engage in this activity and they both agreed to work and
commit to this contract as follows:
2-1 Providing the second party with all available ، ﺗﺰوﻳﺪ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﺑﻜﺎﻣﻞ اﻟﻤﻌﻠﻮﻣﺎت اﻟﻤﺘﺎﺣﺔ ﻋﻦ ﺻﺎﺣﺐ اﻟﻌﻤﻞ1-2
information about the employer, including the وﻣﻨﻬﺎ ﻋﻨﻮان ﺻﺎﺣﺐ اﻟﻌﻤﻞ ورﻗﻢ اﻟﺠﻮال اﻟﺨﺎص ﺑﻪ ﻹﻣﻜﺎﻧﻴﺔ اﻟﺘﻮاﺻﻞ

2-2 Taking the Full responsibility for the information ﺗﺤﻤﻞ اﻟﻤﺴﺆوﻟﻴﺔ ﻛﺎﻣﻠﺔ ﺗﺠﺎه اﻟﻤﻌﻠﻮﻣﺎت اﻟﺘﻲ وﻓﺮﻫﺎ اﻟﻄﺮف2-2
provided to the Second Party in terms of specifications, اﻟﺜﺎﻧﻲ ﻣﻦ ﺣﻴﺚ ﻣﻮاﺻﻔﺎت اﻟﻌﺎﻣﻞ اﻟﻤﻨﺰﻟﻲ وأﺟﺮه اﻟﺸﻬﺮي وأﻳﺔ ﻣﻴﺰات
salary of the worker and any features or conditions, .أو ﺷﺮوط
which the Second Party has properly implemented.
2-3 Educating the employer about the rights and duties ﺗﻮﻋﻴﺔ ﺻﺎﺣﺐ اﻟﻌﻤﻞ ﺑﺤﻘﻮق وواﺟﺒﺎت اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ وﻓﻘﺎً ﻟﻤﺎ3-2
of the domestic worker according to the labor regulations .ورد ﻓﻲ اﻟﻠﻮاﺋﺢ واﻟﺘﻌﻠﻴﻤﺎت اﻟﺴﺎرﻳﺔ ﻓﻲ اﻟﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ
in the Kingdom of Saudi Arabia.
2-4 Providing the domestic worker with photocopies of ﺗﺰوﻳﺪ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﺑﺼﻮر اﻟﻤﺴﺘﻨﺪات اﻟﺨﺎﺻﺔ ﺑﻬﺎ واﻟﻤﺘﻮﻓﺮة4-2
their own documents which are available within the first . وﺗﻮﺟﻴﻬﻬﺎ ﻋﻨﺪﻣﺎ ﺗﻄﻠﺐ ﻣﻨﻪ اﻟﻤﺸﻮرة،ﻟﺪﻳﻪ ﻣﺘﻰ ﻃﻠﺒﺖ اﻟﻌﻤﺎﻟﺔ ذﻟﻚ
party whenever the domestic worker resorts to the first
party, as well as to assist in directing the worker when the
worker resorts to the first party consultation.
2-5 Following-up with the domestic workers who is ﻣﺘﺎﺑﻌﺔ ﺣﺼﻮل اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﻋﻠﻰ ﺣﻘﻮﻗﻬﺎ اﻟﻨﻈﺎﻣﻴﺔ ﻛﻤﺎ ﻫﻮ5-2
recruited through him/her to work in the Kingdom of وﺗﻘﺪﻳﻢ ﺗﻘﺮﻳﺮ،ﻣﻨﺼﻮص ﻓﻲ اﻟﻌﻘﺪ اﻟﻤﻮﻗﻊ ﺑﻴﻨﻬﺎ وﺑﻴﻦ ﺻﺎﺣﺐ اﻟﻌﻤﻞ
Saudi Arabia in order to assure receiving his/her rights as ﻟﻠﻄﺮف اﻟﺜﺎﻧﻲ ﺣﺎل ﻧﺸﻮء ﻧﺰاع ﻳﺘﻌﻠﻖ ﺑﺈﺧﻼل ﺻﺎﺣﺐ اﻟﻌﻤﻞ ﺑﺤﻘﻮق ﺗﻠﻚ
stated in the contract signed between the employer and .اﻟﻌﻤﺎﻟﺔ وﻣﺒﺎﺷﺮﺗﻪ ﻣﻦ ﻗﺒﻞ اﻟﺠﻬﺎت اﻟﻤﺨﺘﺼﺔ

the domestic workers by the employer and that case is
transferred to The concerned authorities to be resolved.

The first party shall provide a report on the case status
and progress to the second party.
2-6 To provide emergency residency solutions for the أن ﻳﻮﻓﺮ ﺣﻠﻮل إﻗﺎﻣﺔ ﻃﺎرﺋﺔ ﻟﻠﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ اﻟﺘﻲ ﺗﻮاﺟﻪ ﻣﺸﺎﻛﻞ6-2
domestic worker who has problems in obtaining ﻓﻲ اﻟﺤﺼﻮل ﻋﻠﻰ ﻣﺄوى ﻛﺎﻟــ )ﻋﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ اﻟﺘﻲ وﺻﻠﺖ ﻟﺘﻮﻫﺎ
accommodation (such as the worker who has just arrived اﻟﻌﻤﺎﻟﺔ اﻟﺘﻲ،ﻟﻠﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ أو ﻋﻠﻰ وﺷﻚ اﻟﺨﺮوج ﻣﻨﻬﺎ
to the Kingdom of Saudi Arabia, the workers who are on ﻓﻲ ﻃﻮر إﺟﺮاء ﻧﻘﻞ ﺧﺪﻣﺎﺗﻬﺎ إﻟﻰ ﺻﺎﺣﺐ ﻋﻤﻞ آﺧﺮ( أو ﺑﻄﻠﺐ

