SUBJECT: Grant of 2021 Collective Negotiation Agreement (CNA) Cash Incentive


per Article VIII, Section 2 (a) of the signed CNA between the
Department of Health and the National DOH Employees Association
(NADEA)

I. RATIONALE

The Public Sector Labor Management Council (PSLMC) which was mandated by
Executive Order No. 180 to govern all Public Sector Unions (PSU) issued Resolution No. 04,
series of 2002 which states that:

“x—x—x in recognition of the joint efforts of the association and the


management to achieve all planned targets, programs and services approved in the
budget of the agency at a lesser cost; the National Government Agencies, State
universities/Colleges and Local Government units can provide CNA incentives to those
who have contributed either in productivity or cost savings .... x —x—x"

The provision of CNA incentives was reinforced under Item 4(h)(ii)(aa) of the Congress
Joint Resolution (JR) No. 4, dated June 17, 2009 which states that:

“(aa) Collective Negotiation Agreement (CNA) — This may be granted to both


management and rank-and-file employees of agencies with approved and successfully
implemented CNAs in recognition of their efforts in accomplishing performance targets
at lesser cost, in attaining more efficient and viable operations through cost cutting
measures and systems improvement xxx."

This Fiscal Year (FY) 2021, the General Appropriations Act (GAA) specifically under
Section 73 of the General Provisions provides the rules in the grant of CNA Incentive, to wit:

“Sec. 73. Rules in the Grant of Collective Negotiation Agreement Incentive.


Departments, bureaus, and offices of the National Government, including Constitutional
Offices enjoying fiscal autonomy and SUCs may grant collective negotiation agreement
(CNA) Incentive sourced from the allowable MOOE allotments identified by the DBM,
subject to the following:

(@) There is a valid CNA executed between the agency and the recognized
employee organization which includes a provision on cost-cutting measures
to be undertaken collectively by the agency and its personnel;

(b) The one-time annual payment of CNA Incentive shall be made through a
written resolution signed by the agency representatives from both labor and
management, and approved by the agency head;

(c) The CNA Incentive that may be granted shall be limited to the amount
determined by the DBM; and

(d) The use of MOOE for the payment of CNA Incentive shall be subject to
approval by the agency head and made only during the validity of
appropriations. Any excess amounts therefrom after payment of the CNA
Incentive shall revert to the General Fund.”

Corollary to the above, the Department of Budget and Management (DBM) issued
Budget Circular No. 2021 -3 dated 17, November 2021 with the subject: “Guidelines on the
Grant of Collective Negotiation Agreement (CNA) Incentive for FY 2021".

In compliance thereto, the Department of Health (DOH) and the National DOH
Employees Association (NADEA) as the national umbrella organization of DOH’s
employees’ organization/association and the accredited Sole and Exclusive Negotiating Agent
(SENA) by the Civil Service Commission (CSC) entered into a Collective Negotiation
Agreement (CNA) for Calendar Year (CY) 2021-2024 on July 14, 2021.

II. OBJECTIVE

This Order aims to prescribe guidelines on the grant of CNA Incentive for FY 2021,
pursuant to laws, resolutions and executive issuances.

III. SCOPE

This Order shall apply to the following officials and personnel occupying regular,
contractual, or casual positions whose salaries are charged against Personnel Services,
rendering services on full-time or part-time basis in the DOH Central Office, Centers for
Health Development, Retained and Specialty Hospitals, Sanitaria, Treatment and
Rehabilitation Centers, and Attached Agencies:

a. Rank-and-file employees who are members of an employees’ organization


accredited by the CSC as the sole and exclusive negotiating agent (herein after
referred to as “negotiating agent”) in accordance with the rules and regulations
issued by the PSLMC;

b. Rank-and-file employees who are non-members of the CSC-accredited sole and


exclusive negotiating agent but want to enjoy or accept benefits under the CNA,
subject to payment of agency fee to the negotiating agent in accordance with
PSLMC Resolution No. 1, s. 1993; and

c. Those who performed managerial functions.

IV. DEFINITION OF TERMS

A. Accredited Employees’ Organization — refers to a registered organization of rank-and-file


employees which has been recognized and certified by the Civil Service Commission as
the sole and exclusive collective negotiating agent.

B. Agency Fee — refers to a reasonable assessment equivalent to the dues and other fees paid
by the members of the sole and exclusive collective negotiating agent deducted from non-
employees’ organization members who benefited from the terms of the collective
negotiation agreement.

C. Collective Negotiation Agreement (CNA) — refers to the negotiated contract between an


accredited employees’ organization representing a negotiating unit and the
employer/management concerning terms and conditions of employment, and
improvements thereof that are not fixed by law.

