1) What is RA 10591 all about?

Answer:
RA 10591 is an act providing for a Comprehensive Law on Firearms and Ammunition
and Providing Penalties for violation thereof, or it is also known as the “Comprehensive
Firearms and Ammunition Regulation Act”. In section two of this acts declaring of state
policy, it says here that It is the policy of the State to maintain peace and order and protect
the people against violence. The State also recognizes the right of its qualified citizens to
self-defense through, when it is the reasonable means to repel the unlawful aggression
under the circumstances, the use of firearms. Towards this end, the State shall provide for a
comprehensive law regulating the ownership, possession, carrying, manufacture, dealing in
and importation of firearms, ammunition, or parts thereof, in order to provide legal support to
law enforcement agencies in their campaign against crime, stop the proliferation of illegal
firearms or weapons and the illegal manufacture of firearms or weapons, ammunition and
parts thereof.

2) What the restrictions enforced by RA 10591 as regards the carrying of firearms?

Answer:
SEC. 10 of RA 10591, Firearms That May Be Registered. – Only small arms may be
registered by licensed citizens or licensed juridical entities for ownership, possession and
concealed carry. A light weapon shall be lawfully acquired or possessed exclusively by the
AFP, the PNP and other law enforcement agencies authorized by the President in the
performance of their duties: Provided, That private individuals who already have licenses to
possess Class-A light weapons upon the effectivity of this Act shall not be deprived of the
privilege to continue possessing the same and renewing the licenses therefor, for the sole
reason that these firearms are Class “A” light weapons, and shall be required to comply with
other applicable provisions of this Act.
a) Civilians are required to have a License to Own and Posses Firearm (LTOPF) for
him/her to be authorized to acquire, own/possess or use a firearm. This is a pre-
requisite prior to application for the Registration of Firearm(s).
b) The minimum requirements are the following:

Qualification
In order to qualify and acquire a license to own and possess a firearm or firearms and
ammunition, the applicant must be: a) a Filipino citizen; b) at least twenty-one (21) years old
at the time of the filing of his/her written application to own and possess a firearm or firearms;
(c) has gainful work, occupation, or business or has filed an Income Tax Return (ITR) for the
preceding year as proof of income, profession, business or occupation.

Requirements
a) Filled-Out Application Form (notarized)
b) Clearances issued by the Regional Trial Court (RTC) and Municipal/Metropolitan
Trial Court (MTC) that has jurisdiction over the place where the applicant resides
and/or the Sandiganbayan as the case may be, showing that he/she has not been
convicted by final judgment of a crime involving moral turpitude or that he/she has
not been convicted or is currently an accused in any pending criminal case before
any court of law for a crime that is punishable with a penalty of more than two (2)
years;
c) Neuro-psychiatric clearance issued by the PNP Health Service and its accredited
psychologist or psychiatrist;
d) A certification that the applicant has passed the drug test conducted by PNP Crime
Laboratory or any accredited and authorized drug testing laboratory or clinic.
e) A certification that the applicant has passed a gun safety and responsible gun
ownership seminar which is administered by the PNP or a registered and
authorized gun club;
f) National Police Clearance;
g) NSO Birth Certificate;
h) Proof of Latest Billing;
i) At least two valid IDs (one Government issued ID);
j) Income Tax Return (ITR), Certificate of Employment, Business permit or any
appropriate document as proof of income;
k) For Government Employee (Copy of Appointment Order, Oath of Office);
l) For Military Reservists (J9 Clearance);

3) When was RA 10591 created and implemented?

Answer:
It was enacted and passed by the Senate of the Philippines and the House of
Representatives of the Philippines on February 4, 2013 and February 5, 2013, respectively. It
was signed into law by President Benigno Aquino III on May 29, 2013.

4) What is the penalty for carrying a gun without a permit in the Philippines?
Answer:
It will found in section 31 of article V which is known as Penal Provision, it says there
that the absence of permit to carry outside of residence will be penalize of prision
correccional and a fine of Ten thousand pesos (P10,000.00). It shall be imposed upon any
person who is licensed to own a firearm but who shall carry the registered firearm outside
his/her residence without any legal authority therefor.

5) What are the salient provisions of RA 10591?

Answer:
The Republic Act no. 10591 provisions are significant to the individual such as civilian
or authorized person who carry firearms or want to carry firearms because, this was made to
maintain peace and order and protect the people against violence. They must abide the law
when handling a guns, ammunitions and explosives because if they violated the law
according to Republic Act of 1059, they are accountable or liable and investigate the illegal
firearms. In order to qualify and acquire firearms at first, they must be registered and licensed
the firearms to identify whether they are qualified or not. It will help them to know the do’s
and don’ts if they want to own a gun or firearms and also when using it to a crime it will
identify the identity of the owner of the gun and ammunition. Lastly, they will penalize
according to the law and provision of RA 10591 if they aren’t comply with it.
