FOOD CATERING SERVICE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This contract entered into this_____day of September 2018, at Southern Leyte State University – Tomas Oppus, San Isidro,
Tomas Oppus, Southern Leyte, Philippines, by and between:

The Republic of the Philippines, through the Southern Leyte State University – Tomas Oppus, with office at San Isidro,
Tomas Oppus, Southern Leyte, established under RA 9261 represented herein by MONNA LIZA M. BOSQUE( Department Head-
BSBA) and hereinafter referred to as the “CONTRACTING AGENCY”.

MR. JACKY LOU SERENIO JAC CATERING, with office address at Poblacion, Bontoc, Southern Leyte, hereinafter
referred to as the “CONTRACTOR”.

WITHNESSETH

WHEREAS, the CONTRACTING AGENCY desires for food catering services for BSBA Socialization to be held at the
SLSU Tomas Oppus Campus on September 12, 2018 at 3-8PM;

WHEREAS, the CONTRACTING AGENCY needs the services of Mr. Jacky Lou Serenio / JAC CATERING to render
the food catering services for 4th year BSBA Students during their socialization on the aforementioned date;

WHEREAS, the CONTRACTOR has agreed and accepted to undertake the catering services under the terms and
conditions herein set forth;

NOW, THEREFORE, for and in consideration of the above premises, and the covenants hereinafter stipulated the parties
hereto hereby agree as follows:

ARTICLE I
SCOPE OF WORK

1.1 The CONTRACTOR shall undertake the catering services for the 4 th year BSBA students to be held at the SLSU Tomas
Oppus Campus on September 12, 2018 in accordance with the requirements set forth by the same.

1.2 The works to be done under this AGREEMENT shall include the furnishing by the CONTRACTOR of foods, catering
crews, kitchen utensils and all other operations necessary for the _____ BSBA students and officials during the said event .

1.3 Should the catering services becomes incapacitated to continue in improving the needed services for the CONTRACTING
AGENCY due to some problems or troubles, the CONTRACTOR has the obligation of looking for other means in order to continue
the contracted service at their own expense.

ARTICLE II
CONTRACT PRICE

2.1 The CONTRACTING AGENCY shall pay the CONTRACTOR, as consideration of full and faithful performance and
accomplishment of all the obligations specified in Article I, which the CONTRACTOR agreed to undertake, perform and accomplish
under this contract, the total contract price of THIRTY THOUSAND PESOS (P30,000.00).

ARTICLE III
TERMS OF PAYMENTS

3.1 Upon signing of this AGREEMENT, the CONTRACTING AGENCY, shall pay to the CONTRACTOR a partial
payment of Fifteen Thousand Pesos(P15,000.00) as partial payment while the balance of Fifteen Thousand Pesos shall be paid on
September 13, 2018.

ARTICLE IV
IN CASE OF EMERGENCY

4.1 If any untoward incident happens during the food catering services, like accident which may cause injuries, the
CONTRACTOR will provide financial assistance to the families of the casualties/victims for hospitalization cost.

ARTICLE V
NON-WAIVER

5.1 No inspection made by the CONTRACTING AGENCY or any of its employees or representatives; nor any order by the
CONTRACTING AGENCY for the payment of the money; nor the payment after acceptance of the whole part of the works; nor any
extension of the Contract Time granted by the CONTRACTING AGENCY or its employees or representatives; shall construed or
operate as waiver by the CONTRACTING AGENCY of any of the provisions of the AGREEMENT or any right of action accruing
to CONTRACTING AGENCY, for each any breach of this AGREEMENT.

5.2 The CONTRACTING AGENCY shall not be liable to damages of any untoward incident and injuries of personnel resulting
from accidents and similar situations. The right of action accruing to CONTRACTING AGENCY under existing law or breach of
this AGREEMENT.

ARTICLE VI
BREACH AND VENUE

6.1 A material breach by the CONTRACTOR of any warranty, representation or covenant herein made entitles the
CONTRACTING AGENCY, at its option to rescind the AGREEMENT upon written notice to this effect by the CONTRACTING
AGENCY to the CONTRACTOR. Any suit proceeding which either party may be virtue of or relation to or in any way connected
with this AGREEMENT, shall be filed with the SOUTHERN LEYTE STATE UNIVERSITY – TOMAS OPPUS, San Isidro,
Tomas Oppus, Southern Leyte, Philippines, and that the proper laws applicable to the contract shall be the laws enforced in the
Republic of the Philippines.

ARTICLE VII
EFFECTIVITY

7.1 This AGREEMENT shall take effect five (5) days after receipt by the CONTRACTOR of the Notice to Proceed from the
CONTRACTING AGENCY, which Notice shall be issued only after approval of this AGREEMENT by the Philippine Government
concerned.

IN WITNESS WHEREOF, the parties hereto have executed this contract at the place and date above written.
