1. That the plaintiff has filed the present against this defendant for declaration
and temporary injunction.

2. That the defendant has already submitted his written statement to the said
plaint.

evidence of this defendant.

4. That, however, since has met an accident on………. 2009, and still bed ridden, it
will not be possible for the defendant to remain in this Hon'ble Court today as well as
during the next one fortnight.