2-7 following-up and communicating with the Employer اﻟﺘﻮاﺻﻞ ﻣﻊ ﺻﺎﺣﺐ اﻟﻌﻤﻞ ﺑﺸﺄن اﻻﺳﺘﻔﺴﺎر وﻣﺘﺎﺑﻌﺔ ﺣﺎﻻت7-2
of the domestic worker that is recruited through the first اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﻋﻨﺪ ﻃﻠﺐ اﻟﻤﺴﺎﻋﺪة ﻣﻦ اﻟﻄﺮف اﻟﺜﺎﻧﻲ أو ذوي

relatives of the worker.
2-8 Receiving and ensuring the arrival of the domestic . اﺳﺘﻘﺒﺎل اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ وﺿﻤﺎن وﺻﻮﻟﻬﻢ إﻟﻰ ﺻﺎﺣﺐ اﻟﻌﻤﻞ8-2
worker to the employers.
3-1 Sending the workers to the Kingdom of Saudi Arabia ﻣﻦ ﺗﺎرﻳﺦ ﻗﺒﻮﻟﻪ ﻟﻌﻘﺪ90 إرﺳﺎل اﻟﻌﻤﺎﻟﺔ إﻟﻰ اﻟﻤﻤﻠﻜﺔ ﺧﻼل ﻣﺪة1-3
within a maximum of 90 days from the date of اﻟﺘﻮﻇﻴﻒ اﻟﻤﺮﺳﻞ ﻣﻦ اﻟﻄﺮف اﻷول
acceptance by the second party of the employment
contract sent by the first party.
3-2 The second party shall guarantee the domestic ﻳﻀﻤﻦ اﻟﻄﺮف اﻟﺜﺎﻧﻲ اﻟﻌﻤﺎﻟﺔ اﻟﻤﺮﺳﻠﺔ ﻣﻦ ﺧﻼﻟﻪ ﻟﻠﻄﺮف اﻷول2-3
workers sent to the first party for 90 Days from the date ﻣﺎ، ﻳﻮم ﻣﻦ ﺗﺎرﻳﺦ وﺻﻮﻟﻬﻢ إﻟﻰ اﻟﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ90 ﻟﻤﺪة
of their arrival to the Kingdom of Saudi Arabia, Unless .ﻟﻢ ﺗﻘﺾ اﻻﺗﻔﺎﻗﻴﺎت اﻟﺜﻨﺎﺋﻴﺔ اﻟﻤﻮﻗﻌﺔ ﺑﻴﻦ اﻟﺒﻠﺪﻳﻦ ﺧﻼف ذﻟﻚ
the bilateral agreements signed between the two
countries stipulate otherwise.
3-3 Any irregularities caused by the employer and have ﻳﺴﺘﺜﻨﻰ ﻣﻦ اﻟﻀﻤﺎن أي ﻣﺨﺎﻟﻔﺎت ﺻﺎدرة ﻣﻦ ﻗﺒﻞ ﺻﺎﺣﺐ اﻟﻌﻤﻞ3-3
sentence that is issued by the concerned authority shall .وﻳﺼﺪر ﻓﻴﻬﺎ ﻗﺮار ﻣﻦ اﻟﺠﻬﺔ اﻟﻤﻌﻨﻴﺔ
be excluded from the guaranty.
3-4 The second party undertakes the responsibilities to اﻟﺤﺼﻮل ﻋﻠﻰ ﺗﺼﺪﻳﻖ اﻟﺴﻔﺎرة اﻟﺴﻌﻮدﻳﺔ ﻋﻨﺪ إﻧﻬﺎء ﻛﺎﻓﺔ4-3
finalize all governmental procedures for the domestic وإﺟﺮاء،اﻹﺟﺮاءات اﻟﺤﻜﻮﻣﻴﺔ واﻷﻣﻨﻴﺔ اﻟﻼزﻣﺔ ﻓﻲ ﺑﻠﺪ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ
worker in his/her country and all the medical, ﺑﺎﻹﺿﺎﻓﺔ إﻟﻰ ﺗﺤﻤﻠﻪ اﻟﻤﺴﺆوﻟﻴﺔ اﻟﻜﺎﻣﻠﺔ،اﻟﻔﺤﻮﺻﺎت اﻟﻄﺒﻴﺔ واﻟﻨﻔﺴﻴﺔ
psychological and security procedures and clearances :ﺗﺠﺎه ﻣﺎ ﻳﺘﺮﺗﺐ ﻋﻠﻰ ﻣﺨﺎﻟﻔﺔ اﻵﺗﻲ
necessary for the worker with the approval of the Saudi
Embassy to ensure the following:
1. The second party commit that the domestic worker أن ﺗﻜﻮن اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﻓﻲ ﺣﺎﻟﺔ ﺻﺤﻴﺔ ﺳﻠﻴﻤﺔ ﺧﺎﻟﻴﺔ ﻣﻦ.1
shall be in a healthy state and free of physical وﻣﻦ اﻷﻣﺮاض اﻟﻤﻌﺪﻳﺔ واﻟﻤﺰﻣﻨﺔ واﻟﻨﻔﺴﻴﺔ،اﻟﻌﺎﻫﺎت اﻟﺠﺴﻤﻴﺔ
disabilities, infectious, chronic, psychological, واﻟﻌﻘﻠﻴﺔ واﻟﻌﺼﺒﻴﺔ وﻛﻞ اﻷﻣﺮاض اﻟﺘﻲ ﻻ ﺗﻤﻜﻨﻬﺎ ﻣﻦ أداء

