a democratic country and their rights are
protected under a constitution, hence, the constitution
protects the people from the abuse of power by those
people in position.

The 1987 constitution holds the rights of the Filipino


people under these articles to protect the Filipino
people’s rights and ensure that the people in position
does not overpower the people like what happened in the
Martial Law.
