Subject: Policy for Grant of Change of Land use permission for setting up of Eco-Friendly
Farmhouse in Agriculture zone.
In exercise of the powers conferred under Section 11 of the Haryana Scheduled Roads
and Controlled Areas Restriction of Unregulated Development Act, 1963 (hereinafter referred as Act,
1963), the Government is pleased to convey the following policy parameters for grant of change of land use
permission for setting up of Eco-Friendly Farmhouse in the Agriculture zone of Hyper, High, Medium &
Low Potential towns beyond 500 mtr. distance from the urbanizable zone of respective Development
Plans:-

1. Fee and charges:-
i. Scrutiny fee - as prescribed in the Act No. 41 of 1963 on the entire applied area.
ii. Conversion charges – Shall be applicable as prescribed for normal residential use under Act
No. 41 of 1963 on the entire CLU granted area.

2. Other parameters:-

a. The site shall be developed as a self sustainable unit.


b. Minimum 15 metres set back at front and 6 metres on all other sides shall be mandatory.
c. Installation of solar water heating system shall be provided in the building.
d. 100% treatment and re-use of waste water shall be ensured by the owner. No effluent in any
case should be generated from the site.
e. Rain water harvesting shall be mandatory.
f. In addition to permissible ground coverage/FAR mentioned in para-C above, a swimming
pool with maximum size of 50 sqm shall be permissible subject to the conditions that it will
be exclusively for personal use of the plot owner and not for commercial purpose. Structural
and public safety measures for the construction, operation and maintenance of swimming
pool shall be adhered to.
g. Tree plantation on at least 15% of farm land shall be mandatory.
h. No additional purchasable FAR in terms of provisions of HBC-2017 shall be permissible.
i. 100% on site processing of all green/animal waste shall be mandatory.
j. No commercial use of the site i.e. usage as banquet hall/party hall, recreational, religious,
institutional etc. shall be allowed.
k. The provisions of the Haryana Apartment Ownership Act, 1983 shall not be applicable to the
sites approved under this policy.
l. In case of any misuse of the building, the premises shall be sealed and penal action as per
provisions of Section 12 of Act No. 41 of 1963 shall be taken.
m. The District Level Monitoring Committee Chaired by Deputy Commissioner shall make
regular checks of the premises to ascertain that the policy provisions are not being violated.
The concerned Sub Divisional Magistrate, Superintendent of Police will be members and
District Town Planner concerned will be member secretary of this committee.

A copy is forwarded to Chief Coordinator Planner (NCR) Haryana, Chandigarh with the
request to incorporate the said provisions in the zoning regulations of the Development Plans, which are in
process of finalization/publication. Apart from this, necessary amendment in the zoning regulations of other
Development Plans, which already stands published, may also be made.