for recruitment by name from the first party to the اﻟﺜﺎﻧﻲ ﻓﺈن اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﻻ ﻳﺘﺤﻤﻞ أي ﻣﺴﺆوﻟﻴﺔ ﺗﺠﺎه ﺣﻘﻴﻘﺔ إﺟﺎدة

for the validity of the profession or the refusal of the ب( وﻋﺪا ذﻟﻚ ﻓﺈﻧﻪ ﻻ,ﻟﻜﻞ ﻣﻦ اﻟﻨﻘﻄﺔ )أ
ٍ (4-3) ( ﻓﻲ اﻟﻔﻘﺮة4) ﻓﻲ ﺑﻨﺪ

second party assume no other responsibility.
3-6 The Second Party shall provide the First Party with a ﺗﺰوﻳﺪ اﻟﻄﺮف اﻷول ﺑﻤﻠﻒ ﻳﺤﺘﻮي ﻋﻠﻰ ﺻﻮر ﻣﻦ ﻛﺎﻣﻞ6-3
complete file containing copies of all documents related اﻟﻤﻌﻠﻮﻣﺎت واﻟﻤﺴﺘﻨﺪات اﻟﻤﺘﻌﻠﻘﺔ ﺑﺎﻟﻌﺎﻣﻞ أو اﻟﻌﺎﻣﻠﺔ اﻟﻤﻨﺰﻟﻴﺔ ﺑﻤﺎ
to the work, including a copy of the passport including ﻓﻲ ذﻟﻚ ﺻﻮرة ﺟﻮاز اﻟﺴﻔﺮ ﻣﺘﻀﻤﻨﺎً ﺗﺄﺷﻴﺮة اﻟﻌﻤﻞ وﻛﺬﻟﻚ اﻟﺘﻘﺎرﻳﺮ
the work visa, medical and psychological reports, chest ﻣﺴﺆوﻻ ﻣﺴﺆوﻟﻴﺔ
ً وﻳﻜﻮن، وﻋﻘﺪ اﻟﻌﻤﻞ اﻟﻤﻮﻗﻊ،اﻟﻄﺒﻴﺔ اﻟﻼزﻣﺔ
radiographs and the work contract after the domestic .ﻣﺒﺎﺷﺮة ﻋﻦ ﺻﺤﺔ ﺗﻠﻚ اﻟﻤﻌﻠﻮﻣﺎت واﻟﻤﺴﺘﻨﺪات
worker signed it in electronic or physical.
3-7 Ensuring the opportunity for the first party or his /her إﺗﺎﺣﺔ اﻟﻔﺮﺻﺔ ﻟﻠﻄﺮف اﻷول أو ﻣﻦ ﻳﻤﺜﻠﻪ ﻟﻤﻘﺎﺑﻠﺔ وﺗﺮﺷﻴﺢ واﺧﺘﻴﺎر7-3
representative to meet and nominate any of the domestic .أي ﻣﻦ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ اﻟﻤﻘﺪﻣﺔ إﻟﻴﻪ
workers provided by the second party and the option to
choose the suitable candidate.
3-8 Bear the cost of the flight ticket for domestic workers ﺗﺤﻤﻞ ﺗﻜﺎﻟﻴﻒ ﺗﺬﻛﺮة اﻟﻄﻴﺮان ﻟﻠﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ وﻣﺼﺎرﻳﻒ وﺻﻮﻟﻬﺎ8-3
and the expenses of arriving in the Kingdom of Saudi ﺑﺎﻹﺿﺎﻓﺔ إﻟﻰ ﻣﺴﺆوﻟﻴﺘﻪ اﻟﻤﺒﺎﺷﺮة،اﻟﻰ اﻟﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ
Arabia, in addition to his/her direct responsibility for ﻋﻦ ﻛﻞ ﻣﺎ ﻳﺘﺮﺗﺐ ﻋﻠﻰ ﻋﺪم إﺑﻼغ اﻟﻄﺮف اﻷول ﺑﺎﻟﻤﻌﻠﻮﻣﺎت اﻟﻮاﻓﻴﺔ
everything that results from not informing the first party اﺳﻢ اﻟﺸﺮﻛﺔ، اﻟﻮﻗﺖ، اﻟﺘﺎرﻳﺦ،واﻟﺤﻘﻴﻘﻴﺔ ﻋﻦ ﺧﻂ ﺳﻴﺮ اﻟﺮﺣﻠﺔ )اﻟﻴﻮم
with adequate and real information about the flight ﻣﺤﻄﺔ اﻟﻮﺻﻮل اﻟﻤﻄﻠﻮﺑﺔ( وأن ﻳﻜﻮن ذﻟﻚ اﻹﺑﻼغ، رﻗﻢ اﻟﺮﺣﻠﺔ،اﻟﻨﺎﻗﻠﺔ
itinerary (day, date, time, name of the carrier company, وأن ﻳﻮﺿﺢ ﻋﻠﻰ ورﻗﺔ ﻻﺻﻘﺔ ﻓﻲ ﻇﻬﺮ، ﺳﺎﻋﺔ72 ﻗﺒﻞ ﺗﺎرﻳﺦ اﻟﺴﻔﺮ ﺑـ
flight number, and the required arrival station.) and that ﺟﻮاز ﺳﻔﺮ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﻋﻨﻮان وأرﻗﺎم ﻫﻮاﺗﻒ ﻛﻞ ﻣﻦ ﺻﺎﺣﺐ

