COMPLAINT-AFFIDAVIT

I, DAX XENON VALDE SALA, Filipino, of legal age, married, and a resident of
Brgy. Punong, Tomas Oppus, Southern Leyte, after being sworn to in accordance
with law, do hereby depose and state:

1. That I personally know NILO V. SALA who is a resident of Brgy. Punong,

Tomas Oppus, Southern Leyte.

2. That around 6:00o’clock in the morning of August 10, 2018, I was waiting
for a fish vendor in order to buy fish for breakfast;

3. That when I found one passing by the National Highway peddling fish
riding his motorcycle, I immediately called up his attention and he
happened to stop at the side of the road in front of NILO V. SALA’s house;

4. That I approached the fish vendor named NILO TIMKANG and inquired as
to what kind of fish he is selling how much it cost per kilo;

5. That to my surprise while I was busy negotiating with the fish vendor,
NILO V. SALA without apparent reason came near us and suddenly
prompted me to a fistfight uttering “Gara-garaon ka ug drive imo sakjanan
salig ka kay naa ka igsoon nga abogado! Unja nganu diay naa man ko anak
na pulis!” Judicial Affidavit of witness NILO TIMKANG and a copy of the
POLICE REPORT is hereinafter referred to as Annex “A” and Annex “B”;

6. That the such act annoyed and irritated not only me but my entire family
because I did nothing to provoke him to do such act especially that I am his
niece and he is the recipient of our house given away by my late father for
free without any consideration or condition when we moved to our new
house in Brgy. Mag-ata Tomas Oppus, Southern Leyte sometime in 1989;
 7. That after the incident, I filed a complaint against Nilo V. Sala in Brgy.
Punong regarding the incident and reported it to the Tomas Oppus Police
Station;

8. That numerous complaints has been filed against him in Brgy. Punong of
doing similar acts in the past like slapping even his younger sister Gloria V.
Sala, challenging certain Alex Matondo to a fistfight during mediation
proceedings concerning his act of challenging Alex to a _____________ in
front of the Brgy. Chairman;

9. That several confrontation before the Brgy. Chairman and the Pangkat ng
Tagapagkasundo were conducted but both parties failed to settle the issue
which prompted me to file this complaint not just for my own benefit but
for the benefit of the people of our barangay in order to live peacefully and
in order to deter people who has similar inclinations towards violence to
refrain from doing such acts;

10.That I am therefore executing this Complaint-Affidavit in support of the

charges of violation of Art. 287 Paragraph 2 of the Revised Penal Code for
UNJUST VEXATION against NILO V. SALA, who may be served with
subpoena and other processes of this Honorable Court at his residence in
Brgy. Punong, Tomas Oppus, Southern Leyte, Philippines;
