EXTRAVERSION

The scope of this paper is to identify the Jurisprudential reflections in each

of the following instances and an attempt is made for substantiating a novel extraversion to it:

INSTANCE 1:
The first instance essentially lays down the Jurisprudential reflection of ‘Sociology’ along
with ‘Political Science’ in law. Starting with sociology, which is the study of society, it can
be held over here that the notion of the constitution being referred to as an ‘evolving
organism’ is the reflection of sociology in law as sociology aims to study the society, its
norms, cultures, stereotypes, problems according to the current times. Thus, Sociological
Jurisprudence is the formation and modification of laws according to the current needs and
conscience of the society. This is specifically true for the existence of the binding authority
of the constitution just like any other Grundnorm. The Constitution was being formed by a
non-elected body called as the constituent assembly, not theoretically representing the
national consensus. However, constitution is still relevant because of ‘Constituanalism’
which is the feeling to abide by the constitutional provisions. This Constituanalism is
prevailing only because the constitution responds to the needs of the public, gets changed
according to the changing times.