and that the address and phone numbers of both the
employer and the first party be indicated on a sticky
paper on the back of the domestic worker’s passport.
3-9 Providing the First Party with correct information and ﺗﺰوﻳﺪ اﻟﻄﺮف اﻷول ﺑﺎﻟﻤﻌﻠﻮﻣﺎت اﻟﺼﺤﻴﺤﺔ واﻟﺘﻘﺎرﻳﺮ اﻟﻤﻨﺘﻈﻤﺔ ﻋﻦ9-3
regular reports on the progress of the selection process وﻛﺬﻟﻚ ﻋﺪم اﻟﺘﺄﺧﻴﺮ،ﺳﻴﺮ ﻋﻤﻠﻴﺔ اﻻﺧﺘﻴﺎر واﻟﻤﺮاﺣﻞ اﻟﺘﻲ وﺻﻠﺖ إﻟﻴﻬﺎ
and the latest stages updates, and shall be provide a .ﻓﻲ اﻹﺟﺎﺑﺔ ﻋﻠﻰ اﺳﺘﻔﺴﺎرات اﻟﻄﺮف اﻷول
quick service in supporting for any inquiry from the First
Party from time to time without delay whenever
requested by the first party.
3-10 Take full responsibility for every entry visa that ﺗﺤﻤﻞ اﻟﻤﺴﺆوﻟﻴﺔ اﻟﻜﺎﻣﻠﺔ ﺗﺠﺎه ﻛﻞ ﺗﺄﺷﻴﺮة دﺧﻮل ﺗﺤﺼﻞ ﻋﻠﻴﻬﺎ10-3
domestic worker obtains from the Saudi embassy and اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﻣﻦ ﻗﺒﻞ اﻟﺴﻔﺎرة اﻟﺴﻌﻮدﻳﺔ وﻻ ﺗﺼﻞ إﻟﻰ اﻟﻤﻤﻠﻜﺔ
does not reach the Kingdom of Saudi Arabia. .اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ
3-11 Paying a fine equivalent to one hundred (100) Saudi ( رﻳﺎل ﺳﻌﻮدي ﻓﻘﻂ ﻋﻦ100) ﺗﺤﻤﻞ دﻓﻊ ﻏﺮاﻣﺔ ﻣﺎﻟﻴﺔ ﺗﻌﺎدل ﻣﺎﺋﺔ11-3
riyals only for each domestic worker in the event that ﻛﻞ ﻋﺎﻣﻞ أو ﻋﺎﻣﻠﺔ ﻣﻨﺰﻟﻴﺔ ﻓﻲ ﺣﺎل ﺗﺄﺧﺮ وﺻﻮﻟﻬﻢ اﻟﻰ اﻟﻤﻤﻠﻜﺔ ﻋﻦ
their arrival to the Kingdom is Delayed for the agreed وﻳﺘﻢ اﺣﺘﺴﺎﺑﻬﺎ ﻣﻦ اﻟﺘﺎرﻳﺦ،اﻟﻤﺪة اﻟﻤﺘﻔﻖ ﻋﻠﻴﻬﺎ ﻷﺳﺒﺎب راﺟﻌﺔ إﻟﻴﻪ
period for reasons within the second party control, and it ﻋﻠﻰ أﻻ ﻳﺰﻳﺪ،اﻟﻤﺘﻔﻖ ﻋﻠﻴﻪ ﻟﻠﻮﺻﻮل وﺣﺘﻰ ﺗﺎرﻳﺦ اﻟﻮﺻﻮل اﻟﻔﻌﻠﻲ
is calculated from the agreed date of arrival until the وﻳﺘﻢ ﺧﺼﻤﻬﺎ ﺗﻠﻘﺎﺋﻴﺎ ﻣﻦ،(اﻟﻤﺒﻠﻎ ﻋﻤﺎ ﻳﻌﺎدل )ﺛﻼﺛﺔ آﻻف رﻳﺎل ﺳﻌﻮدي
date of actual arrival, provided that the amount does not .ﻣﺴﺘﺤﻘﺎﺗﻪ ﻟﺪى اﻟﻄﺮف اﻷول ﺧﻠﻞ ﺛﻼﺛﺔ أﺷﻬﺮ ﻣﻦ ﺗﺎرﻳﺦ اﻻﺳﺘﺤﻘﺎق

