CONSTRUCTION AGREEMENT

This DEED OF CONSTRUCTION AGREEMENT entered into at Chennai on the 1 st day


of October 2020
BETWEEN
M/s HONEYCOMB INTERIOR SOLUTIONS PVT.LTD. Represented by its Directors
Mr. G. Saravanan and Mr. S. Azharuddin having their registered office at No.726/1, 1 st Floor,
Anna Salai, Nandanam, Chennai -600035, hereinafter called “THE BUILDER” on one part;
AND
Mr. Jaya Kumar, residing at Plot No.14, 3rd Main Road, Jothi Nagar, Annanur, Chennai- 600062
hereinafter called the LANDLORD/OWNER on the other part:

The terms THE BUILDER and THE LANDLORD/OWNER would mean and include
themselves, their legal heirs, successors, legal representatives, assigns, Directors, etc.,
respectively.
The BUILDER is a registered company in the field of building designing, architectural services,
interior designing and building construction.

The LANDLORD/OWNER is the absolute owner of the land at Plot No.14, 3 rd Main Road, Jothi
Nagar, Annanur, Chennai – 600062 more fully described in the SCHEDULE-A hereunder.

The LANDLORD/OWNER approached the BUILDER for construction of superstructure /


house in the schedule- A mentioned land, the BUILDER also agreed to construct building on the
following terms and conditions.

NOW THIS DEED OF CONSTRUCTION AGREEMENT WITNESSETH:

I. BUILDING DRAWING AND APPROVAL

a. The BUILDER shall prepare and submit the drawing for the proposed building to the
LANDLORD. The LANDLORD/OWNER shall approve the drawing submitted by the
Builder.

b. The LANDLORD on approval of the drawing of the building shall get the plan approval
for the construction of the building from the concerned authority. The BUILDER shall
help the LANDLORD for the plan approval.

c. The plan approval shall be done/obtained by the LANDLORD/OWNER at his cost.

II. CONSTRUCTION COST:

a. The LANDLORD/OWNER shall pay a sum of


GROUND FLOOR – Rs.1700/ (One Thousand Seven Hundred Only) per square feet.
FIRST FLOOR – Rs.1700/ (One Thousand Seven Hundred Only) per square feet.
The scope and specification of construction are detailed
more fully in SCHEDULE-B hereunder.
III. PAYMENT TERMS:

a. The LANDLORD/ OWNER shall make the payment to the BUILDER in the following
terms:
 Agreement& up to Basement - 25%
 On Commencing Ground Floor Roof - 5%
 First Floor Roof & Brick Work - 15%
 Brick Work - 15%
 Plastering - 10%
 Wood work - 5%
 Electrical & Plumbing - 10%
 Tiles - 10%
 Painting - 5%

IV. SPECIFICATIONS OF CONSTRUCTION

The detailed specifications about the construction are described more fully in
SCHEDULE-B hereunder.

V. PERIOD OF COMPLETION:
a. The BUILDER shall construct and complete the building/ superstructure within a
period of Eight months from the date of handing over the approved plan by the
Authority, and if “The BUILDER” fails to complete the work within the specified period
shall be liable to pay compensation of 0.1% of contract amount per month of delay to
“The LANDLORD/OWNER”.

b. The period of construction starts only from the date of receipt of approved plan/
drawing by the BUILDER from the Authority.

c. If any problem arises from the neighbor or from any authority and if the
construction could not be carried out due to such objection or obstruction, that
period shall not count in the period of construction.

d. If the construction could not be carried or continued due to natural calamity or due
to any unavoidable reason, the period shall not be taken into consideration in the
period of construction.

e. If the LANDLORD/OWNER makes any change or alteration from the approved


drawing and if any alteration is effected after its completion, the construction period
shall extend and the period shall not be strictly taken as mentioned above.

f. There shall be grace period of 3 months from the agreed date of completion of the
building.

VI. WATER & POWER/ ELECTRICITY:

a. Water and Power required for construction work shall be arranged and provided at or
near the construction site by the LANDLORD/OWNER as per the safety standards.

b. The LANDLORD/OWNER shall bear the expenses for the temporary electricity
connection and shall bear the cost.

c. If the ground water is not suitable for construction, the LANDLORD shall make
arrangements for water for construction and storage of such water.

d. The monthly temporary electricity charges will be paid by the LANDLORD till the
completion of the building to the EB without any default.

