J.M.Ist Class , Court No.7, Agartala. PRC(SP)- 328 of 2021 01.12.2021 Today the case is fixed for SR/appearance. A bail petition is filed by Ld Counsel Mr. S. Chakraborty on behalf of accused persons namely, Sri Manik Sarkar, Sri Badal Choudhury, Sri Pabitra Kar, Sri Manik Dey, Sri Sankar Prasad Datta, Sri Madhusudhan Das, Smt Rama Das and Smt Krishna Rakshit for granting the accused persons bail on the strength of PR bond on any condition. A vokalatnama is filed on behalf of the afore named accused persons by their engaged Ld. Counsel Mr. S. Chakraborty. Perused. Tag the same with the case record. Ld. A.P.P. raised objection against the release of afore named accused persons on PR bond as Section 353 of IPC is non-bailable offence. Ld. Counsel Mr. S. Chakraborty appearing on behalf of the afore named accused persons verbally submitted that the accused persons are permanent residence of Tripura and are very respectable and they have duly appeared before this Court on receipt of summons and they have duly complied with the Court orders and in future will continue to comply with the Court orders. Keeping in view the conduct of the afore named accused persons, they may be enlarged on bail on furnishing PR bond. Heard submissions of both the sides. Considered. Perused the case record. On perusal of case record it appears that cognizance of offence is taken under Sections 188/353/270/34 of IPC and Section 3 of Epidemic Disease Act and Section 82 of the Tripura Police Act against accused persons namely, Sri Manik Sarkar, Sri Goutam Das, Sri Badal Choudhury, Sri Pabitra Kar, Sri Manik Dey, Sri Sankar Prasad Datta, Sri Madhusudhan Das, Smt Rama Das and Smt Krishna Rakshit. Considering the nature and gravity of the offence and keeping in view the fact that all the afore named accused persons have appeared before the Court on receipt of summons, I am of the considered opinion that the accused persons namely, Sri Manik Sarkar, Sri Badal Choudhury, Sri Pabitra Kar, Sri Manik Dey, Sri Sankar Prasad Datta, Sri Madhusudhan Das, Smt Rama Das and Smt Krishna Rakshit be enlarged on P.R. bond on furnishing bond of Rs. 30,000/- each with one surety of like amount. Another accused person Sri Goutam Das is not present before this Court. Ld. Counsel Mr. S. Chakraborty appearing on behalf of the accused persons verbally submitted before this Court that accused Sri Goutam Das had expired and in support of his claim he has submitted before this Court a copy of death certificate where it is mentioned that accused Sri Goutam Das had expired on 8th day of September, 2021 at 7.19 am issued by Apollo Multi Specialty Hospital, Kolkata. Perused. Tag the same with the case record. From the death certificate submitted by Ld. Counsel Mr. S. Chakraborty it is clear that accused Sri Goutam Das had expired and so he be abated from further proceedings. All the accused persons namely, Sri Manik Sarkar, Sri Badal Choudhury, Sri Pabitra Kar, Sri Manik Dey, Sri Sankar Prasad Datta, Sri Madhusudhan Das, Smt Rama Das and Smt Krishna Rakshit are directed to remain present on the next date fxed without fail. Supply a copy of this order to both Prosecution and Defence. Office is directed to prepare accused copy. Fix 25.01.2022 for appearance/supply of accused copy.