riyals), and it is automatically deducted from the second
party dues with the first party within 3 months from the
date of maturity.
3-12 Providing a return ticket for the domestic worker if ﺗﺄﻣﻴﻦ ﺗﺬﻛﺮة ﻃﻴﺮان ﻋﻮدة اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﻓﻲ ﺣﺎل ﺗﺮﻛﻬﺎ ﻟﻠﻌﻤﻞ12-3
he / she resigns within the agreed guaranty period as per ( ﻟﺴﺒﺐ ﻏﻴﺮ راﺟﻊ2-3) ﺧﻠﻞ ﻓﺘﺮة اﻟﻀﻤﺎن اﻟﻤﺘﻔﻖ ﻋﻠﻴﻬﺎ ﻓﻲ اﻟﻔﻘﺮة
Paragraph (3-2) due to a reason not caused by the .ﻟﺼﺎﺣﺐ اﻟﻌﻤﻞ
Employer.
3-13 The second party shall be committed to raise ﺗﻘﺪﻳﻢ ﻣﻌﻠﻮﻣﺎت ﺑﻠﻐﺔ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ )ﺑﺮوﺷﻮرات أو أي وﺳﻴﻠﺔ13-3
awareness of the domestic workers to be working in أﺧﺮى ﻣﻨﺎﺳﺒﺔ( ﻋﻦ اﻷﻧﻈﻤﺔ واﻟﺘﻌﻠﻴﻤﺎت وأﺣﻜﺎم اﻟﺸﺮﻳﻌﺔ اﻹﺳﻼﻣﻴﺔ

instructions and living and climatic conditions through وﻋﻦ اﻟﻌﺮض اﻟﻤﻘﺪم ﻣﻦ ﺻﺎﺣﺐ اﻟﻌﻤﻞ ﻓﻴﻤﺎ،اﻟﺤﻴﺎة ﻓﻴﻬﺎ ﺑﺸﻜﻞ ﻋﺎم
educational tools (such as but not limited to, brochures, وأن ﻳﺘﺄﻛﺪ ﻣﻦ رﻏﺒﺘﻪ،ﻳﺘﻌﻠﻖ ﺑﺎﻷﺟﺮ اﻟﺸﻬﺮي واﻟﻤﺰاﻳﺎ اﻷﺧﺮى إن وﺟﺪت
leaflets), in the domestic worker's language, and the .ﻓﻲ اﻟﻌﻤﻞ ﻓﻲ اﻟﻤﻤﻠﻜﺔ ﻃﻮال ﻣﺪة اﻟﻌﻘﺪ
employer's offer of salary and benefits if any. Work in
Saudi Arabia for the duration of the contract.
3-14 The second party shall be responsible for the ﻣﺴﺆوﻻ ﻋﻦ اﻟﻌﻤﺎﻟﺔ اﻟﺬﻳﻦ ﺗﻢ ﺗﺮﺷﻴﺤﻬﻢ ﻣﻦ ﻗﺒﻠﻪ ﻟﻠﻄﺮف

domestic workers nominated by him/her to the first party ( وﺗﺒﺪأ ﻣﻦ3) ( ﻓﻲ اﻟﺒﻨﺪ2-3) اﻷول وﻓﻘﺎً ﻟﻠﻤﺪة اﻟﻤﺬﻛﻮرة ﻓﻲ اﻟﻔﻘﺮة
in accordance with the period mentioned in paragraph وذﻟﻚ ﻓﻲ اﻟﺤﺎﻻت،ﺗﺎرﻳﺦ وﺻﻮل اﻟﻌﻤﺎﻟﺔ ﻟﻠﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ
(1.1) in Article (1) and starting from the date of arrival of :اﻟﺘﺎﻟﻴﺔ
the domestic worker to Saudi Arabia, as per the following
cases:
1. The domestic worker who runs away or refused to ﺗﺮك أو اﻣﺘﻨﺎع اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﻋﻦ أداء اﻟﻌﻤﻞ ﻷﺳﺒﺎب ﻻ ﺗﻌﻮد.1
work for reasons not caused by the employer and . وﻳﺜﺒﺖ ذﻟﻚ ﺑﻘﺮار ﻣﻦ اﻟﺠﻬﺔ اﻟﻤﻌﻨﻴﺔ،ﻟﺼﺎﺣﺐ اﻟﻌﻤﻞ
shall be proved by a decision or official document
وﻓﻘﺎ ﻟﻌﻘﺪ اﻟﻌﻤﻞ
ً ﻋﺪم اﻟﺘﺰام اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﺑﺘﻨﻔﻴﺬ ﻣﻬﻤﺎﺗﻬﺎ؛.2
from the Labor Committee or the Ministry of Human
.اﻟﻤﺒﺮم ﻣﻌﻪ وﻳﺜﺒﺖ ذﻟﻚ ﺑﻘﺮار ﻳﺼﺪر ﻣﻦ اﻟﺠﻬﺔ اﻟﻤﻌﻨﻴﺔ
resources and Social Development.
ﻋﺪم ﺗﻮﻓﺮ اﻟﺨﺒﺮة اﻟﻤﻄﻠﻮﺑﺔ ﻓﻲ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ؛ وﻓﻘﺎً ﻟﻤﺎ ﺣﺪده.3
2. The domestic worker to not perform and carry out
.ﺻﺎﺣﺐ اﻟﻌﻤﻞ ﻓﻲ ﻋﻘﺪ اﻟﻌﻤﻞ
his/her duties as per the employment contract that is
signed with him/her and this have to be proved and ، أو ﻣﺰﻣﻦ، ﺛﺒﻮت وﺟﻮد ﻣﺮض ﻣﻌﺪ ﺑﺎﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ اﻟﻤﺴﺘﻘﺪﻣﺔ.4
confirmed by a decision that is issued by the labor أو أي ﻣﺮض ﻻ ﻳﻤﻜﻨﻬﺎ ﻣﻦ أداء، أو ﻋﻘﻠﻴﺔ،أو ﻋﺎﻫﺔ ﺟﺴﻤﻴﺔ
committee or the Saudi Ministry of Human resources أو ﺛﺒﻮت ﻋﺪم ﺻﺤﺔ ﺗﻘﺎرﻳﺮ،ﻋﻤﻠﻬﺎ ﻗﺒﻞ ﻗﺪوﻣﻬﺎ ﻟﻠﻌﻤﻞ ﺑﺎﻟﻤﻤﻠﻜﺔ
and Social Development. . وﻳﺜﺒﺖ اﻟﻤﺮض ﺑﺘﻘﺮﻳﺮ ﻃﺒﻲ،اﻟﻔﺤﻮﺻﺎت اﻟﻄﺒﻴﺔ اﻟﺘﻲ أﺟﺮﻳﺖ ﻟﻬﺎ
3. Lack of experience that is required in the domestic ، )إذا ﻛﺎﻧﺖ اﻟﻤﺴﺘﻘﺪﻣﺔ أﻧﺜﻰ( وﺟﻮد ﺣﻤﻞ ﻗﺒﻞ دﺧﻮﻟﻬﺎ ﻟﻠﻤﻤﻠﻜﺔ.5

