Activity 8: The Public Relations Planning Process

The instant case happened five days before Christmas. Gunshots were heard coming from a
caliber 9mm, apparently owned by a police officer which took two lives in the process. Two
bloodied bodies, one from a mother and the other, her son, fell on the ground. Lifeless.
Breathless.

The killing was caught on a phone video and was uploaded quickly in social media.
Thereafter, multiple opinions from the public arose. Public trial is imminent. The police
officer was then dismissed form service. The eyes of the public are focused on the two (2)
information’s filed before the Court.

The case before the Court has been sensationalized due to the personalities involved and due
to the fact that the actual killing was recorded and was uploaded in immediately in the social
media. Consequently, the video was overwhelmed with public opinion. However, the court
remains steadfast and independent and will not be persuaded or swayed by any social forces
or influence. The Court will uphold its functions as the rule of the law and shall remain
passive, neutral, and impartial. The court will not base its decision on public opinion and
sensationalism but rather, will only be swayed by evidence presented.

Court, the amount of 50,000.00 pesos as temperate damages shall be awarded.

The prosecution presented various receipts (Exhs. “CC”, “DD’ and “EE”) from Paniqui
Realty and Development Corporation and Lotus Memorial Service which are as follows:

Being supported by competent proof, the Court awards to the heirs of Sonia and Frank
Anthony the amount 252,560 pesos as actual damages.

Likewise, the Court is aware of the fact that other expenses were incurred by the victims’
families as a consequence of their death, hence it is proper that temperate damages be
awarded.

WHEREFORE, in light of the foregoing considerations, judgement hereby rendered finding


acussed JONEL NUEZCA y MOSTALES GUILTY beyond reasonable doubt of the crime of
murder (two counts) as defined and penalized in Article 258 of the Revised Penal Code, and
hereby sentenced as follows:

(1) In Criminal Case No. 313-20, to suffer the penalty of reclusion perpetua, and to pay the
heirs of Sonia Gregorio y Rufino the following amounts: P100,000 as civil indemnity;
P100,000 as moral damages; P100,000 as exemplary damages; P126,280.00 as actual
damages; and P50,000 as temperate damages with interest of six percent (6%) per annum
from the finality of this decision until fully paid.

(2) In Criminal Case No. 314-20, to suffer the penalty of reclusion perpetua, and to pay the
heirs of Frank Anthony Gregorio y Rufino the following amounts: P100,000 as civil
indemnity; P100,000 as moral damages; P100,000 as exemplary damages; P126,280.00 as
actual damages; and P50,000 as temperate damages with interest of six percent (6%) per
annum from the finality of this decision until fully paid.

So Ordered.