CNA Incentives — refer to the promotion and enhancement of the employees’ welfare,
productivity and contributing to economy, effectiveness and efficiency in the delivery of
health services. This is in recognition of the harmonious relationship and cooperation
between the MANAGEMENT and the ASSOCIATION. The following are the forms of
CNA Incentives:

1. Monetary Incentive — a yearly cash incentive granted to employees, derived from


savings of successfully implemented cost cutting measures of respective member
unions, and

2. Non-Monetary Incentive — incentive given to employees, such as improvement of

working conditions and other programs that will redound to employees’ welfare,
productivity, and health”

DOH Human Resource for Health (HRH) Deployment Program - refers to the strategy of
the national government to redistribute health workers to address inadequacy of health
workers in priority areas in order to provide quality health services for marginalized,
vulnerable and disadvantaged populations of the country and complement the local
government health workforce.

Employees’ Organization — refers to any organization, union or association of employees


in agencies of the national government and their regional offices, attached agencies and
their regional offices, state universities and colleges, government-owned and controlled
corporations with original charters, and local government units, which exists in whole or
in part for the purpose of collective negotiations or for mutual aid, interest, cooperation
and protection.

Sole and Exclusive Negotiating Agent — refers to any registered employees’


organization/association which has been accredited by the CSC to act as negotiating
agent in behalf of all the rank-and-file employees in a negotiating unit.

Negotiating Unit — refers to the constitutional bodies and their regional offices; the
executive department including services and staff bureaus and regional offices; line
bureaus and their regional offices; attached agencies; the legislature; the judiciary; state
universities and colleges; government-owned or controlled corporations with original
charters; and, provinces, cities and municipalities.

Rank-and-file employee — refers to employees holding level 1 to 5 positions (Division


Chief) pursuant to PSLMC Resolution No. 1 s, 1991 and No. 2 s, 1993.

GENERAL GUIDELINES

A. DBM Budget Circular No. 2021-3 with the subject: Guidelines on the Grant of
Collective Negotiation Agreement (CNA) Incentive for FY 2021, dated November
17, 2021 shall be applied suppletorily;

B. Conditions for the Grant of CNA Incentive

1. Existence of a CNA

a. There should be a valid and subsisting CNA executed between the


representatives of the management and the employees’ organization accredited
by the CSC as the sole and exclusive negotiating agent for the purpose of
collective negotiations with the management of the DOH.

The registration of the employees’ organization of its respective CNA with the
CSC is not a condition precedent for the grant of the CNA Incentive.

b. The grant of the CNA Incentive must be stipulated in the CNA or in


supplements thereof.

2. Accomplishment of Targets
a. The DOH should have accomplished, by September 30, 2021, at least an average
of 70% of all the targets for all the organizational outcomes/performance
indicators under the FY 2021 budget approved by Congress, or the approved FY
2021 Corporate Operating Budget (COB), whichever is applicable.
b. The Agency should have submitted to DBM their respective accountability
reports as of September 30, 2021 pursuant to Commission on Audit (COA) —
Department of Budget and Management (DBM) Joint Circular No. 2014-1 dated
July 2, 2014, as amended by COA-DBM JC No. 2019-1 dated January 1, 2019.

3. Rate of CNA Incentive


a. The rate of CNA Incentive shall not be pre-determined in the CNA since
it is
subject to compliance with the conditions stipulated above and the availability of
the allowable allotments.

b. The CNA Incentive may be given equally to all qualified employees or at


varying rates in consideration of the employee’s or his/her office’s
contribution to the accomplishment of performance targets, efficiency,
productivity, or profitability, as determined by the agency head upon
recommendation of the Management-Union Consultative Council (MUCC).

c. In all cases, the CNA Incentive shall not exceed Twenty-Five Thousand Pesos
(P25,000) per qualified employee.

d. This incentive shall not cover those employees paid on piecework basis and
employees receiving salaries from foreign sourced/funded projects.

4. Fund Sources of the CNA Incentive

a. The CNA Incentive shall be sourced solely from the available balances of
allowable Maintenance and Other Operating Expenses (MOOE) allotments after
considering the FY 2021 requirements, provided further that the same have
become available as a result of a cost-cutting and systems improvement
measures undertaken collectively by the agency and its personnel, as identified
in their respective CNA and supplements thereof.
Such fund sources shall be limited to the following MOOE items defined under the
Government Accounting and Auditing Manual:

i. Communication Expenses;

ii. Repairs and Maintenance;
if. Supplies and Materials Expenses;
iv. Transportation and Delivery Expenses;
v. Traveling Expenses; and
vi. Utility Expenses.

b. The following shall, in no case, be used as fund source of the CNA Incentive:

i. Balances of allotment for programs/activities/projects which were later


discontinued or deferred; and
ii. Released allotments intended for acquisition of goods and services to be
distributed/delivered to, or to be used by agency clients.

c. Items under the Personnel Services, other MOOE, and/or Capital Outlay shall
not be used to increase the allowable MOOE items as fund source for the FY
2021 CNA Incentive.