4. The presence of a contagious, chronic, and physical
or mental illness, or any disease that prevent the ﺛﺒﻮت ﻋﺪم ﺻﺤﺔ ﺗﻘﺎرﻳﺮ اﻟﻔﺤﺺ اﻷﻣﻨﻲ واﻟﺠﻨﺎﺋﻲ اﻟﺬي أﺟﺮي ﻟﻬﺎ.6
domestic worker from performing his/her job before أو ﻣﻨﻊ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ اﻟﻤﺴﺘﻘﺪﻣﺔ ﻣﻦ اﻟﺪﺧﻮل إﻟﻰ اﻟﻤﻤﻠﻜﺔ
entering Saudi Arabia, or the invalidity of the .اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ
reports of medical examinations performed, the وﺗﻜﻮن ﺣﺪود ﻣﺴﺆوﻟﻴﺔ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﻋﻦ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ
presence of the disease must be confirmed by a (3) ( ﻣﻦ اﻟﺒﻨﺪ رﻗﻢ3-3) اﻟﻤﺴﺘﻘﺪﻣﺔ ﻓﻴﻤﺎ ﻻ ﻳﺨﺎﻟﻒ اﻟﻔﻘﺮة
medical report from a public or private hospital in :ﻛﺎﻟﺘﺎﻟﻲ
Saudi Arabia. ﻣﺤﺴﻮﻣﺎً ﻣﻨﻬﺎ ﻣﺎ،إﻋﺎدة ﺗﻜﻠﻔﺔ اﻻﺳﺘﻘﺪام ﻟﻠﻄﺮف اﻷول
5. Pregnancy (If the domestic worker is a female) ﻳﻌﺎدل اﻟﻤﺪة اﻟﺘﻲ ﻗﻀﺘﻬﺎ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ اﻟﻤﺴﺘﻘﺪﻣﺔ
before entering the Kingdom of Saudi Arabia, within :ﻓﻲ اﻟﻌﻤﻞ ﺣﺴﺐ اﻟﻤﻌﺎدﻟﺔ اﻟﺘﺎﻟﻴﺔ
(90) days from the date of her arrival to the )إﺟﻤﺎﻟﻲ ﺗﻜﻠﻔﺔ اﻻﺳﺘﻘﺪام ÷ ﻣﺪة ﻋﻘﺪ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ
Kingdom. The pregnancy must be confirmed by a ﺑﺎﻷﺷﻬﺮ( × اﻟﻤﺪة اﻟﻤﺘﺒﻘﻴﺔ ﻣﻦ ﻣﺪة ﻋﻘﺪ اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ
medical report from a hospital in the Kingdom of ﺑﺎﻷﺷﻬﺮ
Saudi Arabia. وﻳﺘﺤﻤﻞ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﺗﻜﺎﻟﻴﻒ ﻋﻮدة اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ
6. The invalidity of the security and criminal clearance .اﻟﻤﺴﺘﻘﺪﻣﺔ إﻟﻰ ﺑﻠﺪﻫﺎ ﻓﻲ اﻟﺤﺎﻟﺔ اﻟﺴﺎﺑﻘﺔ
reports conducted for the domestic worker or being
prevented from entering the Kingdom of Saudi
Arabia.
The liability of the second party shall be limited for
the worker who is not in violation of paragraph (1-
2) of Article (1) as follows:

4-2 Payment and financial dealings between the two ﻳﺘﻢ اﻟﺪﻓﻊ واﻟﺘﻌﺎﻣﻞ اﻟﻤﺎﻟﻲ ﺑﻴﻦ اﻟﻄﺮﻓﻴﻦ ﻣﻦ ﺧﻠﻞ اﻟﺤﺴﺎﺑﺎت2-4
parties shall be made through the bank accounts .اﻟﺒﻨﻜﻴﺔ اﻟﻤﺬﻛﻮرة ﻓﻲ ﻫﺬا اﻟﻌﻘﺪ

4-3 In case of updating and adding a new bank accounts ﻳﺘﻢ ﺗﺤﺪﻳﺚ وإﺿﺎﻓﺔ اﻟﺤﺴﺎﺑﺎت اﻟﺒﻨﻜﻴﺔ اﻟﺠﺪﻳﺪة ﺑﻴﻦ اﻟﻄﺮﻓﻴﻦ ﻣﻦ3-4
by one of the two parties it must be done through ﺧﻼل ﻧﻈﺎم ﻣﺴﺎﻧﺪ( اﻟﺘﻮﺛﻴﻖ اﻹﻟﻜﺘﺮوﻧﻲ( وﻳﺘﻢ أﺧﻄﺎر اﻟﻄﺮف اﻵﺧﺮ

