Branch : Infrastructure law

Infrastructure is a key driver for the Indian economy. It is this sector that is responsible for
spearheading India’s overall development and enjoys intense focus from the Government of India.
The latter have initiated policies that would ensure time-bound creation of world-class infrastructure
in the country.

A Public Private Partnership (PPP) is a commercial legal relationship defined by the Government of
India in 2011. It can be defined as, “an arrangement between a government or statutory entity or
government-owned entity on one side and a private sector entity on the other, for the provision of
public assets and/or related services for public benefit, through investments being made by and/or
management undertaken by the private sector entity for a specified time period, where there is a
substantial risk sharing with the private sector and the private sector receives performance-linked
payments that conform (or are benchmarked) to specified, predetermined and measurable
performance standards.".

Scope

In this project we will cover following topics-

• Infrastrucre law.

• Public private partnership(PPP).

• Types of PPP.

• Role of private sector partner in PPP Projects.

• Legal framework and incentives for private sector participation in infrastrucre developement.

• Some live projects under PPP model and cases regarding this.

Why this Topic ?

Because in the 2021-22 Budget speech, Finance Minister Nirmala Sitharaman had announced that
monetising operating public infrastructure assets is a very important financing option for new
construction.

The PPP model has delivered mixed results in India on account of overextended balance sheets,
contract disputes, land acquisition problems, and lack of a dispute-resolution mechanism.

Our new parliament (Central Vista Redevelopement Project ) also constructed under PPP model by
Tata Projects.