VII. DUTIES OF LANDLORD

a. The LANDLORD shall take all responsibility for the peaceful construction by the
BUILDER.

b. In case of any dispute by the neighbors or any disturbance by any authority or any person
in the site shall be sorted out by the LANDLORD.

b. Any legal issue in regard to the construction by any third party or by any Government
or any other Authority shall be dealt by the LANDLORD/OWNER at his cost and
shall defend the BUILDER in such suits.

c. The BUILDER if happened to defend or contest any legal proceedings that may arise
as mentioned supra, the cost and expenses shall be borne by the LANDLORD. If
spent by the BUILDER, the same shall be reimbursed by the LANDLORD.

e. The LANDLORD shall indemnify the BUILDER from any civil suits, legal battle or
litigation that may arise out as mentioned in clause VII (C).

f. If the construction could not be carried out due to any litigation or legal battle, that
period shall not be exempted in the period of completion stated above.

g. The BUILDER shall put up shed or small huts for storage of materials and also permit
their staffs/employees/ workers to stay.

h. The LANDLORD shall provide space for storage of sand and for fabrication of
required things for construction at site.

i. Any work done more and above the agreed drawing annexed along with this
agreement and mentioned in the specifications in Schedule-B shall be treated as
additional work and the LANDLORD shall pay extra cost to the BUILDER for
the extra work.
j. The BUILDER shall give one Year warranty against Structural flaws and Material Quality

VIII. DUTIES OF BUILDER.

a. The BUILDER shall take all necessary steps and shall avoid disturbance to the
neighbors.

b. The BUILDER shall not use the construction premises for any illegal purpose.

c. The BUILDER shall pay all the wages and salaries and salaries payable to their
employees or workers or staffs employed in the construction at Schedule-A premises.

d. The LANDLORD is in no way responsible or liable to pay salary, any arrears of


salary or wages to workers or employees of the BUILDER employed at schedule- A
premises.

e. The BUILDER shall take care of all the materials stored in the site and the LAND
LORD shall not be responsible for any loss of materials stored in the site.

f. The BUILDER shall not employ any child labour in the site or for the construction.

f. The BUILDER shall indemnify the LANDLORD against all wages, salary cases if
filed by the workers or employees or staffs.

h. The BUILDER shall follow the statutory requirements while employing the workers.

IX. Arbitration

In the event of any dispute of differences arising between the parties relating to their respective
rights and obligations under this contract or the work executed there under,
whether during the continuance of the contract or after its termination, the same shall
be referred to arbitration. The arbitral tribunal shall consist of three arbitrators, each
party herein namely “The BUILDER” and “The LANDLORD/OWNER” shall
appoint one arbitrator each and the charges/ expenses/ fee for the Arbitrators shall be
borne equally by the parties. The arbitration proceedings shall be governed by the
provisions of the Indian Arbitration & Conciliation Act, 1996 or any re-enactment or
statutory modifications thereof for the time being in force. The venue of the
arbitration shall be at CHENNAI only.
SCHEDULE: B

DETAILED SPECIFICATIONS OF THE CONSTRUCTION BUILDING:

Specification of the proposed residence at Plot No.14, 3rd Main Road, Jothi Nagar
Annanur, Chennai- 600062.
Measurement as per agreed plan enclosed with the agreement

1. Ground floor - 1063.5 Sq. ft


2. First floor - 1398 Sq. ft
3. Over Head Tank Room - 45 Sq. ft

Total = 2506.5 Sq. ft

1. STRUCTURE:

(a) RCC Framed Structure, all around Brick Plastered and Finished with Cement, paint internally
and externally.

(b) RCC Column will be with the Column Box only.

(c) All Excavation, Column, beam size, Footing size and depth, Slab, Sill and Lintel concrete
thickness, RCC work and Cement mix ratio will be carried out as per the structural drawings
provided by the licensed structural engineer.

(d) Basement Level up to 3’-00” feet height from the adjacent road near the site

(e) Roof slab height including slab thickness 10’-00” feet at respective floors.

(f) All outer wall shall be double brick work in 0’-9” inch.

(g) All inner walls shall be single brick work in 0’-4.5” inch.

(h) Final Measurement will be overall Roof measurement at each floor respectively
(i) Staircase SS railing will be of Builder’s choice.

(j) Single way water service line will be provided, additional water way line will be charged extra.

(k) One Wash basin will be provided only for the dining

(l) One Loft and Cupboard of size 7’0’’x4’0’’ with cuddapah stone will be provided each at
Kitchen & Bedrooms respectively.

(m) All MS grill work will be of Builder’s choice

(n) Compound Wall will be of 5’-0’’ feet height with column of size 9’’x9’’ at an interval of 10’-0’’
feet, Plinth beam of size 9’’x9’’ connecting all the columns, 4.5’’ brick work with both side
plastering and finished with one coat of white cement and two coats of Asian ACE.