5. Payment of the CNA Incentive

a. The CNA Incentive for the year shall be a one-time benefit to be granted not
earlier than December 15, 2021.
b. The CNA Incentive for the year shall be granted only during the validity of
appropriations from which the available MOOE allotments shall be sourced.
c. The amount paid as CNA Incentive shall be recorded in the agency books under
the account code “Collective Negotiation Agreement Incentive-Civilian.”

SPECIFIC GUIDELINES

A. The payment of CNA Incentive shall be through a written resolution signed by agency
representatives from both labor and management, and approved by the agency head.

B. The Management-Union Consultative Council (MUCC) of each Operating Units under


the DOH shall determine if their agency is qualified for the grant of CNA Incentive based
on compliance with the requirements under DBM National Budget Circular No. 2021-3
dated November 17, 2021.

As provided in Section 73 of the General Provision of CY 2021 General Appropriations


Act, the payment of CNA Incentive shall be subject to the approval of the Head of
Agency or authorized representative (Regional Director, Executive Directors of Attached
Agencies/Specialty Hospitals, Chief of Hospital/TRCs and Bureau Director). Hence, the
agency head or authorized representative and the corresponding accountable officers shall
be responsible for the proper implementation of CNA and they shall be held
administratively, civilly, and/or criminally liable, as the case may be, for any payment of
the CNA Incentive not in accordance with the provision of the said Act.

If qualified, the Council shall review the agency’s financial records and submit
recommendations on the following matters, through a written resolution, for approval by
the agency head:

1. The total amount of allowable MOOE allotments which has become available as a
result of a cost-cutting and systems improvement measures identified in the CNA
and supplements thereof, and which was the result of the joint efforts of management
and employees;

2. The internal guidelines to be followed in the grant of the CNA Incentives, such as (i)
specific criteria for determining who are entitled; and (ii) the distribution of the
amount available and the rate of the CNA Incentive;

3. The payment of the CNA Incentive shall be made only during the validity of
appropriations. Any excess amount from the allowable MOOE allotments after
payment of the CNA Incentive shall revert to the General Fund.

C. The CNA cash incentives shall be based on actual services rendered from January 1, 2021
to September 30, 2021 on a pro-rated scheme as follows:

D. Qualified part-time employees shall receive 50% of the CNA Cash Incentive from their
respective mother unit.

E. DOH personnel detailed/reassigned (e.g. on concurrent capacity, officer-in-charge, etc.)


at the Central Office and Central Office personnel detailed/reassigned (e.g. on concurrent
capacity, officer-in-charge, etc.) to other DOH health facilities shall receive their CNA
cash incentive from their respective mother unit.

F. CNA Incentive of Human Resources for Health (HRH) personnel under the DOH
Deployment Program may be given chargeable to their respective Centers for Health
Development subject to the availability of savings intended for CNA Incentive; provided
that all the rank and file employees shall be given the maximum amount of allowable
CNA Cash Incentive.

G. The list of Employees’ Organization/Association covered and identified in the CNA


between DOH and NADEA for CY 2021-2024 shall be attached as Annex A.

H. Article VI, Section 2 of 2021-2024 CNA is providing a fifteen percent (15%) assessment
fee, also known as “Agency Fee”, charged against non-members of the recognized
Employees Organization/Association in consonance with PSLMC Resolution No. 1, s.
1993.

I. Agency shall submit via online to the DBM's Budget and Management Bureau or
Regional Office concerned not later than January 31, 2022, the annual report on the grant
of the CNA Incentive by following the Annex A template prescribed by the Item 6.0 of
DBM Budget Circular No. 2021-3.

The Agency shall encode the required details/information, as well as upload the scanned
copy of the report using the following link https://www.dbm.qov.ph/add-cna-report.

VII. SEPARABILITY CLAUSE

Any provision or part of this Order which shall be declared unauthorized or rendered
invalid by the court or tribunal or any competent authority shall not affect provisions herein
outside the scope of such declaration

VIII. EFFECTIVITY CLAUSE

This Order shall take effect immediately.