Article (5): Contract Termination and Duration ﻣﺪة اﻟﻌﻘﺪ واﻧﻘﻀﺎﺋﻪ:(5) اﻟﺒﻨﺪ
5-1 The duration of this contract is (two Years) Gregorian ﻳﺴﺮي ﻫﺬا اﻟﻌﻘﺪ ﻟﻤﺪة )ﺳﻨﺘﺎن( ﻣﻴﻼدﻳﺔ ﺗﺒﺪأ ﻣﻦ ﺗﺎرﻳﺦ اﻟﺘﻮﻗﻴﻊ1-5
calendar - from the date of signature. The contract Shall وﺗﺘﺠﺪد ﺗﻠﻘﺎﺋﻴﺎً ﻟﻤﺪة أو ﻣﺪد ﻣﻤﺎﺛﻠﺔ ﻣﺎ ﻟﻢ ﻳﺸﻌﺮ أﺣﺪ اﻟﻄﺮﻓﻴﻦ،ﻋﻠﻴﻪ
be automatically renewed for a similar period unless one ( ﻳﻮﻣﺎً ﻣﻦ ﺗﺎرﻳﺦ اﻧﺘﻬﺎءﻫﺎ30) اﻵﺧﺮ ﺑﻌﺪم رﻏﺒﺘﻪ ﻓﻲ اﻟﺘﺠﺪﻳﺪ ﻗﺒﻞ ﺛﻼﺛﻴﻦ

5-2 In the event if one of the party’s requests termination ﻓﻲ ﺣﺎل ﻃﻠﺐ أﺣﺪ اﻟﻄﺮﻓﻴﻦ ﻓﺴﺦ اﻟﻌﻘﺪ وﻓﻚ اﻻرﺗﺒﺎط ﻓﻴﻜﻮن2-5
of the contract and disengagement, this shall be with the ذﻟﻚ ﺑﻤﻮاﻓﻘﺔ اﻟﻄﺮف اﻵﺧﺮ ﻋﻠﻰ أن ﻳﺘﻢ ﺗﺼﻔﻴﺔ ﻛﺎﻓﺔ اﻷﻋﻤﺎل

6-1 The two parties are obligated to observe the ﻳﻠﺘﺰم اﻟﻄﺮﻓﺎن ﺑﻤﺮاﻋﺎة ﺳﺮﻳﺔ اﻟﺒﻴﺎﻧﺎت واﻟﻤﻌﻠﻮﻣﺎت اﻟﺘﻲ ﻳﺤﺼﻠﻮن1-6
confidentiality of the data and information that they ﻋﻠﻴﻬﺎ ﺑﺴﺒﺐ ﺗﻨﻔﻴﺬ ﻫﺬا اﻟﻌﻘﺪ وﻋﺪم اﻓﺸﺎﺋﻬﺎ ﻟﻄﺮف ﺛﺎﻟﺚ إﻻ ﺑﻤﻮاﻓﻘﺔ
obtain due to the implementation of this contract and وﻳﺴﺘﻤﺮ اﻟﻌﻤﻞ ﺑﻬﺬا اﻟﺒﻨﺪ ﺣﺘﻰ ﺑﻌﺪ اﻧﻘﻀﺎء،ﺧﻄﻴﺔ ﻣﻦ اﻟﻄﺮف اﻵﺧﺮ

to work even after the expiration.

7-1 The two parties have agreed that the implementation اﺗﻔﻖ اﻟﻄﺮﻓﺎن ﻋﻠﻰ أن ﻳﺨﻀﻊ ﺗﻨﻔﻴﺬ وﺗﻔﺴﻴﺮ ﺑﻨﻮد ﻫﺬا اﻟﻌﻘﺪ1-7
and interpretation of the provisions of this contract shall ﻟﻸﻧﻈﻤﺔ واﻟﻠﻮاﺋﺢ واﻟﺘﻌﻠﻴﻤﺎت اﻟﺴﺎرﻳﺔ ﻓﻲ اﻟﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ
be subject to the laws, regulations and instructions in . ﻛﻤﺎ ﻳﺸﻤﻞ ذﻟﻚ أﻳﻀﺎً ﻣﺨﺎﻟﻔﺘﻪ ﻣﻦ ﻗﺒﻠﻬﻤﺎ،اﻟﺴﻌﻮدﻳﺔ
force in the Kingdom of Saudi Arabia, and this also
includes any violation committed by either of the two
parties.
7-2 In the event that a dispute arises between the two ﻓﻴﻠﺠﺄ، ﻓﻲ ﺣﺎل ﻧﺸﻮء ﻧﺰاع ﺑﻴﻦ اﻟﻄﺮﻓﻴﻦ ﻳﺘﻌﻠﻖ ﺑﻬﺬا اﻟﻌﻘﺪ2-7
parties related to this contract, the two parties resort to ً( ﻳﻮﻣﺎ30) اﻟﻄﺮﻓﺎن إﻟﻰ ﺣﻠﻪ ﺑﺎﻟﻄﺮق اﻟﻮدﻳﺔ ﻓﻲ ﻣﺪة أﻗﺼﺎﻫﺎ ﺛﻼﺛﻮن
resolving it amicably within a maximum period of thirty ﻓﺈن اﻧﻘﻀﺖ اﻟﻤﺪة وﻟﻢ ﻳﺘﻢ اﻟﻮﺻﻮل إﻟﻰ ﺣﻞ،ﻣﻦ ﺗﺎرﻳﺦ ذﻟﻚ اﻟﻨﺰاع
(30) days from the date of that dispute, and if the period ودي ﻓﻴﺤﻖ ﻟﻮزارة اﻟﻤﻮارد اﻟﺒﺸﺮﻳﺔ واﻟﺘﻨﻤﻴﺔ اﻻﺟﺘﻤﺎﻋﻴﺔ اﻟﺴﻌﻮدﻳﺔ أو