Anything more and above constructed by the Builder beside the specification mentioned in the
SCHEDULE B on the request of the Landlord/Owner beside the agreed plan enclosed with the
agreement shall be borne by the Landlord/Owner separately to the Builder.

2. KITCHEN:

(a) Cooking Platform 2’ 0” wide granite slab with SS sink as per the Kitchen Layout.

(b) Providing Taps and drains for the Sink.

(c) Glazed tiles fixing up to 2’ – 0” height over the kitchen working table.

(d) Kitchen slab will be Granite with a R.C.C. slab at the bottom approved by the
LANDLORD/Owner.

(e) Kitchen Granite maximum of Rs.75/Sq. Ft.

3. TOILET:

(a) Toilet Wall tile will be glazed Ceramic tile up to 7’-0’’ feet height from Floor level maximum of
Rs.35 per square feet.
(b) Floor Tile will be Anti-skid tile maximum of Rs.35 Per Square feet.

(c) All Taps, shower and wall mixtures will be C.P. finish – make of Parryware of Jade Model.

(d) All Sanitary fittings will be of Parryware IWC/ EWC with seat cover, flush tank etc., including
health faucet maximum of Rs. 6000/ piece only.

(e) All Concealed plumbing Line will be of CPVC Pipes and all exterior plumbing lines will be of
PVC pipes of reputed make.

4. FLOORING:

(a) Flooring of Vitrified tile for Kitchen, Hall, Bedroom etc. Price maximum of Rs.55/ Sq. Ft..

(b) Granite/ Marble for Staircase price range of Rs.75/ Sq. Ft.

(c) Service, Balcony and car Parking tiles of Rs. 35/ Sq. Ft..

5. ELECTRICAL:

(a) Wiring will be in concealed PVC conduits with copper wires and switches – Make of Orbit and
Anchor switches respectively with metal boxes and DB box at each floor.

(b) Electrical points will be provided as per electrical layout.

(c) CCTv, DTH, Telephone, Inverter, Speaker cabling will be LANDLORD / Owner’s scope.

6. JOINERIES:

(a) Main doors: Teak wood door frame of size 5’’x3’’ and Teak wood door of size 3’6’’x7’0’’ with
all necessary brass fittings and ordinary handles and lock will be provided with Polish.

(b) Other Doors: Teak-II/ Padak wood doors frame of size 4’’x 2 ½’’and flush doors/Skin doors of
size 3’0’’x7’0’’with all necessary fittings in stainless steel.

(c) All windows will be of 4’0’’x 4’0’’ of Teak-II/ Padak frame of glass shutters with paint finish.

(d) Toilet doors Water proof flush doors.


(e) Windows shutters will be 3” x 1 ½” frame and 4mm frosted/plain glass fixed.

(f) Louvered Ventilators provided only for bathroom

(g) Brass Fittings and Lock only for Main door for other doors aldrop will be provided

(h) Pooja room Doors will be LANDLORD/ Owner’s scope.

7. PAINTING:

(a) French polish for main doors.

(b) Doors and Windows Will be given three Coats of painting one primmer and two Coats of
enamel paint – Asian paint.

(c) All interior wall and ceiling will be given three coats of painting two coat putty, one coat primer
and two coats of emulsion –Asian Paints Premium emulsion, Putty will be of JK White putty.

(d) All exterior wall will be given one coat white cement and two coats of Asian paints ACE.

(e) All grills will be given three coats one red Oxide coats and two coats Paint of Asian Enamel.

8. MATERIAL USED:

(A) Cement : Bricks & roof 53 Grade only (RAMCO)


(B) Plastering : 43 Grade (DECCAN)
(C) Steel : TMT Fe500 Grade only (ARS / Eql)
(D) Electrical : Orbit Wires, Anchor switches, DB, MCB & Isolator Standard
(E) Sanitary : Closets Parryware, all CP fittings Parryware
(F) Bricks : Best quality.
(G) Sand : M sand only

9. NOTE:

(a) Metro Water, Borewell & Borewell piping, Drainage & E.B, E.B Main Panel Board, Electrical
Earthing, Soak Pit, Rainwater Harvesting shall be under the scope of the LANDLORD/Owner.
(b) Additional Works if any, Lan d Lord/Owner have to pay the amount Separately to the Builder.
10. EXTRA WORK:

(a) Sump : Rs.25/ litre including material


(b) Main Gate : Calculated by weight & design
(c) Safety Gate : Calculated by Weight & design
(d) Water Tank : Rs.35/litre for RCC Tank
(e) Weathering course : Rs. 150/ Sq. Ft.
(f) Compound wall : Rs.1650/Rft.
(g) French window : As per Design
(h) Elevation : As per Design
(i) Glass : As per requirement and place of installation
(j) Septic tank : Rs. 15/ litre