Development (or its delegate) have the right to consider
and look in the dispute and suspend the violating party
accordingly.
8-1 The Two Parties shall commit not to hire brokers or ﻳﻠﺘﺰم اﻟﻄﺮﻓﺎن ﺑﻌﺪم اﻻﺳﺘﻌﺎﻧﺔ ﺑﺎﻟﻮﺳﻄﺎء أو اﻟﺴﻤﺎﺳﺮة أو أي ﺟﻬﺔ1-8
any unauthorized entity, whether inside or outside the .ﻏﻴﺮ ﻣﺮﺧﺼﺔ ﺳﻮاء ﻛﺎن ذﻟﻚ داﺧﻞ اﻟﻤﻤﻠﻜﺔ أو ﺧﺎرﺟﻬﺎ
Kingdom of Saudi Arabia.
8-2 The two parties undertake not to use or deal with ﻳﻠﺘﺰم اﻟﻄﺮﻓﺎن ﺑﻌﺪم اﻻﺳﺘﻌﺎﻧﺔ أو اﻟﺘﻌﺎﻣﻞ ﻣﻊ ﺟﻬﺎت ﻣﻮﻗﻮف أو2-8
suspended or prohibited entities, whether inside or .ﻣﺤﻈﻮر اﻟﺘﻌﺎﻣﻞ ﻣﻌﻬﺎ ﺳﻮاء ﻛﺎن ذﻟﻚ داﺧﻞ اﻟﻤﻤﻠﻜﺔ أو ﺧﺎرﺟﻬﺎ
outside the Kingdom of Saudi Arabia.
8-3 The Parties undertake not to contribute, form or ﻳﻠﺘﺰم اﻟﻄﺮﻓﺎن ﺑﻌﺪم اﻟﻤﺴﺎﻫﻤﺔ أو ﺗﺸﻜﻴﻞ أو ﺗﺴﻬﻴﻞ اﻹﺗﺠﺎر3-8
facilitate human trafficking, child labor or the .ﺑﺎﻷﺷﺨﺎص أو ﺗﺸﻐﻴﻞ وﺗﻮﻇﻴﻒ اﻷﻃﻔﺎل و اﻷﺣﺪاث
employment of juvenile.
8-4 The two Parties shall undertake not to mediate or ﻳﻠﺘﺰم اﻟﻄﺮﻓﺎن ﺑﻌﺪم اﻟﺘﻮﺳﻂ أو اﻟﻀﻠﻮع ﻓﻲ اﺳﺘﻘﺪام ﻣﻦ ﻳﻘﻞ4-8
engage in the recruitment of people who are under the .ﻋﻤﺮه ﻋﻦ واﺣﺪ وﻋﺸﺮون ﻋﺎﻣﺎً ﺑﻘﺼﺪ اﻟﻌﻤﻞ
age of Twenty-one years old for the purpose of
employment.
8-5 The First Party shall not associate and contract with ﻻ ﻳﺠﻮز ﻟﻠﻄﺮف اﻷول أن ﻳﺮﺗﺒﻂ ﻣﻊ أﻛﺜﺮ ﻣﻦ اﻟﻌﺪد اﻟﻤﺤﺪد ﻣﻦ5-8
more than the specified number of Recruitment Office/ ﻛﻤﺎ،ﻣﻜﺎﺗﺐ ووﻛﺎﻻت اﻟﺘﻮﻇﻴﻒ اﻟﺨﺎﺻﺔ ﺑﺈرﺳﺎل اﻟﻌﻤﺎﻟﺔ ﻓﻲ ﻫﺬه اﻟﺪوﻟﺔ
Agency for domestic workers in the second party country. ﻻ ﻳﺠﻮز ﻟﻠﻄﺮف اﻟﺜﺎﻧﻲ أن ﻳﺘﻌﺎﻗﺪ ﻣﻊ أﻛﺜﺮ ﻣﻦ اﻟﻌﺪد اﻟﻤﺤﺪد ﻣﻦ

Arabia and the Ministry of Labor of the second party
country state.
8-6 The second party shall undertake to ensure and ﻳﻠﺘﺰم اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﺑﻀﻤﺎن اﻟﻌﻤﺎﻟﺔ ﻟﻠﻄﺮف اﻷول ﺣﺘﻰ ﺑﻌﺪ إﻧﻬﺎء6-8
guarantee the domestic workers to the first party even .اﻟﻌﻘﺪ وﻓﻚ اﻻرﺗﺒﺎط ﺑﻴﻨﻪ وﺑﻴﻦ اﻟﻤﻜﺘﺐ اﻟﺴﻌﻮدي
after the termination of the contract and the partnership
